The regular scheduled meeting of Mayor and Council was held pursuant to the Charter
at City Hall, Smyrna, Georgia on April 4, 1977. The meeting was called to order
by presiding officer Mayor Arthur Bacon at 7:30 o'clock P.M. All Councilmen were
present. Also present was Attorney Chuck Camp, City Clerk Willouise Spivey, Con-
troller Ron Egger, Director of Parks and Recreation Lee Silver, Police Chief Little,
Fire Chief Don Atkinson, Inspector David Granade, Director of Public Works Jim
David, Civil Defense Director Jim Farley and representatives of the press.
Invocation was given by Homer Kuhl, followed by the pledge to the Flag.
No citizens reports.
Request to rezone (1) Barry Adkins requested that property located at 1114 Church
Street be rezoned from R15 to RM10, which would allow him to build a duplex. A
motion to deny the rezoning was tabled at the last meeting and Mr. Adkins was asked
to secure signatures of the neighbors, stating they did not object, since Council
had turned down a rezoning for apartments in the area a short while ago. The
petition submitted contained the signatures of a majority of the neighbors. Mr.
Verville spoke in opposition of the rezoning. During discussion Jim Tolleson and
C. 0. Canada stated they were in favor of the rezoning. 'The motion to deny lost on
a two to five vote. Homer Kuhl and Rem Bennett voted for the motion. Jerry Mills,
Bill Darby, Jim Tolleson, C. 0. Canada and Elbert Coalson voted against. C. 0.
Canada then made a motion the property be rezoned from R15 to RM10. Jim Tolleson
seconded the motion. Homer Kuhl and Rem Bennett voted against the motion. Jerry
Mills, Bill Darby, Jim Tolleson, C. 0. Canada and Elbert Coalson voted for.
Motion carried.
(2) A request to rezone property located at 1307 Concord Road from R15 to O.I.
for the purpose of using as a funeral home was made by C. Dyre Eubanks, represented
by Scoggins Realty Co. After discussion and reviewing the plans, Homer Kuhl made
a motion the rezoning be approved. Jerry Mills seconded the motion and the vote
was unanimous. There was no opposition to the rezoning.
Commercial building permits (1) A building permit -was requested by Granny's
Chicken to build at 998 Cherokee Road. Plans had been approved by the Fire Marshall
and the Building Inspector recommended they be approved. Jerry Mills made a '
motion a 25 foot variance be granted and the permit be approved. Rem Bennett
seconded the motion and the vote was unanimous.
(2) Horace D. Huggins of 1110 McLinden Avenue requested a variance and permit to
build a garage. A letter from his neighbor, W. R. Vaughn of 1120 McLinden Avenue,
stated he had no objections to the garage being built within five feet of the
common property line. Homer Kuhl made a motion the variance and permit be approved.
C. 0. Canada seconded the motion and the vote was unanimous.
Jim Tolleson made a motion the Rules and Regulations for the Smyrna Fire Depart-
ment be approved as amended. Rem Bennett seconded the motion and the vote was
unanimous. Jim thanked the Fire Chief, Assistant Chief and City Attorney Camp
for their assistance.
Jim Tolleson asked Mayor and Council to approve a shift change in the Fire Depart-
ment. He made a motion the 12 hours on, 24 hours off, be changed to 24 hours on,
48 hours off, effective April 14, 1977. Rem Bennett seconded the motion. During
discussion Homer Kuhl spoke in opposition to the shift change. He was in favor
of going to the 8-hour shift. He stated the Police Department was on an 8-hour
shift and it had worked fine, and he thought the Fire Department could cut
operating expenses on the 8-hour shift. Jim Tolleson said we would have to hire
5 more men to go on an 8-hour shift. Jerry Mills stated he would vote for the
24/48 hour shift because we did not have the money to go to the 40-hour shift at
this time. Vote on the motion was six to one. Homer Kuhl voted against the
motion.
C. 0. Canada made a motion swimming pool fees be increased as follows:

Day Camp fee was set at $28.00 for the first child and $23.00 for the second
child of the same family.
The motion was seconded by Bill Darby and the vote was unanimous.
Jerry Mills stated that Jim David would get the list of vehicle control devices
in the city, as per location. The list should be completed within four weeks.
Mayor Bacon recommended no action be taken at this time on the Resolution covering
acquisition and clearance of rights -of -way with control of future encroachments
and regulation of vehicular traffic on highway construction projects, SAP-(3)
Atlanta Road.
Jerry Mills made a motion the minutes of March 7, 1977 be approved as submitted.
Elbert Coalson seconded the motion and the vote was unanimous.
Elbert Coalson made a motion the minutes of March 21, 1977 be approved as sub-
mitted. Rem Bennett seconded the motion. Bill Darby stated that Civil Defense
Director Jim Farley attended the meeting but was not listed. The minutes were
approved as amended, by a unanimous vote.
Homer Kuhl made a motion the Public Works Funds be allocated to pay the salaries
of five new firemen. Bill Darby seconded the motion and the vote was unanimous.
Police Chief Little stated one of the newer police cars was wrecked last week.
He had investigated the accident and no disciplinary action would be taken
against the officer.
Bill Darby made a motion to request bids for two (2) new police cars, to be opened
at the next council meeting, April 18, 1977. Homer Kuhl seconded the motion and
the vote was unanimous.
Lee Silver reported a member of the Smyrna Parks and Recreation Track Team, Cindy
Cochran, broke the Southeastern States record in the 100-yard dash last week in
Florida. There were 192 participants in our first meet.
Homer Kuhl made a motion a Public Hearing be held on Saturday morning, April 16,
1977, at 9:30 A.M. at the City Hall on the proposed usage of Revenue Sharing
Entitlement 8 Funds. Rem Bennett seconded the motion and the vote was unanimous.
Mr. Kuhl expressed his appreciation to council and the department heads for
holding down expenses last month.
Jerry Mills stated he was working on the insurance renewal, and asked that the
department heads be instructed to exercise better control of their drivers.
Jerry Mills also reported we were hit hard by the flood damage and a list of
the excessive damages had been made. A committee meeting was held last Thursday
and approval was given to start work in some areas. All repairs will be made as
soon as possible.
Jerry Mills made a motion that speed limit signs be installed in Deerwood
Subdivision on the following streets: Deerwood Circle, Doeskin Lane, Deerwood
Parkway, Deerwood Drive, Fawn Lane, Doeskin Trail and Antler Trail. Rem Bennett
seconded the motion and the vote was unanimous.
Jim Tolleson asked Jim David to check with the county on the proposed light at
Fire Station #3. He also thanked the Civil Defense Department, Public Works
Department and the Fire Department for their assistance with the flood damages
on Highland Drive.
