08-19-1974 Regualr Meeting(continuation of August 19th minutes) 266 All action on sanitation deposits, water deposits, and unpaid wate_r.bills, was deferred to the next meeting. On motion by Marston Tuck, seconded by E. R. Coalson, Council Meetings for September were changed from the first and third Mondays, to September 9th and 23rd, due to Labor Day holiday. Vote on the motion was unanimous. C. 0. Canada reported the golf driving range+in rear of Mr. Steaks on South Cobb Drive was a nuisance to the neighborhood-, one lady having picked up 300 balls from her yead. The building inspector was requested to write a letter to the owner giving him 30 days to erect an adequate fence. It was agreed by Mayor and Council that.Victory,Cab drivers would have to be cleared through the police department if they are to drive in Smyrna. Speed breakers in residential areas was referred to the streets committee and police committee for study and recommendations. It was reported that King -Williams had made 'arrangements to pay their delinquent water bill. The City Attorney reported he had heard nothing further on the business license fees, concerning apartments and real estate. - The meeting adjourned at 8:40 P. M. AUGUST 19, 1974 The regularly scheduled mid -month meeting of Mayor and Council was held at City Hall, Smyrna, Georgia, August 19, 1974, and called to order at-7:30 o'clock P. M. by presiding officer Mayor John C. Porterfield. All Councilmen were present. Also present were: L. W. Charles, City Clerk,-Willouise Spivey, Asst. City Clerk, Nora Proctor, Clerk, Lee Silver, Director of Parks and Recreation,.J. E..David, Supt. of Public Works, Leon Hood, Building Inspector, Don Atkinson, Asst. Fire Chief, W. L. Westbrook, Plumbing Inspector, Joe Briggs, Consultant Engineer, and a representative of the press. Invocation was given by Councilman Homer Kuhl. Under Agenda Item 2, Reports from Citizens, Mr. and Mrs. C. K. Panter, of 1084 Fleming Street, appeared before Mayor and Council in regard to their inability to tap on to the recently installed sewer line in Fleming,Street. Mr. Panter stated the tap should be 10 lower for him.to tap on. He also stated that of the eight homes on Fleming Street, only three had been able to tap on to the sewer line. Mr. Joe Briggs of Mayes, Sudderth and Etheredge, requested that a member of his firm be permitted to inspect the basement of the Panter home to study all alternatives and find a solution to the problem. 'Mr. Panter was agreeable to this proposition. Mr. