THE PAVING OF FOSTER STREET IN SAID CITY

Notice is hereby given:
1. That at a regular meeting of the Mayor and Council of the City of
Smyrna, held'at seven-thirty o'clock P. M. on Monday, August 6, 1951, at the
City Hall, an ordinance was introduced by Councilman John Collier and seconded
b,y Councilman Stanley McCalla, providing that Foster Street in the City of
Smyrna, shall be paved. Copy of said proposed ordinance is hereto attached
and made a part hereof.
2. That the street proposed to be paved in said proposed ordinance is
Foster Street in the City of Smyrna. Said proposed ordinance provides that
Foster Street in the City of Smyrna, being a distance of approximately 400
lineal feet from the northern intersection of Foster Street and Spring Street
to the end of Foster Street, which is a dead end, in the City of Smyrna, be
paved.
3.. That said proposed ordinance provides that Foster Street in said
City, as above described, be paved in a uniform width of fourteen (14) feet
of asphalt paving 1.'Ii th clay bound base, with one-and-one-half to two inches of
No.2 rock penetrated with 0.75 gallons of asphalt per square yard, choked
wi th No.1 stone and shot again with 0.25 gallons of asphalt per square yard
and sealed with No. 1 stone a.nd properly rolled throughout operations.
4. That the' estimated cost per front foot for such contemplated
improvements as above described is $0.65 per front foot of property in the Ci~
of Smyrna, abutting on Foster Street, on the east and west sides thereof.
'" 5. That if such contemplated improvements as herein described are
erected all persons mming property on Foster Street in said Ci~, shall be
subject to a pro rata assessment of the cost of said improvements against
their properties.
6. That all persons ovvning property fronting or abutting on said
street in the City of Smyrna, and all other persons interested in any way in
subject matter, are hereby notified and directed to appear at a meeting of
the IvIayor and Council of the City of Smyrna, to be held on the 23rd day of
August, 1951, at seven-thirty o'clock P. hi. in the City Hall of said Ci~,
'then and there to make any objections that they may desire to urge against the
passage of the proposed ordinance herein described, copy of which is hereto

following ordinance was introduced by Councilman John Collier and seconded by
Councilman Stanley McCalla.

improved, until the mayor and council shall have first been petitioned in
writing to pave, repave, or otherwise improve the same, by a majority of the
persons, companies, or corporations, 'or the owner or'owners of a majority of
the front footage of abutting property' subject to assessment for the cost of
paving, repaving, or otherwise improving the sidewalk, street, avenue, public
alley, public place or portion thereof proposed to' be paved or repaved;" and
WHEREAS, at a special meeting of the Council held at seven-thirty P. M-
on the 6th day of August, 1951, a petition was presented to the Mayor and
Council signed by five (5) property owners of the city residing on Foster
Street in said City, being a majority of the owners of property on Foster
Street, or oyming a majority of the front footage of property in the City, abut-
ting on Foster Street; and
2. That the Mayor of said City 1s authorized and empowered to engage
an engineer to prepare the proper plans and specifications of the above im-
provements herein proposed to be made, and that said Mayor be authorized after
legal and proper advertising of same, to let a contract for and in behalf of
the City for the erection of such proposed improvements~
3. That the Mayor and Council estimate the cost of such improvements
from the best information available at this time based on various discussions
vdth contractors and others having technical krKnvledge of the cost involved
to be approximately One & 30/100 ($1.30) Dollars per lineal foot of such
improvements and being as above set forth approximately 400 feet of paving to
be erected, the total estimated cost therefore for the complete job, being
$520.00. Such estimated costs as above set forth being estimated to be $0.65
per front foot of properw in said City abutting on Foster Street, on the east
and west sides thereof.
4. That when said improvements are completed an ordinance shall be
passed asscesing the total cost of same including engineering and supervision
expenses against the ovners of the property on said street, as provided in
Section 66,et seq. of the new charter of said City (Georgia La.lS 1931, page 983"
et seq'.).

5. That before the passage of this ordinance a public hearing
regarding same shall be held at a meeting of said M<\yor and Council; and
it is hereby ordered that such said public hearing shall be held before
said Mayor and Council on the 23rd day of August, 1951, at seven-thirty
o'clock P. M. That all property ov~ers and other persons interested therein
are directed and notified to appear at such hearing and make any objection
they may desire to urge against the passage of this ordinance.
6. That pending the consideration of this ordinance by the Mayor
and CO\ll1.cil, an advertisement shall be posted in three (3) public places in
said City, to-wit: the City Hall, the Post Office and the Bank of Snvrna,
the City Hall and Bank of Srrwrna being located on Atlanta Street in the City
of Smyrna, and the Post Office being located on West Spring Street in the City
of Smyrna, giving notice of the introduction and pendency of this ordinance.
Such advertisement shall state the name of tho street to be improved and paved,
the nature of such contemplated improvements and the estimated cost per front
foot of same. Such advertiseL'llent shall further set forth that the property
owners or others interested are notified to appear at a meeting of the said

