03-21-1977 Regular Meeting(Continuation of March 14, 1977 Meeting) Jerry Mills made a motion the minutes of February 7, 1977 be approved as sub- mitted. C. 0. Canada seconded the motion and the vote was unanimous. Jim. Tolleson made a motion the minutes of February 21, 1977 be approved as amended. Rem Bennett seconded the motion and the vote was unanimous. Rem Bennett made a motion a Malt Beverage (Pouring).license be approved for John Fredrick Wetzel, Pennsylvania Poor Boy, Inc., located at 2514 Atlanta Road, subject.to the FBI fingerprint report. C. 0. Canada seconded the motion and the vote was unanimous. Committee Reports (1) Elbert Coalson asked David Granade the status of the wrecker service on Benson Poole Road. David replied they had been given a two -weeks extension to put up a fence and the permit for the fence had been issued. (2) C. 0. Canada recommended that property located at East Twin Oaks Drive, owned by Fred G. Fetts, Jr., LL 554, parcel 84, be either sold for back taxes or con- demnation proceedings be initiated, in order that we may clean it up and use as a mini -park. The lot is unbuildable, small, with a creek running through the middle. Mr. Fetts will not answer our letters and no taxes are being collected. Elbert Coalson made a motion we initiate condemnation proceedings against the property. Jim Tolleson seconded the motion and the vote was unanimous. (3) Jim Tolleson said a letter had been written to the Fire Chief suggesting the Assistant Fire Chief act as the training officer, and he hoped action would be taken soon. Also, that he had met with Ron Egger and Lee Silver about a CETA grant, securing five or six people to work on the Certified City Program for one year. (4) C. 0. Canada made a motion that we waive bids on $3800.00 for equipment for the park, since only one company makes the equipment needed, subject to advice of the City Attorney. Bill Darby seconded the motion and the vote was unanimous. Jack Shinall asked if a mini -park was planned for the west side of the city. C. 0. Canada advised that we were trying to get one on Powder Springs Street. Halpern Enterprises requested a variance for a building set back line on Cherokee Road. They asked for a variance from 50 to 25 feet, in order to build a Granny's Fried Chicken at 1004 Cherokee Road. David Granade had seen the plans and he recommended the.variance be approved. Elbert Coalson made a motion the variance be granted. Jerry Mills seconded the motion and the vote was unanimous. Meeting adjourned at 9:08 P.M. March 21, 1977 The regular scheduled meeting of Mayor and Council was held on March 21, 1977 at City Hall, Smyrna, Georgia. The meeting was called to order by presiding officer Mayor Arthur T. Bacon at 7:30 o'clock P.M. All Councilmen were present. Also .present was Attorney Charles Camp, City Clerk Willouise Spivey, Controller Ron Egger, Parks and Recreation Director Lee Silver, Building Inspector David Granade, Police Chief Everett Little, Fire Chief Don Atkinson, Director of Public Works James David, Civil Defense Director Jim Farley, and representatives of the press. Invocation was given by Homer Kuhl, followed by the pledge to the Flag. Citizens Reports - Joe Shoemaker of Old Spring Road stated that in December his home was flooded, due to a sewer blockage, and his furnace was ruined. The insurance company covering the City of Smyrna, the Insurance Company of North America, has paid the contractor, Don -Lon Contractors, but they state they have not been able to get the new furnace. Mr. Shoemaker requested the help of Mayor and Council. Mayor Bacon said he had called our agent, Bob Fowler, and he was C (Continuation of March 21, 1977 Meeting) checking on it, but he would call him again tomorrow, and would do everything in his power to see that it is taken care of. Mayor Bacon asked Mr. Shoemaker to come by the office tomorrow afternoon and they would see what could be done. Request to rezone 1114 Church Street from R15 to RM10 (duplex) was the first item of business. Barry Adkins, who wishes to build a duplex on this property stated he had talked with the neighbors and they did not object to the multi -family dwelling; also the Planning and Zoning Board recommended the property be rezoned. Homer Kuhl made a motion the request to rezone be denied for the following reasons: we had turned down a request to rezone for apartments just down the street, we try to be consistent in zoning, and he was afraid it would open the city to more rentals. Jerry Mills seconded the motion. C. 0. Canada stated he thought this building would enhance the property. After discussion, Elbert Coalson made a motion this request be tabled until the next meeting, enabling Mr. Adkins to get the signatures of the neighbors. C. 0. Canada seconded the motion. Vote on the motion was four to three. Elbert Coalson, C. 0. Canada, Rem Bennett, and Jim Tolleson voting to table; Homer Kuhl, Jerry Mills and Bill Darby voting against. The request for a Bail Bond License for Davis Bonding Company, 2580 Olive