09-09-1974 Regular Meetingf 269 September 9, 1974 1 The regularly scheduled meeting of Mayor and Council was held pursuant to the Charter at City Hall, Smyrna, Georgia, September 9, 1974, and was called to order at 7:30 P. M. by presiding officer Mayor John C. Porterfield. Councilman C. 0. Canada was on vacation. All other Councilmen were present. Also present were: L. W. Charles, City Clerk, ' Willouise Spivey, Asst. City Clerk, Nora Proctor, Clerk, Bob Birchfield, Administrative Assistant, Lee Silver, Parks Director, Vic Broyles, Asst. Supt. of Public Works, Leon Hood, Building Inspector, Don Atkinson, Asst. Fire Chief, George H. Kreeger, Attorney and members of the press. Invocation was given by Councilman Homer Kuta. Citizens Report: A representative of the Smyrna Lions Club asked persmission for the Club to hold a White Cane Sale September 21, 1974 from 10:00 A. M. to 5:00 P. M. The proceeds are to be used'for eye examinations and glasses for the underprivileged. They asked to sell from the curb at the following intersections: Love -Atlanta, Concord - South Cobb Drive, South Cobb Drive -Pat Mell Road, and Atlanta at Cherokee Road. Elbert Coalson made a motion the request be granted. Jerry Mills seconded the motion and the vote was unanimous. Mr. Leon Faulkner of Wooddale Drive appeared before Mayor and Council with reference to the drainage problem in that area. Mr. Faulkner wants the drainage ditch cleaned out. He presented a plat of properties calling out the residents affected by excess water. Mayor Porterfield stated he would like to secure a five (5) foot easement on r each side of the property line of each property owner, so that the City could cut the ditch and maintain it properly, which he thought would take care of this problem. Mr. Faulkner is to secure deeds on all property involved, meet with Councilman Elbert Coalson and Vic Broyles in an effort to secure easements, and report to Mayor and k Council at the September 23, 1974 Council meeting. Mr. Richard Kitchens, owner of property at the corner of Campbell Road and Argyle Road asked Mayor and Council to do whatever was necessary to stop the flow of water from the streets from flooding his yard. He stated there were no curbs to stop the water. Vic Broyles is to check this drainage problem and report at the next meeting. Mr. Tom Roebuck, owner of property at the corner of Glendale Place and Birch Street, stated that water from the Belmont Hills School grounds and Glendale Place, together with drainage from the restaurant property on South Cobb Drive, was flooding his property. He also complained of rats in the area and of the garbage containers on South;Cobb being left dirty. Vic Broyles is to check these complaints and report at the next meeting. Arthur Bacon appeared before Mayor and Council and asked permission to install a lift station between his property and that of Reed::McCollum on Bank Street. He said those were the only two houses on Bank Street without sewerage. Mayor Porterfield told him that if the pump was installed according to city specifications, and was approved by the city engineer, the city would accept title and maintain it. Residents of Grady Street also complained of excess water in their rear yards. Jerry Mills is to check this out. The sewer line on Fleming Street has been checked and is ready for all residents to tap on. The only exception is the Kirkland property, which was not intended to be on sewer. Names of persons who will tap on are to be submitted to City Clerk, L. W. Charles. Vic Broyles is to check the sewage problem on Sleepy Lane and report to Mayor Porterfield. Commercial Building Permits were submitted by building inspector Leon Hood and upon his recommeridation the following action is recorded: (1) Chappy's Fish & Chip, Cherokee Road, 1Ox49' addition to the west side of present building. Sufficient parking would still be available. On motion by Homer KA1, seconded by Elbert Coalson, the permit was approved. Vote on the motion was 4-2. Earle Cochran and Jerry Mills voted against the motion. (2) John Mann, Cherokee Road, two-story office and warehouse, at the rear of his present store. The building would be 60x8O' and he requested an 8' side yard variance. Jerry Mills made a motion the Building permit, plus the 8' variance, be approved. Motion was seconded by Homer Kuhl and the vote was unanimous. Leon Hood