Special Called Meeting - December 29, 1994
A special called meeting of Mayor and Council was held at Smyrna City Hall. The meeting was called
to order by presiding officer Mayor A. Max Bacon at 7:00 o'clock p.m. All council members except
Ron Newcomb were present. Also present was City Administrator Bob Thomson, City Clerk Melinda
Dameron and City Attorney Charles E. Camp.
PUBLIC HEARINGS:

Annexation of Property - Belmont Circle - Land Lot 446,
17th District, 2nd Section of Cobb County

Mr. Thomson stated James A. Evans, Jr., has requested the annexation of property in Land Lot 446 of
the 17th District and 2nd Section of Cobb County, Georgia, being Parcel 9, and more particularly
described as follows:
BEGINNING at the common intersection of Land Lots 446, 447, 490 and 491; thence northerly along
the common lot line of Land Lots 446 and 491 a distance of 663 feet more or less to a point, said point
being the POINT OF BEGINNING; thence westerly a distance of 511 feet to a point on the eastern right
of way of Belmont Circle; thence northerly along said right of way of Belmont Circle a distance of 228
feet to a point; thence easterly a distance of 211 feet more or less to a point; thence northerly a distance
of 12 feet more or less to a point; thence easterly a distance of 300 feet to a point on the common lot line
of Land Lots 446 and 491; thence southerly along the common lot line of Land Lots 446 and 491 a
distance of 240 feet to the POINT OF BEGINNING.
Mr. Thomson stated the public notices had been advertised December 15, 1994, and December 22, 1994.
Mayor Bacon stated this is a public hearing and asked if anyone was present in opposition to the
annexation of this property. There was none.

Councilman Cramer stated the property was zoned RM-12 to the plat for eight units per acre in the
county and the houses will be 10' apart from roof top to roof top. He further stated the houses will be
shifted on the lots to allow for additional parking. Councilman Cramer made a motion the annexation
of the above listed property be approved and made a part of Ward 5 with the following stipulations and
to be effective December 31, 1994. 1. No home shall be any closer than 6 inches from the side property
line and no home shall be any closer to any other house than 10' roof edge to roof edge. 2. Each home
shall be provided sufficient parking space so that if there are two cars, one may pull in and out of the
garage without having to move the other car. Councilman Lnenicka seconded the motion. Motion was
approved 6-0.
