October 19, 1992
The regular scheduled meeting of Mayor and Council was held October 19, 1992 at
Smyrna City Hall. The meeting was called to order at 7:30 o'clock p.m. by
presiding officer Mayor A. Max Bacon. All council members were present. Also
present was City Administrator Bob Thomson, City Clerk Melinda Dameron, City
Attorney Charles E. Camp, Recreation Coordinator Patty Bacon, Communications
Director Steve Ciaccio, Accounting Supervisor Claudia Edgar, Library Director
Laurel Best, Police Chief Stan Hook, Community Relations Director Kathy Barton,
Public Works Director Vic Broyles, City Engineer Ken Hildebrandt, Fire Chief
Larry Williams and representatives of the press.

Invocation was given by Councilman Pete Wood, followed by the pledge to the flag.
CITIZENS INPUT: Judy Mann with the Cobb County Animal Shelter Society urged
everyone to vote yes on the special referendum November 3rd to approve funding
for a new animal shelter.
Mayor Bacon recognized Ann Brady who will represent Smyrna on the Cobb County
Board of Education after January 1, 1993.
PUBLIC HEARINGS:
(A) Variance request - reduce front yard at 2756 Stonecreek Road
Bob Thomson stated that Mr. J. D. Cunningham is requesting a variance to reduce
the front setback from 35 to 26 feet and the side yard from 10 to 9.1 feet for
a porch addition at his home. There was no opposition.
Mr. Cunningham said the footings had been in place for about 4 years and he did
not realize that the setback requirements applied when the addition was not
attached to the house itself.
Councilman Jack Cramer said he had no problem with the variance and made a motion
it be approved. Bill Scoggins seconded the motion which carried 7-0.

(B) Privilege license - agent change at Spring Road Package Store, 1669 Spring
Road
Bob Thomson stated that Ms. Judy Lee is requesting a license as the new
owner/agent for Spring Road Package. Ms. Lee has been the owner since 1991 but
at the time the license was originally issued, did not meet residency
requirements. Ms. Lee is now a resident of Cobb County and has lived here for 1
year. The police investigation was favorable and there was no opposition.
Ms . Lee said she had read and understood the ordinance and would check
identification of almost everyone who made purchases. Councilman Scoggins made
a motion the agent change be approved. Pete Wood seconded the motion which
carried 7-0.
(C) Privilege license - agent change at K&L Food Mart, Inc., 540 Concord Road
Bob Thomson stated that Khe Van Tran is requesting a license as the new
owner/agent for K&L Food Mart, formerly Sing Food Store. This property was
annexed into the City in 1991. The police investigation was favorable and there
was no opposition.
Mr. Van Tran said he was familiar with the ordinance requirements relative to the
sale of alcoholic beverages and always checked age on drivers license. Councilman
Wood said this location has been in the City for just under a year and wanted to
... be sure that the employees are familiar with our ordinances. Mr. Van Tran said
he had been a resident of Cobb County for 1 year and had been in this business
for 5 years.
Councilman Wood made a motion the license be approved. Bill Scoggins seconded the
motion which carried 7-0.

BID AWARDS:
(A) Elevator Maintenance
Jack Cramer made a motion the bid for elevator maintenance be awarded to General
Elevator for their bid price of $178 per month. John Patrick seconded the motion
which carried 7-0.
... CONSENT AGENDA:
(A) Approval of October 5, 1992 minutes
Wade Lnenicka made a motion the consent agenda be approved. Jim Hawkins seconded
the motion which carried 7-0.
COMMITTEE REPORTS:
John Patrick reported there has been a problem in his ward with unsecured garbage
containers at the curb, creating a litter problem and warned that citations may
be issued to those at fault.
Laurel Best was called on for a report from the Library.
Ron Newcomb stated he had received a proposal from Kathy Barton and Jim Hawkins
regarding recycling at Country Park and Countryside and would be meeting with
them soon to discuss further. Also, the Department of Transportation will conduct
a public hearing at Argyle School on November 15, 1992 to discuss proposed
widening of Cobb Parkway.
Bill Scoggins said he had received several calls about the civil defense sirens
sounding during the night recently and called on Steve Ciaccio for a report. Mr.
Ciaccio said that apparently the switch became stuck on one siren at the Police
... Station from a previous day 12:00 noon test. The operators were unable to cancel
the alarm from their control panel and it had to be manually disengaged.
Councilman Jim Hawkins called on Vic Broyles and Kathy Barton for reports. Mr.
Hawkins said he was surprised at the wide range of bids for the solid waste
management study and stated that is a mandated program that we must have in place
or be penalized by the State. The study can be funded through host fees paid by
Southern States and Chambers Development since that money must be designated only
for sanitation-type issues. Hopefully by next budget year, we will be able to
purchase some of the City's rolling stock out of this fund balance.
Councilman Jack Cramer called on Patty Bacon for a report from the Parks
Department. Mr. Cramer said he still receives complaints about the dog problem
and we might need to consider an additional part time person for that department.
Also, the City continues to work on water and drainage problems. Mr. Cramer said
he was a police officer in the State of Georgia and backed the police department
in this city. A question was raised recently when he wore a gun to City Hall, but
he is a certified officer in the State and would uphold the laws as long as he
held his credentials.
Councilman Wade Lnenicka called on Stan Hook for a report from the Police
Department. Mr. Lnenicka said he had talked with a number of residents about
other issues and many of them have given high reviews to our police department.
Mr. Lnenicka announced that Personnel Director Jane Mears has announced her
... resignation the end of this month and he wished her well in her new career.
Mr. Lnenicka also announced that a decision has been made to replace the
equipment at Creatwood Park which is basically designed for kids that are 10 to
14 years old but the ones using the park now are much younger. We have managed
to locate some equipment on sale for about 1/3 off and the money is in the
budget. It should be delivered and installed sometime around the middle of
November and the existing equipment will be relocated to Jonquil Park.
Councilman Pete Wood said that Jane Mears has resigned to accept employment
elsewhere. She has made a lot of achievements for the City and we wish her well.

We will soon be advertising for qualified applicants to fill this position as
well as the Finance Director's position.
Mayor Bacon recognized five American Government students from Campbell High
School. With no further business, meeting adjourned at 8:44 p.m.
