December 30, 1991 Council Meeting
DECEMBER 30, 1991
A special called meeting of Mayor and Council was held pursuant to the
Charter on December 30, 1991 at Smyrna City Hall. The meeting was called to
order at 6:30 o'clock p.m. by presiding officer Mayor A. Max Bacon. All
council members were present except Bob Davis. Also present was City Clerk
Melinda Dameron and City Attorney Charles E. Camp. The purpose of the
meeting was to hear a request for a privilege license for Jocks & Jills
Restaurant.

Mayor Bacon stated this is a public hearing and asked if anyone was present
in opposition to this request. There was none.
Mayor Bacon stated the reason for the special called meeting is due to the
fact that some of the owners of Jocks and Jills will only be in town this
weekend and we are trying to accommodate them in order for them to have their
grand opening. Normally the request would have been heard on January 6,
1992, but since this location has been a very good location for beer, wine
and liquor pouring we felt it would be in line for us to try to accommodate
them as much as possible.
Wade Lnenicka asked Mr. Small to tell us a little about the business he
wanted to open.

Mr. Small responded that they were a sports bar and indicated they had been
in business downtown for about four years and they have two locations
currently, in mid-town and Jimmy Carter Boulevard. We are more of a
restaurant than a bar and we do serve more food than we do liquor. We have a
very good lunch program and have televisions in the restaurant where they can
show all the sporting events.
Councilman Lnenicka asked Mr. Small if he had held an alcoholic beverage
license before and Mr. Small responded that he had. Mr. Small is currently
the licensee on the downtown location and has held that license for four
years. Mr. Lnenicka asked if there had ever been any problems with holding
that license and Mr. Small said they had been caught serving a minor in the
time that Atlanta busted two hundred establishments in July of 1989, but
nothing since that time. Mr. Small indicated they would have between
eighteen and twenty-four employees and most of them are current employees who
have been trained in who can be served and who can not be served. They will
have training classes for the employees on Thursday night and have an
on-going training process for this purpose. During special events they will
hire police officers to be at the door to assist in determining age limits.
The bar only accepts valid Georgia Drivers License as a means of
identification if there is a question as to the age of the patron.
Councilman Lnenicka stated for the record that we do have a letter from
Police Chief Stan Hook indicating there was no derogatory information that
would preclude the issuance of this license.
Councilman Wood asked if the bar was leasing the space and how much large the
establishment was. Mr. Small indicated the space would be leased and is
approximately two thousand square feet. The seating capacity is 96 people
and an additional 20-24 people can be accommodated on the patio.

Mayor Bacon cautioned that all rules and regulations should be followed as
pertains to being certain not to sell to minors. Councilman Lnenicka asked
if Mr. Small had read and understood all the ordinances given to him and Mr.
Small indicated he had read and understands the ordinances. Mr. Small also
indicated they had set up a deal with Checker Cab and Anheuser Busch, called
Alert Cab, to drive people home if they need to be taken home instead of
allowing them to drive their own car.

Councilman Lnenicka made a motion that the beer, wine and liquor pouring
license for Jocks and Jills at 2569 Cobb Parkway be approved. Motion was
seconded by Councilman Scoggins. Motion was approved 6-0.
Mayor Bacon asked if there was any other business to be brought forward.
Councilman Lnenicka made a motion to suspend the rules for discussion of what
to do with our recycling contract that expires December 31, 1991. Councilman
Scoggins seconded the motion. Approved 6-0.
Councilman Lnenicka stated that we need to discuss the recycling contract.
He feels the contract should be extended in order to allow us time to
determine what course of action the City wishes to follow.

Councilman Scoggins stated this program had been costly and we should proceed
slowly with our decision. Mayor Bacon stated he felt the City needs at
least ninety days to corne up with a decision.
Councilman Lnenicka made a motion to extend our pilot recycling contract with
Chambers Development Company for ninety days through the end of March and
allow the Mayor to extend the contract on a month-by-month basis through June
30. Councilman Scoggins seconded the motion. After discussion Councilman
Lnenicka amended his motion that the funds to continue this contract shall
come from the contingency account. Councilman Hawkins seconded the amended
motion. The amendment to the motion was approved 6-0. The main motion was
approved 6-0.
