The regular 'meeting of"MiIyor and Council was held January 10, 1977, at City Hall,
Smyrna,' Georgia.- The meeting of January 3, 1977 was postponed until this date, due
to inclement weather. The meeting was called to order by presiding officer Mayor
Arthur Bacon at 7:30 o'clock P.M. All Councilmen were present except Jim Tolleson
5iwho was absent due to a prior commitment. Also present was Charles Camp, City
Attorney, Willouise Spivey, City Clerk, E. R. Little, Police Chief, Ron Egger, Con-
troller, Lee Silver, Director of Parks and Recreation, David Granade, City Inspector,
James David, Superintendent of Public Works and representatives of the press.
Invocation was given by Homer Kuhl, followed by the pledge to the Flag.
Citizens Reports: David Thomas of the Fire Department asked Mayor Bacon if anything
had been worked out on the working hours of the firemen. He said he understood at
the last council meeting that a meeting would be held with the firemen and some
decision would be made, but as yet no meeting has been called. Mayor Bacon stated
that as yet nothing had been worked out, but when funds could be found a meeting would
be called. In response to the question by Mr. Thomas as to how much money it would
take to go on the 24 hours on and 48 hours off schedule, Mayor Bacon stated they were
still working on it and he was not sure at this time. Marston Tuck said he would
still like for council to set up a joint communications system, and would like to
see something worked out for the Fire Department.
Mrs. Ester Cearfoss asked if anyone from Kidd and Associates was present to answer
questions about annexation. She was advised a public hearing on the annexations
was being set up for January 27th.
{4 Gene Reeves, owner of Smyrna Village Apartment, requested a variance to install a
sign on Church Street right-of-way. Mr. Reeves stated he had had a sign on property
belonging to Castellaw Funeral Home but that now Mr. Castellaw would not renew the
lease, and without a sign he could not rent his apartments. During discussion it
was brought out that allowing a sign on the right-of-way would be in direct violation
of our sign ordinance. Mayor Bacon appointed a committee of Jerry Mills, Homer
Kuhl and Rem Bennett to work with Attorney Camp to see what could be done, and
report at the next council meeting.
Bids for one (1) garbage truck were opened, read, and are recorded as follows:

Jerry Mills made a motion the bids be turned over to committee for review and
report back at the next council meeting. Elbert Coalson seconded the motion and the
vote was unanimous.
No building permits were submitted. •
Homer Kuhl made a motion that David Granade be appointed City Marshall. Rem Bennett
seconded the motion and the vote was unanimous.
Jerry Mills made a motion the minutes of December 6, 1976 meeting be approved as
submitted. Homer Kuhl seconded the motion and the vote was unanimous.

y Bill Darby stated some action should be taken on the bids received for (4) pagers
'i for the Civil Defense Department, and he made a motion we accept the bids from Tone
.Radio. Homer Kuhl seconded the motion and the vote was unanimous.

Jerry Mills stated the Employees Benefit committee had received a request from
Police Chief R. E. Little that the Employees Rules and Regulation Handbook be
amended to include the Police Department personnel in the following sections:
Chapter X, Section 3 Holidays; Section 4, Vacation Leave; Section 5, Sick Leave;
Section 6, Workmens Compensation; Section 7, Temporary Disabilities Not Covered
by Workmens Compensation; Section 8, Funeral Leave; Section 9, Military Leave and
Section 13, Leave of Absence Without Pay.
Jerry Mills made a motion the handbook be amended to include the Police Department
in the above mentioned sections. Rem Bennett seconded the motion and the vote was
unanimous. The request for this amendment is to be made a part of these minutes.
An amendment was made to this motion to make the effective date as of 12:01 A.M.,
January 11, 1977.
Homer Kuhl asked Attorney Camp if he thought we should accept the Code of Ordinance,
as prepared by the Municipal Code, Inc. Mr. Camp said he had checked over the proofs '-
before returning them to the company and several small changes had been made.
Homer Kuhl made a motion that we order the minimum order of fifty (50) copies.
Jerry Mills seconded the motion and the vote was unanimous.
C. 0. Canada asked the status of the City Manager study by the University of Georgia.
Mayor Bacon advised that he would call them tomorrow.
C. 0. Canada asked when a vehicle could be acquired for the City Inspector. Homer
Kuhl said he would like for him to use one of the old police cars for the present,
since funds were not available to buy a new car. Mr. Canada stated he should have
a truck in order to pick up signs, etc. Mayor Bacon said he thought he should have
a new truck but could use a surplused police car until we could get one.
Rem Bennett said we had had a bad storm water drainage problem at 541 Benmac Road
for a number of years and he made a motion this problem be corrected for an estimated
cost of $753.40. Elbert Coalson seconded the motion and the vote was unanimous.
This cost to be paid from State Grants Funds. The owner of property at 541 Benmac
Road was in the audience and asked to see what was to be done. Rem Bennett said
he thought the owner had already seen the plans. C. 0. Canada made a motion this
request be tabled until the next meeting, in order that the owner have time to go
over the plans with Jim David. Elbert Coalson seconded the motion and the vote was
unanimous.
Rem Bennett made a motion that "No Parking Overnight" signs be put up in the Church

Street Park parking lot. Jerry Mills seconded the motion and the vote was unanimous.
A meetingof Mayor and Council was called for Tuesday afternoon at 5:30 P.M.

Citizens Input: Mr. W. B. Mauldin of 1221 Kingsview Drive asked the status of the
annexation study and stated he did not think it has been advertised enough, did 0'
not think it had been handled correctly. Mayor Bacon advised that a public hearing
would be held January 27th, and at that time he hoped all the questions could be
answered. Mayor Bacon is to call Mr. Mauldin when they can meet with Kidd &
Associates.
Jack Shinall said they still had a sewerage problem in Hickory Acres. C. 0. Canada
gave Mr. Shinall a copy of a letter from Leon V. Weeks, Civil Engineer of Cobb
County, stating this problem should be corrected by the end of February, 1977.
Sue Brissey asked where the Internal Affairs reports are now. Mayor Bacon said

they were still in the hands of Judge Luther Hames, and if no more appeals are
made they will be filed with a committee of the grand jury.
Bill Darby advised the Civil Defense had installed five sirens and a test would
be made next Saturday at 12:00 noon. He wanted everyone to know it was only a test. *,