read a letter from James Pressley, owner of the South Cobb Driving Range, with reference to the complaints received from nearby residents of golf balls hitting 270 (Continuation of September 9th Minutes) roofs, etc. Mr. Pressley stated he had already made a number of changes, including balls must be driven to the left, back side of the range and only -iron clubs can be used. He stated he had insurance to cover any damage done, and asked permission to continue operations through this season. Mayor Porterfield asked C. 0. Canada to check out these changes and report at the next meeting. There were no zonings nor annexations to be brought before Mayor and Council. The application for a business license for liquor, beer and wine sales, made by W. D. Hearn for 930 Cherokee Road, was withdrawn. It was reported the Concord -Love construction was completed with the exception of landscaping and sidewalks. Neel Contracting Co. will begin the sidewalks as soon as C. W. Matthews completes the landscaping. Four-way stop signs have been + installed at the Love, Concord, King Street intersection. Forster Puffe reported the committee recommended receiving bids for traffic signals for Concord Road at King Springs and Concord Road at Love Street. He asked Vic Broyles to check with the State to see if our old 6" reflector lights could be converted to the 8" reflectors now 4 being used by the state. He also requested that the state make a survey at both intersections and give their recommendations, also conduct a traffic count. Forster Puffe made a motion that Love Street, from King west to Reed Street, be made a one- way street heading West. Marston Tuck seconded the motion and the vote was unanimous. The Street committee also recommended that Love Street, from Atlanta Road to King Street be renamed Concord Road, effective 12/1/74. Forster Puffe made a motion the name be changed. Homer Kuhl seconded the motion and the vote was unanimous. ,The committee also recommemded, and Forster Puffe made a motion that Love Street Extension, running from Spring Street to Atlanta Road, be renamed Spring Road. Homer Kuhl seconded the motion and the vote was unanimous. The change to be effective 12/1/74. Forster Puffe requested the Department of Transportation be contacted about moving the traffic light at CampbellRoad and Spring Road to the Jonquil Park entrance on Spring Road. Bob Birchfield reported he had contacted all property owners involved in the present phase of the Atlanta Road widening except Mr. Bobby Landers. J. D. Daniel stated he would sign an option to sell at the agreed price, but would not sign a deed until the time of purchase. Mr. M. V. Ware said that he would not sell a portion of his property for the right-of-way. Earle Cochran made a motion the City be responsible i for moving all signs back from the right-of-way purchased. Forster Puffe seconded the motion and the vote was unanimous. Bob Farrar is to be contacted about appraisals north, to the old depot building. Marston Fuck motioned we accept the bid from the Calhoun Company, in the amount of $913.68, for the Bell and Howell Movie Projector for the Civil Defense Department, even though it was not the lowest bid, the equipment was superior. Jerry Mills seconded the motion and the vote was unanimous. A purchase order is to be issued and the equipment delivered after October 1, 1974. Mayor John C. Porterfield announced the closing on the property on Concord Road for the Westside Fire Station would be at 11:00 o'clock A. M., September 10, 1974. The purchase price is $38,500.00. t Homer Kuhl asked council approval for the Mayor to sign a note at the First State Bank, not to exceed $80,000, at an interest rate of 6 3/4%, if needed to meet expenses from the General Fund until tax payments start arriving. A General Fund Certificate of Deposit in the amount of $80,000, at the First State Bank is presently drawing 11 1/2% interest. Homer Kuhl made a motion & Mayor be given authority to sign a note if necessary.' Earl Cochran seconded the motion and the vote was unanimous. Recommendations for a nominee for the Planning and Zoning Board was deferred to the next meeting. Mayor Porterfield, stated a letter has been written to the State concerning the J Radar -Unit, requesting they meet with our streets committee and our police committee, in.making a survey of the residential and major