Springs Road, Marietta, Georgia was approved on motion by Jerry Mills, seconded by Bill Darby. Vote on the motion was unanimous. Commercial building permits were submitted and upon the recommendation of David Granade the following action is recorded: Yy (1) Dixie Exterminators requested a permit to add a room onto a garage on property at the corner of Cherokee Road and Old Spring Road. A side yard variance was required, but since the lot affected is also owned by Dixie Exterminators they granted a variance to themselves. A detailed site plan drawn to scale will be submitted. Rem Bennett made a motion the permit be granted, subject to receipt of the detailed drawings. C. 0. Canada seconded the motion and the vote was unanimous. Rem Bennett made a motion the City of Smyrna adopt a Soil Erosion & Sediment Control Ordinance - Ordinance #17 -8008. C. 0. Canada seconded the motion and the vote was unanimous. Jerry Mills read the Street Department progress report for the week of March 14, 1977 and it is recorded as follows: Turn radius and recurbed at Highview and North Cooper Lake Road. Turn radius at Church Street and Reed Road. Dredged ditch and seeded in 3 yards on Green Forest Drive. Curbed and guttered McCauley Road. Repaired Willowbrook Drive curb. Installed guard rail at Birch Street and Powder Springs Street. Patched holes throughout city - used 40 tons of asphalt. Curbed Alexander Street and built head wall. Curbed Church Street at Castellaw Funeral Home. Curbed Medlin Street at Clifton Road. He also reported a list of eighteen (18) streets had been approved to be resurfaced with the $50,000 of state money we will get from Cobb County. A list of twenty- six (26) streets have been approved by Cobb County to be resurfaced if the $22,000,000 Bond Issue passes. C. 0. Canada made a motion to reset the date for bid openings for Phase II, King Springs Park to April 12, 1977. Bill Darby seconded the motion and the vote was unanimous. Committee Reports - Bill Darby stated the Blood Drive would be Wednesday, March 30, 1977 at the First Methodist Church from 3:00 until 7:30 P.M. He challenged Mayor and Council to give. (2) The Smyrna Little League opening ceremony will be April 16th and he requested Mayor and Council participate in the parade. He also made a motion we furnish a police escort for the parade. Homer Kuhl seconded the motion and the vote was unanimous. (3) The City Attorney had advised we could waive the bids on the playground equipment since it was a budgeted item, and only one company makes this equipment. Jerry Mills reported the city's insurance on vehicles, buildings and contents was up for renewal May 2, 1977 and he was working to secure the best coverage. He also stated a professional appraiser will appraise all city buildings. (Continuation of March 21, 1977 Meeting) Homer Kuhl reported that all department heads had received forms for submitting proposed budgets for 1977-78 and he requested the lists of capital expenditures be in for review by April 2, 1977. This is mandatory since two public hearings must be held on Revenue Sharing expenditures. He stated the financial state- ments through February had been distributed and advised they be used as a guide in making the new budgets. C. 0. Canada reported the Smyrna Parks and Recreation Department was hosting the 5th District Annual Meeting on April 26th and he would like for all Council to attend. Lt. Governor Zell Miller is to speak at 10:30 A.M. (2) The lumberyard on Powder Springs has been moved and the lot is being cleaned. Elbert Coalson read a letter thanking the Sanitation Department for a job well done and he asked that a copy be posted on the bulletin board in the department. (2) The owner of the junkyard on Benson Poole Road was fined $25.00 in Recorder's Court and given ten (10) days to comply with the ordinance. (3) He urged the city to buy some property in the Benson Poole Road area for the next fire station. Rem Bennett reported that $20,000 had been collected due to the Mailgrams mailed to delinquent tax customers. (2) Commended David Granade for work he is doing. Attorney Camp reported he had reviewed the Resolution covering acquisition and clearance of rights of way with control of future encroachments and regulation of vehicular traffic on highway constructions projects, Project SAP-(3), Atlanta Road, and was submitting it to Mayor Arthur Bacon for approval. After discussion it was recommended this resolution be held to the next meeting. Jerry Mills asked Mayor and Council if they had any objections to his contacting Commissioner Ernest Barrett and requesting that the city take over the maintenance and patrolling of the county streets, when the city limits are in and out several times on the .same street. Jim David is making a list of these streets. This item was deferred for further study. Attorney Camp advised we needed a list of all vehicle control devices in the city, designating their specific locations, and a blanket motion should be made to approve them all at one time.
