09-23-1974 Regular Meeting• f 271 I (Continuation of September 9th Minutes) 1974 Council Meeting were approved as submitted. The vote was unanimous. Homer Kuhl made a motion the City of Smyrna sponsor the Cobb County Chamber of Commerce Jonquil Breakfast, September 18, 1974, with Parks Director Lee Silver, presenting the "Recreation Unlimited" program. Elbert Coalson seconded the motion and the vote was unanimous. Mayor Porterfield congratulated Assistant Fire Chief Don Atkinson on receiving the Georgia State Fireman Association Outstanding Service Award. Jerry Mills asked if anyone knew of a five or six room house in Smyrna, for rent or lease, to be used for the Children's Adplesence Program. Earle Cochran made a motion we take bids to surplus the old police car #22, bids to be opened at the next council meeting. Homer Kuhl seconded the motion and the vote was five to one. Jerry Mills voted against. Ground breaking for the hew King Springs Park will be Saturday, September 21, 1974 at 10:00 o'clock A. M. Elbert Coalson made a motion the City pay membership dues to the Georgia Recreation Association for all Parks and Recreation Committee members. Earle Cochran seconded the motion and the vote was unanimous. Homer Kuhl stated the finance committee recommerided hiring a purchasing agent for the City and asked approval to start accepting applications and interviews. He asked the applications be submitted to Bob Burchfield to be presented to council. He also stated he would like to have the gart-age trucks moved as soon as possible. Meeting adjourned at 10:05 P. M. September 23, 1974 The regularly scheduled mid -month meeting of Mayor and Council was held at City Hall, September 23, 1974 and called to order at 7:30 o'clock P. M. by presiding officer Mayor John C. Porterfield. All Councilmen were present. _Allpresent were L. W. Charles, City Clerk, Willouise Spivey, Asst. City Clerk, Bob Burchfield, Administrative Asst., Nora Proctor, Clerk, Lee Silver, Parks and Recreation Director, J. E. David, Supt. of Public Works, Leon Hood, Building Inspector, A. L. Coleman, Heating and Air Conditioning Inspector, Berl T. Tate, City Attorney, Joe Briggs, Consultant Engineer, and a repre- sentative of the press. I-_. Invocation was by Councilman Homer Kuhl. J. E. David, Supt. of Public Works, reported on drainage problems as follows: (1) Glendale and Birch Street: A curb has been installed from behind the restaurant on South Cobb to Birch Street. (2) Campbell Road, Kitchens property: Estimated cost of pip_e_from rear of Kitchens home to Howell Drive was $3200.00 Three home owners are involved. Councilman Forster Puffe was requested to contact Mr. Kitchens and the other property owners in regard to their reaction on the cost of the pipe. (3) Mr. Leon Faulkner of 590 Wooddale Drive submitted a larger map of the Wooddale and Trailwood Drive area. Mr. Faulkner stated that from the information he was able to obtain, approximately 18 years ago the City was requested to dig a ditch for surface water drainage purposes, by the developer of the area; however, no easements have been located, and he feels the City has some responsibility in a permanent solution to the drainage problems. He also stated he had contacted most of 'the property owners in regard to a ditch on the property lines with a five foot easement from each home owner. He stated the property owners on one side were not favorable; on the other side he thought most would be favorable. Councilman E. R. Coalson was requested to meet with Mr. Faulkner, citizens in the area, and the Streets Committee at 6:30 o'clock P. M., September 30, 1974, to try to work out a solution to the problem. Public Works Supt. J. E. David reported that Neel Contracti g Compgn'y would not install sidewalks on Concord -Love until C. W. Matthews had completed all of their work. The finishing work by C. W. Matthews Company was to be discussed with State officials at a meeting September 24, 1974, at 1:30 o'clock P. M. In regard to traffic lights, Councilman Forster Puffe reported a letter had been re- 272 (Continuation of September 23rd Minutes) ceived from the Department of Transportation and they did recommend a traffic light at Concord and King Street and Concord and"'King Springs, and recommended that action be taken to have these two lights installed. A letter was read from A & P Signal, quoting a price (using lamps owned by the City) of $3250.00 for installation at King and Concord and $2800.00 for installation at KingSprings and Concord. After further discussion, Forster Puffe motioned that bids be requested for installation of these two traffic i signals, specifying the City has the lamps on hand. The bids to be opened at the 1 October 7, 1974 Council Meeting. The motion was seconded by Jerry Mills and vote on the motion was unanimous. Marston Tuck requested that action be deferred on the traffic light at Spring Road and Campbell (Farmstead) until he had an opportunity to talk with an official of the Depart- ment of Transportation, and Queet-with the Streets Committee. No progress was reported on Atlanta Road appraisals. Commercial building permits were submitted by building inspector Leon Hood and upon his recommendations the following action is recorded: (1) A. D. Church Builders, requested permit to build the new Cobb Bank and Trust Co., 1041 Cherokee Road. Mr. Hood stated the plans met the building code and has been approved by the Fire Prevention Bureau. On motion by Jerry Mills, seconded by E. R. Coalson, the permit was approved by unanimous vote. (2) Building Inspector Leon Hood read a letter from Mr. Charles Bernstein, attorney for Gloria B. Formisano, 1566 Spring Street, requesting permission to board up and seal the house pending the consummation of a sale. The building inspector was authorized to write a letter condemning the property. Jerry Mills was also requested to have the property cleaned up again and bill the property owner. Mayor John