The regular meeting of the ~ayor and Council WaS held at the City
Hall January 7, 1952,7:30 P. M.
Mayor J. M. Gibson presiding. Oath of office was given by-Mayor
J. M. Gibson to newly elected Councilmen C. M. Hamby, Harry Mitchell,
Jr., and Glenn Yarbrough. Other Councilmen.present, C. W. Jones and
John Collier. Assistant City Engineer, Ralph Lewis, Jr., present.
Minutes of special meeting December 27, 1951 read and held in abeyance
for retiring Councilmen to approve.
Mayor Gibson read appointments of committees 1'01' the yeAr.,1952.
Motion by C. M. Hamby: to question authority of Mayor of making
appointments of Electrical Board, Building Inspector, Civil Defense,
Zoning and Planing Board and Plumbing Board and to hold up on these
appointments, .seconded by C. W. Jones. Voting for C. M. Hamby, C. W.
Jones, Harry Mitchell, Jr., and Glenn Yarbrough. Voting against
John Collier. Motion carried.
Mayor ask that a ruling in writting be given by Attorney General,
Eugene Cook regarding above question.

Motion by C. W. Jones to add an, appropriation to the budget for the
Fire Department. There being no second, motion lost.
Motion by C. W. Jones: that the Electrical Inspector, Plumbing In-
spector, and Building Inspector be salaried employees to be paid from
the General Fund. There being no second, motion lost.
Raymond Reed, B. F. Reed, Jr., Mrs. stewart and Mr. J. F. Bradfield
came before the Council in regard to a notice being given them by the
Health Department stating that Southern Manor Apts. must be on sewerage
as at present, not being on sewerage it is considered a state of emer-
gency from a health standpoint.
Motion by John Collier seconded by Harry Mitchell to authorize immedi-
ately a survey to estimate the cost of seTIerage for ~he Southern Manor
Apt. Area which is not on sewerage including Church st., Mann st.,
. Davis and Stephens sts. Voted unanimous.
Mayor's budget for 1952 studied. Motion by C. M. Hamby seconded by
Glenn Yarbrough to accepx Budget of General Fund with the following
adrnendments: 1.Clerk's salary to be decided on later; 2.Fire Dept.
Supplies, $400.00 and Kindergarten donation $180.00. to be added to
budget; 3.Miscellaneous be reduced from $250.00 to $100.00.
Voted unanimous as admended. Budget attached to these minutes.

Motion by Glenn Yarbrough to re~elect Mrs. Theodocion as City Clerk
at a salar.y of $250.00 per month. Seconded by C. W. Jones. Voted

Motion by Glenn Yarbrough to elect C. B. Mayas Chief of Police at a
salary of $250.00 p~r month. Seconded by C. W. Jones. Voted unanimous.
Motion by Harry Mitchell seconded by Glenn Yarbrough that J. C. Hardy
be permitted to remain as Chief ~f Police until Janua~y 12, 1952 at
mid night. . Voted unanimous.
New Chief of Police pay to begin January 8, 1952.
Motion by.Glenn Yarbrough seconded by C. W. Jones to elect Bob Taylor
ii's Building Inspector. Voted unanimous.
Bob Taylo~ ask that such agreements regarding the inspections between
he and Ralph Lewis be made and subject ,to approval of Council.
Motion by Harry Mitchell seconded by C. W. Jones to elect the follow-
ing to serve as Zoning and Planing BOard: Glenn Yarbrough, chairman,
Ralph Lewis, Jr., Bob Taylor and C. C. Terrell. Voted unanimous.

following to serve on the Plumbing Board: Chairman to be named by

Raymond Reed as City Attorney. Voted unanimous.

Discussion of Southern Manor sewerage situation.
Harry Mitchell states he would like to go on record as rescinding vote
on Chief of Police.
Motion by Harry Mitchell seconded by Glenn Yarbrough in regard to the
action of council in the case of electing chief of police be rescinded
and the Case be open for further consideration. Voting for Glenn
Yarbvough, Harry Mitchell. .Voting against C. W. Jones. Motion carried.
Action to be postponed.:~until next meeting.
Guy Duncan came before the Council requesting a street light to be in-
stalled on Fuller street. Need for light to be investigated.

home due to illness there was no meeting. Mayor J. M. Gibson called
for the continutation of the regular meeting for January 21, 1952.

January 21, 1952, 7:30 P. M. at the City Hall, Mayor J. M. Gibson,
preslding with the following Councilmen pI' esent; C. M. Hal'l'lby, Harry
~itchell, and Glenn Yarbrough, Jr: City Engineer, M. J. Hensley and
Assistant City Engineer Ralph Lewis, Jr. present.
A hos t of ci tizens gathered at the City Hall for the meeting which they
had been invited and a note was sent into the Council room requesting
that the meeting be moved to the American Legion Home which Was pre-
Pared to take Care of t~e meeting.
Motion by Glenn Yarbrough seconded by C. M. Hamby to move the "council
meeting to the American Legion Hall"for the evening. Voted unanimous.
Mr. Lex Jolley, read report of the annual audit for the year 1951,
which was prepared by Charles P. Bagley Co., Atlanta, Ga.
Motion oy Glenn Yarbrough, Jr. seconded by C. M. Hamby to accept 1951
audit report. Voted unanimous.
Mayor J. M. Gibson recommend that E. C Bramblett and C. Dyre Eubanks
to elected to fill the unexpired term~ of: C. W' Jones and John Collier
who each resigned. .',
Motion by C. M. Hamby seconded by Glenn Yarbrough, Jr. to elect Eugene
Rice to fill the unexpired term of John.Collier. Voted unanimous.
Motion by Harry Mitchell seconded by C. M. Hamby to elect C. C. Terrell
to fill the unexpired term of C. W. Jones. Vote~ unanimous.

