11-21-1974 Regular MeetingI I t I I 1 I u November 21, 1974 At a regular Council Meeting on November 18, 1974, Mayor John C. Porter- field scheduled a meeting for 6:00 o'clock P. M., Novemb.er 21, 1974, at City Hall to review the Fiscal '74 Financial Audit with Perry & Pate, CPA's Mayor John C. Porterfield and all Council members were present, with the exception of Earle Cochran of Ward 7. Mr. Wallace Pate and Al Cerquida discussed the completed audit, answered all questions directed from Council and made certain recommendations. Councilman C. 0. Canada motioned the meeting be considered a regular council meeting. Jerry Mills seconded the motion and the vote was unanimous. In the first order of official business. Elbert Coalson motioned to purchase from Strother Ford Company, a 1974 model Van type truck, fully equiped, for $3,700.00. During discussion of the motion to purchase Marston Tuck motioned for the deletion of the radio. This motion was seconded by Homer Kuhl. The action resulted in a tie vote. For the motion to delete the radio, Homer Kuhl, Forster Puffe and Marston Tuck voting for. Voting against was C. 0. Canada, Jerry Mills and Elbert Coalson. On the split vote Mayor John C. Porterfield voted against the motion. On the main motion to purchase the truck fully equipped, which was seconded by C. 0. Canada, the vote was five for and one against. Forster Puffe voted against. The committee report on employee's welfare was deferred to the next regular council meeting. In the next order of business Council read the City Attorney's Ordinance authorizing the City of Smyrna to cut off water and collect advance deposits. Forster Puffe made a motion to adopt the ordinance as read. Marston Tuck seconded the motion and the vote was unanimous. A copy of this ordinance is to become a part of these finalized minutes. Also effective this date, water cut-offs and locked meters were authorized per motion by Marston Tuck, seconded by Elbert Coalson. Vote was unanimous. Meeting adjourned at 9:07 A. M. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF SMYRNA AND IT IS HEREBY ORDAINED BY THE AUTHORITY OF SAME AS FOLLOWS: The,water department of the City of Smyrna shall from the date of the passage of this"ordinance have authority to require an advance deposit from all individuals, partnerships, firms or corporations requesting water and sewerage services from the City of Smyrna and the City shall not be obligated to furnish same until the advance deposit has been received in its entirety. In the event that any person, partnership, firm or corporation fails to pay bills accumulated for the furnishing of water and sewerage services, the water department of the City of Smyrna shall, when such bills are fifty (50) days in arrears, cut off said utilities and not be required to re -connect same until the charges have been paid in their entirety. Any individual firm, partnership firm, or corporation who shall turn on, or cause to be turned on, water services after the same has been terminated by the City of Smyrna shall, upon conviction, be fined not to exceed $300.00. Residential: Deposit $25.00 (Buyers & Renters - no exception) Commercial: Deposit $25.00 (If sanitation charge is between $5 & Deposit $50.00 (If sanitation charge is between $26 & Deposit $75.00 (If sanitation charge is between $51 & Deposit $100.00(If sanitation charge is over $100. (The above based on sanitation rate will also have a minimum of $7.00 for commercial water) Residential: $10.00 (Sanitation only - same). Commercial: Bases on rate for commercial. We have many customers who move out and the deposit does not cover the amount of the bill plus the final bill. The customer does not call in for a cut off, therefore, we have no forwarding address to send the bill to. This Dosen't always apply one to the renter. CUT OFF - DELINQUENT BILL NEW 1. When work order is made up, water should be cut off and meter locked, thus making it mandatory for user to pay if he uses water. 2. Reconnect charge should be Service Charge and a Service Charge of $5.00 should be added to each work order, to cover expenses. 3. If seen, the men should cut off anyway, unless amount can be collect` plus service charge, at that time and customer is given a receipt by meter reader. NEW Vacating Property: Water to be cut off and meter locked at time the final reading is taken. This is the only way for us to know who and when another tenant moves in. r. OHN C.