Porterfield stated that after further study and consideration on zoning on Spring Road, west to the Railroad, it was the consensus of Mayor and Council that the + property should be left as is. However, he did state Council might be receptive to light commercial on an individual basis. Bob Burchfield was requested to check and correct, if necessary, posting of signs for L properties to be considered for rezoning at the October 7, 1974 meeting:; No bids were received for purchase of surplused Police Car #22; therefore, on motion by Earle Cochran this item was referred to the Garage Committee for negotiations and sale, { as soon as possible. The motion was seconded by C. 0. Canada and the vote was unanimous. E Recommendations for nominee for Planning and Zoning Board was deferred to the next meeting. Councilman Jerry Mills reported that the contract between Complete Refuse Removal, Inc. and the City of Smyrna, which was approved by the Sanitation Committee, had been signed and a copy has been requested by J. E. David and Jack Eudy. Open House for Community Service Center was set for October 22 and 23 from 10:00 A. M. until 12:00 noon, with ribbon cutting on the 22nd. The program will officially start November 4, 1974 Adoption of the 1974 Sign Ordinance was postponed. Ten men appeared before Mayor and Council in the interest of the Sign Ordinance. Marston Tuck motioned that the hearing be continued until the October 7, 1974 Council Meeting, with a working session meeting Monday, September 30, 1974 at 8:00 o'clock P. M., at which time, sign company repre- sentatives would be welcome; also, the City Attorney was requested to attend. Homer Kuhl seconded the motion. After further discussion, Marston Tuck withdrew his original motion and moved that copies of the ordinance, which contained changes the City Attorney and some Councilmen had not seen or had time to review prior to the meeting, be dis- tributed and a public hearing date be set at the next meeting. Jerry Mills seconded the motion. Mayor Porterfield ruled the motion out of order since Homer Kuhl did not withdraw his second to the original motion. The original motion passed on a five to { two vote. Marston Tuck and Jerry Mills Opposed. Councilman Homer Kuhl was requested to contact the county Tuesday morning as to why Smyrna had not received the tax digest when county bills were mailed on Thursday. The cost of the new addition to City Hall to date was reported as $67,728.32. This figure includes $4,949.45 spent on the old portion of City Hall. Ribbon cutting for the new addition was scheduled for Saturday morning, October 5, 1974, at 9:00 A. M. Mayor John Porterfield stated that he had received today a working copy of agreement with the Cobb County Board of Education and called a meeting for 7:30 o'clock P. M. Monday night, September 30, with all Councilmen. s Y' 273 I - (Continuation of September 23rd Minutes) Mayor John Porterfield stated he was concerned about the absence of communication for the Civil Defense Department as installation of a new power antenna for the police station was ready and no provision had been made for tie-in with Civil Defense and the low base Fire Department equipment. Mr. Ray Hinkle, the tower subcontractor quoted $525 for erecting the old police radio tower behind the Police Department Building, in- cluding the furnishing of necessarysupplies, and mounting two Divil Defense antennas on the old tower. Mr. Hinkle then quoted $300 for mounting the other two Civil Defense antennas, including furnishing the two necessary brackets, on the new Police radio tower in the two vacant positions. A maximum of $100 for new cable will also be need- ed tp connect to the new locations. Marston Tuck motion was seconded by Homer Kuhl and the vote was unanimous. All Council Members who plan to attend the GMA Seventh District Fall Meeting to be held October 15, 1974, 2:oo P. M., Cartersville County Club, were asked to notify City Clerk L. W. Charles. 4 On motion by C. 0. Canada, it was agreed to erect a caution sign, then a stop sign, ` at Evergreen and Smyrna Powder Springs Road. The motion was seconded by Jerry Mills and vote on .the motion was unanimous. Homer Kuhl suggested the police be notified and thatthey work with the City Engineer on location of the sign. J. E. David reported that weeds on the state right-of-way on Pinehill had been cut toddy. High rate of speed on Stephens Street was referred to the Police Chairman. Jerry Mills motioned that a Resolution be sent from Mayor and Council to the Public t Service Commission opposing the rate increases proposed by Southern Bell, especially for residences and businesses. The motion was seconded by Homer Kuhl and the vote was unanimous. Police Chairman Earle Cochran stated he had redeived applications in regard to streets where radar would be used and requested each Councilman to submit names of all streets to him in order that the committee could checkout and send the survey to the state. L. W. Charles, City Clerk, was requested to furnish copy of certified minutes of Council meeting requesting radar. City Attorney Berl T. Tate stated hearings on appeal by attorneys for Norseman Apartments would come up in October. r Marston Tuck asked about list of streets to be resurfaced by the state. Forster ' Puffe stated he would submit another copy to George H. Kreeger to give to state officials since they stated they could find no copy of the request. The vacant lot, adjacent to the Mark Turner House on Cherokee Trail, was referred w to Jerry Mills for clean up. Councilman Homer Kuhl stated that a member of the Atlanta Regional Commission would be in the City Hall the latter part of November of first of December to make studies of job classifications, salaries, etc. in each department, at no charge. Mr. Kuhl motioned that Atlanta Regional Commission be authorized to make this study and re- commendation. Earle Cochran seconded the motion and the vote was unanimous. 4 !