thoroughfares. No further action can be taken until we receive a reply from the State Office. On motion by Forster Puffe, seconded by Earle Cochran, the minutes of August 5th, 1974 Council Meeting were approved as submitted. The vote was unanimous. On motion by Forster Puffe, seconded by Jerry Mills, the minutes of the August 19th, • f 271 I (Continuation of September 9th Minutes) 1974 Council Meeting were approved as submitted. The vote was unanimous. Homer Kuhl made a motion the City of Smyrna sponsor the Cobb County Chamber of Commerce Jonquil Breakfast, September 18, 1974, with Parks Director Lee Silver, presenting the "Recreation Unlimited" program. Elbert Coalson seconded the motion and the vote was unanimous. Mayor Porterfield congratulated Assistant Fire Chief Don Atkinson on receiving the Georgia State Fireman Association Outstanding Service Award. Jerry Mills asked if anyone knew of a five or six room house in Smyrna, for rent or lease, to be used for the Children's Adplesence Program. Earle Cochran made a motion we take bids to surplus the old police car #22, bids to be opened at the next council meeting. Homer Kuhl seconded the motion and the vote was five to one. Jerry Mills voted against. Ground breaking for the hew King Springs Park will be Saturday, September 21, 1974 at 10:00 o'clock A. M. Elbert Coalson made a motion the City pay membership dues to the Georgia Recreation Association for all Parks and Recreation Committee members. Earle Cochran seconded the motion and the vote was unanimous. Homer Kuhl stated the finance committee recommerided hiring a purchasing agent for the City and asked approval to start accepting applications and interviews. He asked the applications be submitted to Bob Burchfield to be presented to council. He also stated he would like to have the gart-age trucks moved as soon as possible. Meeting adjourned at 10:05 P. M. September 23, 1974 The regularly scheduled mid -month meeting of Mayor and Council was held at City Hall, September 23, 1974 and called to order at 7:30 o'clock P. M. by presiding officer Mayor John C. Porterfield. All Councilmen were present. _Allpresent were L. W. Charles, City Clerk, Willouise Spivey, Asst. City Clerk, Bob Burchfield, Administrative Asst., Nora Proctor, Clerk, Lee Silver, Parks and Recreation Director, J. E. David, Supt. of Public Works, Leon Hood, Building Inspector, A. L. Coleman, Heating and Air Conditioning Inspector, Berl T. Tate, City Attorney, Joe Briggs, Consultant Engineer, and a repre- sentative of the press. I-_. Invocation was by Councilman Homer Kuhl. J. E. David, Supt. of Public Works, reported on drainage problems as follows: (1) Glendale and Birch Street: A curb has been installed from behind the restaurant on South Cobb to Birch Street. (2) Campbell Road, Kitchens property: Estimated cost of pip_e_from rear of Kitchens home to Howell Drive was $3200.00 Three home owners are involved. Councilman Forster Puffe was requested to contact Mr. Kitchens and the other property owners in regard to their reaction on the cost of the pipe. (3) Mr. Leon Faulkner of 590 Wooddale Drive submitted a larger map of the Wooddale and Trailwood Drive area. Mr. Faulkner stated that from the information he was able to obtain, approximately 18 years ago the City was requested to dig a ditch for surface water drainage purposes, by the developer of the area; however, no easements have been located, and he feels the City has some responsibility in a permanent solution to the drainage problems. He also stated he had contacted most of 'the property owners in regard to a ditch on the property lines with a five foot easement from each home owner. He stated the property owners on one side were not favorable; on the other side he thought most would be favorable. Councilman E. R. Coalson was requested to meet with Mr. Faulkner, citizens in the area, and the Streets Committee at 6:30 o'clock P. M., September 30, 1974, to try to work out a solution to the problem. Public Works Supt. J. E. David reported that Neel Contracti g Compgn'y would not install sidewalks on Concord -Love until C. W. Matthews had completed all of their work. The finishing work by C. W. Matthews Company was to be discussed with State officials at a meeting September 24, 1974, at 1:30 o'clock P. M. In regard to traffic lights, Councilman Forster Puffe reported a letter had been re-
