April 20, 1992 Council Meeting April 20, 1992 The regular scheduled meeting of Mayor and Council was held April 20, 1992 at Smyrna City Hall. The meeting was called to order at 7:30 o'clock p.m. by presiding officer Mayor A. Max Bacon. All council members were present. Also present was City Administrator Bob Thomson, City Clerk Melinda Dameron, City Attorney Charles E. Camp, Finance Director Emory McHugh, Parks and Recreation Director Sherry Reavis, Library Director Laurel Best, Police Chief Stan Hook, Community Relations Director Kathy Barton, Public Works Director Vic Broyles, Fire Chief Larry Williams, City Engineer Ken Hildebrandt, Personnel Director Jane Mears, Communications Director Steve Ciaccio and representatives of the press. Invocation was given by Reverend Stephen Kimmell from the First Baptist Church. .. Councilman Bill Scoggins recognized Firefighter Jeff Pierson who recently won the weightlifting competition event at the Southeastern Fire Academy. Ron Newcomb read a proclamation for Child Abuse Awareness Month and presented it to Dr. Scott Anderson, family therapist. Pete Wood presented Youth. read it to a proclamation for the Appreciation for the Love of Kids and Judy Pell with the Cobb County Commission on Children and CITIZENS INPUT: A resident of 2756 Old Concord Road complained of increased water runoff onto his property as a result of curbing installed on Old Concord Road and also asked who would be responsible for keeping the grate on his property cleaned out. Vic Broyles stated this property is in the county and the curbing was installed on our city streets but would agree to keep the grate cleaned. Steve Turley, Commander of the Smyrna American Legion presented plaques of appreciation to Firefighters Darryl Purvine, Tony Motes and the Smyrna Fire Department. On February 12th these two gentlemen responded to a call at the American Legion and administered emergency first response treatment to a guest. They were on the scene within 3 1/2 minutes and their quick response and professional treatment was felt to have saved the woman's life. .. PUBLIC HEARINGS: (A) Variance request - 219 Oak Forest Drive Bob Thomson stated that Mr. C. C. Lee is requesting this variance to construct a garage on a vacant lot behind his home. This is a vacant recorded lot and since there is no principal building, a variance is required for the accessory structure. There was no opposition. Mr. the this told Lee said the garage would be used to store his two boats and make room in garage attached to his home for his automobiles. Councilman Wood stated property was recently annexed into the City and at that time Mr. Lee us of his intent to build a garage. Mr. Wood said the garage would be compatible with his home and could see no problem with it and made a motion the variance be granted as requested. Bill Scoggins seconded the motion which carried 7-0. Mayor Bacon recognized Charlie Bailey, candidate for Cobb County Eastern District Commission. FORMAL BUSINESS: .. Jim Hawkins seconded the motion which carried 7-0. (C) Appointment to Clean City Commission - Ward 4 Jim Hawkins made a motion that Jean Brannon be appointed to the Clean City Commission representing Ward 4. Pete Wood seconded the motion which carried 7-0. ... (D) Approval of insurance for City of Smyrna Bob Thomson stated the current health insurance carrier (Cigna) has announced a rate hike of 39%, an additional cost this year of $541,111. A self-insured program is proposed coupled with a cafeteria plan. Self-insuring would allow us to control the design of the plan and enable us to earn interest on the reserve trust account. Pete Wood said the Finance Committee and full council had met several times regarding the proposal and based on their recommendation made a motion to approve a self-funded health plan for city employees, basically an 80% indemnity PPO type program. All family coverage employee contributions and deductible amounts will be processed through an internal revenue code qualified cafeteria plan which will result in significant savings for the city and its employees. The City will enter into an agreement with ARS Benefits, Inc. to serve as plan administrator for the self-funded health plan and at a future date the Mayor and Council will discuss and make a decision regarding the administration of the cafeteria plan. Jim Hawkins seconded the motion. Vote on the motion carried 7-0. (E) Establishment of water surcharge rate Bob Thomson said at the April 6, 1992 the Council amended its water supply contract with the Cobb-Marietta Water Authority. This amendment allows a surcharge on the excessive use of water during summer months. The purpose of the surcharge is to encourage the conservation of our limited water resources. The surcharge rate being established by the county is at 90 cents per thousand gallons, to be applied when the monthly consumption exceeds the greater of: 125% of the winter (December, January, February) base rate or 5,000 gallons above the winter base rate. ...., Pete Wood said this proposal is part of the Regional Water Supply Plan and we are passing through what the county will be charging us. The Finance & Administration has recommended approval of the rate structure and Mr. Wood April 20, 1992 meeting - continued made a motion the sur-charge rate of 90 cents per thousand gallons be established to apply when monthly consumption exceeds the greater of 125% of the winter base rate (December, January, February) or 5,000 gallons above the winter base rate. Jim Hawkins seconded the motion for discussion and stated it was his understanding that the 90 cents would apply only when you exceed 125% of the winter base rate, or a 5,000 gallon minimum each month. The recommendation presented tonight incorrectly states that the surcharge applies when you reach 5,000 gallons above the winter base rate. Mr. Wood said that was correct; any billing under 5,000 gallons will not be surcharged. After further discussion, vote on the motion as corrected carried 6-1 with Wade Lnenicka opposed. .. Jim Hawkins made a motion that item (E) on the consent agenda be approved. Jack Cramer seconded the motion which carried 6-1 with Wade Lnenicka opposed. COMMITTEE REPORTS: ... Jack Cramer presented a plaque of appreciation from Smyrna Little League and presented it to Sherry Reavis. Ms. Reavis then gave a report on activities in her department. Jim Hawkins called on Vic Broyles for a report from Public Works and asked about the resurfacing program. Mr. Broyles said he was not sure how much money was left in the 1% road program but he thought there was about $100,000 and he needed for council to decide how those funds should be spent. Installation of the left turn lane on Spring at Glenroy should begin this week if weather permits. Ron Newcomb said he recently learned that the average daily vehicle count for Spring Road is 33,000 vehicles and the expenditure of this $1,500 will enable people to turn safely into their neighborhoods. Jim Hawkins called for a report from Kathie Barton on the Jonquil Festival activities this Saturday. The parade begins at 10:00 a.m. with the arts and crafts show at Village Green Circle, an auction also at 10:00 a.m. and dance Saturday night. Bill Scoggins called on Chief Larry Williams for a report from the Fire Department. .... Ron Newcomb gave a report from Community Development and stated that Heritage Pointe apartments had recently been renamed and renumbered at the request of the Smyrna Post Office. The committee also has agreed to have the Cobb County Water System review the City of Smyrna sewer development plans which should provide a quicker turn around than going through the Georgia Environmental Protection Division. This is a mandated plan and we are also doing a study to determine a reasonable fee to pass on to developers. The committee has studied a draft of a tree preservation ordinance and will contact local developers and refer to the Planning and Zoning Commission for input. Also, minor changes are being proposed to the buffer definition section of the zoning ordinance. John Patrick thanked Vic Broyles for his services in helping to solve problems in Ward 1. Mr. Patrick said he was also concerned with lack of lawn maintenance in his ward. April 20, 1992 meeting - continued Laurel Best was called on for a report from the Library. Mayor Bacon announced that S.B. 685 was approved this year and the bill has been signed into law by the Governor. This bill will allow us to provide $10,000 homestead exemption to residents 62 and older, provided the amendment is approved by the voters on July 21st.