Mayor Gibson stated that Wednesday, January 23, 1952 was the dead
line for municipalities to apply for Federal Aid. He stated upon
report given by City Engineer, ~. J. Hensley the overall program
would cost app. $870,000,008 for the City expansion, and that
$470 ,000 ~OO'} would be aVAilable as Federal Aid from the Govern-
ment if the City could have financed $400,000.00(, for which amount
the City financial condition would justify.

authority to proceed with appliCation for Federal Aid from the Home
Housing and Finance Corporation. Voted unanimous.
Motion by C. M. Hamby seconded by Harry Mitchell to elect.as the
Zoning and Planing Board for 1952 the following: Glenn Yarbrough, Jr.,
chairman, Bob Taylor, Dr. D. C. Landers, S. H. McCalla, Raymond Reed,
and E. C. Bramblett. Voted unanimous.
Motion by Glenn Yarbrough, Jr., seconded by Eugene Rice to elect as
the Plumbing Board for 1952 the following: C. C. Terrell, chairman, J-
Inspector, W. 'L. Westbrook, Bill RObinso:Q, Harley Mgrris and "I
James Mines. Voted unanimous.
Motion by Glenn Yarbrough seconded by Eugene Rice to elect Bob Taylor
as Building Inspector for 1952, effective this date. Voted unanimous.
Motion by Harry Mitchell seconded by Eugene Rice to retain the services
of both Ralph LeWis, Jr. as Assistant Engineer and J. T. Brown, as .
General Supt. of Construction. Voted unanimous.
Letter read by Mayor Gibson from Attorney Raymond Reed declining the
offer given him by the Council as City Attorney.

Motion by Harry Mitchell seconded by Glenn Yarbrough, Jr. to elect
J. C. Hardl as Chief of Police and Marshall for City of Smyrna at a
salary of ~250.00 per month. Voting for Glenn Yarbrough, Jr., Harry
Mitchell, Jr., Eugene Rice and C. C. Terrell. Voting against C. M.
Hamby. Motion carried.

Minutes of previous session read for information.
Motion by Eugene Rice seconded by C. C. Terrell to have clerk write
a letter expressing the concern of the Council for the Mayor who is
ill and in the hospital. Voted unanimous.

Motion by Eugene Rice seconded by Harry Mitchell, Jr. to elect Mrs.
Louise Logan at a salary of $36.00 per week,(5t days)~~Voted unan-
im ous .
Ralph Lewis, Jr. reported to the Council that he and Mr. poss had
been to Newnan to investigate .the water tank for sale and that it
was their opinion that the tank was the best buy of any investigated.
Motion by Eugene Rice seconded by Glenn Yarbrough to hold over until
next meeting a decision regarding purchase of a water tank and that
Mr. Brovm at Newnan be contacted if time could be extended on a de-
cision until the next meeting of the Council and if not a call meet-
.ing would be called in regard to the matter. Voted unanimous.
Resignation of Fire Chief Earl Cobb read. It was reported by
Eugene Rice that Mr. Cobb would reconsider if given $100.00 per month
for fire building rent and he would also cut the 1dst of ten firemen
down to eight.
Motion by C. C. Terrell seconded by Eugene Rice to pay $100.00 per
month fire building rent and $10.00 per month to eight volunteer
firemen instead of ten volunteer as set up in the budget. Voted
unanimous. This action effective February 1, 1952.

Section 6. Be it further ordai~ed that it shall b~ unlaw-
ful for any pool room to remam open after 11 0 clock at
night, or allow any games played.on po.ol tables, and where
poolroom is operated in connection wlth lunch count~r or
other business the proprietor or operator of such busmesi
shall keep dark and not allow public access to the }?art 0
building in which pool tables are located. And all wmdows
and doors facing the streets must be kept clear of all post-
ers, signs, paint or other obs.tacles that would cut off the
r view of the passing pedestrians.
Section 6 Be it further ordained it shall be unlawful
for any per'son, firm or corporation to sell or offer tOf s~ll
any alcoholic liquor, wine, beer or ml;llt beverages 0 m-
toxicating nature after 11 o'clock at mght.
Section 7. ' Be it further ordained b~ the Il;uthority afore-

tion 55 or the Code of said City.
Section 8. Be it further ordained by the authority afore-
said that the Mayor of the City shall have the right to re-
voke any license issued under this ordinance, whether a
person doing business under such license sha" violate any
law or ordinance of the United States, or of the State of
Georgia or of the Town of Smyrna, in pursuance of such
business conducted under such license, or when it shall
be proven before the Mayor that the health, morals, inter-
est and convenience of the public demand the revocation
of such license or the person, firm or corporation holding
such license was issued, and said Mayor shall report his
revocation of such license to the next regular meeting of
the City Council for their ratification or rejection and
should the action of the Mayor be sustained by the Coun-
cil, then the said license shall be permanently revoked,
otherwise it shall be restored and remain in full force.
Section 9. Be it further ordained by the authority afore-
said that the license issued under this ordinance shall be
transferred to any other person, firm or corporation doing
the same business at the same place or places of business,
upon the written approval of such transfer, by the Mayor
of this City, who shall have full discretion to approve or
disapprove such transfer.
Section 10. Be it further ordained by the authority of
the aforesaid that any persons who shall begin or carry
on an~ said business or occupations without first obtain-
ing said license as prescribed above, shall upon conviction,
be fined by the Mayor in a sum not exceeding $100.00 or
in default of the payment thereof shall be required to work
on the streets of said City not exceeding fifty days.
Section 11. Be it provided that if any section, para-
graph or part of this ordinance shall for any reason be ad-
judged by a court to be invalid, such judgement shall not
affect the remainder of the Ordinance.