for tbe cost of paving, repaving, or othervlise improving the sidewalk; street,
avenue, public alley, public place or portion thereof proposed to be paved or
repaved;" and
WHEREAS, at a special meeting of the Council held at seven 0 'clock P. M.
on the 6th day of August, 1951, a petition was presented to the Mayor and
Council signed by five (5) property owners of the City residing on Nichols
Street in said City.. being a majority of the owners of property on Nichols
Street" or owning a majority of the front footage of property in the City abut-
ting on Nichols Street; and
WHEREAS, in said petition the Mayor and Counc il are requested to pass
an ordinance requiring the paving of Nichols Street in the City of Smyrna, to
advertise the introduction of said ordinance and to mail notices of tre same
to all persons owning property fronting on either side of Nichols Street, to
set a date for hearing objections to such ordinance, to subsequently pass an
assessnent ordinance giving the requisite statement to abutting owners on said
street and to do any and all things necessary as required by law and by the
charter of said City to legally accomplish the paving of said street;
NOW, THEREFORE, be it ordained by the Mayor and Council of the City of
Smyrna., and it is hereby ordained by authority of same:
1. That Nichols Street in the City of Smyrna, being a distance of
approximately 500 lineal feet from the eastern intersection of Pickens Street
and Nichols Street to the Western intersection of Nichols Street with Dunton
Street in the City of Smyrna, be paved in a uniform width of eighteen (18)
feet of asphalt paving with clay bound base, with one-and-one-half to two
inches of No.2 rock penetrated with 0.15 gallons of asphalt per square yard,
choked with No.1 stone and shot again with 0.25 gallons of asphalt per square
yard and sealed with No. 1 stone and properly rolled throughout operations.
2. That the Mayor of said City is authorized and empowered to engage
an engineer to prepare the proper plans am specifications of the above
improvements herein proposed to be made, and that said Mayor be authorized

following Councilmen present: H. L. McEntyre, C. W. Jones, Howard
Hrones, Stanley McCalla and JQhn Collier. Ralph Lewis, Jr., assistant

Pursuant to advertising as required by the Charter a public hearing
was held on the ordinance to pave Mar&ton Street introduced by Council-
man John Collier and seconded by Howard H~es at the July 25, 1951
meeting of the Mayor and Council. After public hearing, ~otion was
made by Councilman J04n Collier and seconded by C. W. Jones that the
ordinance for the paving of Marston street be passed as introduced.
Motion lmanimously carried and such ordinance was adopted.
Pursuant to' advertising as required by the Charter a public hearing

the ordinance for the paving of Stephens Street be passed as introduced.
Motion unanimously carried and such ordinance was adopted.
Pursuant to advertising as required by the Charter a public hearing
Was held on the ordinanue to Pave Grady Street introduced by Council-
man John Collier and seconded by Councilman Howard Hames at the July
25, 1951 meeting of the Mayor and Council. After public hearing,
with the objection of Mr. Mark Turner, Mayor ask M~. Lewis, engineer,
to recheck this street as to majority of foot frontage wanting o~ not
wantIng Grady Street paved.
Pursuant to advertising as required by the Charter a public hearing
was held on the ordinance to pave Foster street introduced by Council-
man John Collier and seconded by Councilman Stanley McCalla at the
August 6, 1951 meeting of the Mayor and Council. After public hearing

McCalla that the ordingnce for the paving of Stephens Street be passed
as introduced. Motion unanimously carried and such ordinance was a-

was held on the ordinace to pave Havlthorne street introduced by Council-
man John Collier and seconded by Councilman HOWard Hames at the July

motion was made by Councilman John Collier and Seconded by Councilman

After a discussion was held it was revealed tr~ough error Mr. Aiken
Was not paying the full amount he should be paying to do the several
business he Was engaged in. ~
Motion made by H. L. MCEntyre~secondea by StuDley McCalla to let
Mr. ~ikens licenses remain as~for the remainder of the year. Voted
unanlmous.
Eeer license refussed to applicant for a proposed club to be located

ments herein proposed to be made, and that said Mayor be authorized after legal
and proper advertising of same, to let a contract for and in behalf of the City
tor the erection ot such proposed improvem ants.
3. That the Mayor and Council estimate the cost of such improvements
from the best information available at this time based on various discussions
with contractors and others having technical knOWledge of the cost involved to
be a~roximately One &. 30/100 ($1.30) Dollars per lineal foot of such improve-
ments and being as above set forth approximately 1,000 feet of paving to be
erected, the total estimated cost therefcre for the complete job, being
$1,300.00. Such estimated costs as above set forth being estimated to be $0.65
per front foot of property in said city abutting on Anderson Circle, on the east
and west sides thereof.
". That when said improvements are completed an ordinance shall be
pa8sed assessing the total cost of same including engineering and supervision
expenses against the owners of the property on said street, as provided in Sec-
tion 66 et seq. of the new charter of said cit,y (Georgia Laws 1931, page 983, et
seq.).

5. That before the passage of this ordinance a public hearing regarding
same shall be held at a meeting of said lfayor and Council j and it is here by
ordered that such said public hearing shall be held before said 1~yor and Council
on the 1st day of October, 1951, at seven-thirty o'clock P. M. That all propert,y
owners and other persons interested therein are directed and notified to appear
at such hearing and make any objection they may desire to urge against the
passage of this ordinance.
6. That pending the consideration of this ordinance by the Mayor and
Council, an advertisemant shall be posted in three 0) public places in said
City, to-wit: the Cit,y Hall, the Post Office and the Bank of Smyrna, the City
Hall and Bank of Smyrna being located on ~tlanta Street in the City of Smyrna,
and the Post Office being located on West Spring Street in the City of Smyrna,
giving notice of the introduction and pendency of this ordinance. Such adver-
tisement shall state the name of the street to be improved and paved, the nature
of such contemplated improvements and the estimated cost per front foot of same..
Such advertisement shall further set forth that the property owners or others
interested are notified to appear at a meeting of the said ~or and Council to
be held on the 1st day of October, 1951, in the City Hall of said City at seven-
thirty 0' clock P. M., ani make any objection that they may desire to urge
against the passage of ~~is ordinance.
