The regular meeting of the Mayor and Council Was held at the City
Hall, December 3, 1951. Mayor J. M. Gibson, presiding with the
following Councilmen present; H. L. McEntyre, C. W. Jones, John
Collier, and Stanley McCalla. City Engineers M. J. Hensley and
Ralph Lewis, Jr.

approve minutes of regular and special meetings as read. Voted
unanimous.

Nayor Gibson appointed Stanley McCalla and John Collier to con-
tact Mrs. C. ~. Durham regarding taxation of property on Fleming
Street, of two houses. ~
Motion by John Collier seconded by Stanley MCCalla to pay $200.00
for Christmas lights and installation project sponsored by Smyrna
Menls Club. Total cost of project app. $1,000.00 Voted unanimous.
Motion by John Collier seconded by Stanley MCCalla to accept into
city limits Wilson Lavender and B. L. Walker property located on
Corn Road and Spring st., of forty acres. Voting for.J9hn Qollier,

hundred forty (140) houses, each house to contain not less
than four rooms and bath and not less than six hundred fifty
(650) square feet of floor space;

Gentlemen:
Pursuant to previous negotiations between F. Stephen Hall,
Jr., and the Honorable Mayor and Councilor the Ci ty or Smyrna,
Georgia, F. Stephen Hall, Jr., as the owner or the following
described property, namely:
All that tract or parcel or land lying and being in
the 17th District and 2nd Section of Cobb County, Georgia,
and being what is known as the Judge John M. Stone farm
located about one mile west of the City of Smyrna, con-
sisting of 121 acres, more or less, and being made up of
the rollowing lots and parts or lots of land as follows:
Allor land lot No. 378, being 40.22 acres, more or
less, and bounded on all sides by the original land lot
lines; 18.19 acres, more or less, orr or the east side or
lot No. 377, bounded on the west by the creek and on all other
sides by the original 'land lot lines; one (1) acre, more or
less, of the south, near the center, side of Lot 376, boun-
ded on the west by the creek, north by the center of the
Smyrna-Powder Springs public road, and on the south by
original land line of the south side of said land lot; 32.39
acres, more or less, of_the western side or lot 416 and being
all of said lot except a triangular tract orf of the east-
southeastern side of said lot, the apex of the triangle
being at the northeastern land line corner of said lot and
the base measuring 217 feet along the south land line of
said lot beginning at the southeast corner thereor, this
triangular tract being now, or rormerly owned by one Rollins,
the 32.39 acres of this lot herein described being bounded
on north by the center of the Smyrna-Powder Springs road,
south and west by the original land lines of said lot, and
east by said Rollins triangular tract; also 29.20 acres more

6. Contract agrees to repair at no cost to Cit~ all leaks at. seams or rivets
at points where same were repaired by this contractor in 1947 When they
repaired and painted tank. If any repairs are necessary at places where
Contractor did not make repairs in 1947, the following rates shall govern
for repairs necessary and approved by City of S~yrna; .25 cents per inch
for all seam welding WEther it be horozontal, overhead or verticle; .25
cents per rivet re~elded and .25 cents per square inch of pit or less.
At pla.ces where repairs are made same shall be prine d with zinc chroma'te
and covered with two coats of tank reliner. All work shall carry 10 year
guarantee if contractor is given contract to re-pai~ tank every five
years or sooner.

expense all paint and other materials necessary to complete contract work, Paint and materials furnished shall be
of high quality and standards. Wherever provision is made under specifications for use of trade marked materials,
such trade marked materials shall be used. Municipality agrees to furnish at its own cost and expense and to have
available at site of its water storage tank all electric current necessary for the performance of this contract.
INSURANCE AND COMPENSATION Contractor agrees to carry full coverage Public Liability, Property
Damage and Workmen's Compensation Insurance. Insurance Carrier shall be licensed to do business in the

WEATHER CONDITIONS Contractor agrees that all painting shall be done "in the dry" and that no painting
shall be done in unseasonable weather.
INSPECTION Municipality shall furnish, at its own cost and expense, an inspector duly authorized to pass
on work and accept such work on behalf of Municipality as work progresses.
REPAIRS TO TANK OR TANK STRUCTURE Contractor agrees to make no repairs unless specific authoriza-
tion to make same is given by municipality. Contractor agrees. however. to point out necessary repairs to agent
of Municipality and to make necessary repairs upon receipt of authorization from Municipality or its duly au-
thorized agent at rates or prices to be agreed upon at such time.
MAINTENANCE OF WATER SUPPLY Contractor agrees, upon request of Municipality. to furnish, install and
maintain an excess pressure relief valve so~that water supplTwill not be shutdown, provided. however, that water
equipment of municipality is so constructed that such excess pressure relief valve can be used. Contractor agrees

f PAYMENT Municipality agrees that it shall pay contract price of this project in full upon completion of the

A special meeting of the Mayor and Council WaS held at the City
Hall, December 27, 1951. Mayor J. M. Gibson, presiding with the
following Councilmen present: H. L. McEntyre, S. H. McCalla, and
John Collier. City Attorney, Harold Willingham and Assistant City
Engineer, Ralph Lewis, J~. , present.
Minutes of previous regular meeting read. Motion by S. H. MCCalla
seconded by H. L. McEntyre to approve minutes as read. Voted
unanimous.
Minutes of special meeting December 14, 1951 read.. ~otion by S. H.
MCCalla seconded by H. L. McEntyre to approve minutes as read.
Voted unanimous.
Motion by S. H. MCCalla seconded by John Collier to accept agree-
ment between Mrs. C. T. Durham and Wylie Durham and City of Smyrna.
Said agreement attached to these minutes and made a Part thereof.
Voted unanimous.
On motion of Councilman John Collier seconded by Councilman H. L.
McEntyre the following ordinance was unanimously adopted:
REED STREET
PAVING ASSESSMENT ORDINANCE

WHEREAS, the paving and improving of the whole of Reed street
in the City of Smyrna, being a distance of approximately 300 lineal
feet from the northern intersection of Reed Street with Church street
to the southern intersection of Reed street and Love street in the
Ci ty of Sl"1yrna, has been completed pursuant to the Act of the General I
Assembly of 1931, embodying a new cl~rter for the nity of Smyrna
(formerly Town of Smyrna), approved August 27, 1931 (Georgia Laws 1931,1
pages 955-988), and under and by virtue of the adoption of an ordin- I
an~e intnnduced after the filing of a petition with the Mayor and
Council for such PQving and improvement, by a majority of the persons I
companies and corporations subject to assessment for the cost of such :
paving and improvement, and
WHEREAS, the cost of such paving and improvement to the
abutters as provided in said Act, is $531.24.
THEREFORE, be it ordained by the Mayor and Council of the City
of Smyr'na, and it is hereby ordained by the authority of the same:
That each abutting owner, subject to the cost of such Pavement and
improvement under the provisions of said Act, is hereby assessed
the amount of the pro rata Part of such owner of said sum of $531.24,
to be determined by the an101.mt of the frontage of such ovmer on said
street, and by the provisions of Baid Act, and a lien is hereby
asserted upon each portion of the property abutting upon said street
for the amount of the assessment, determined under and by the pro-
visions of said Act, against the owner thereof, to date back to the
approval of the passage of the ordinance for said paving and improve-
ment, and said lien is hereby declared from the date of said ordinance
which was passed on the 1st day October, 1951.
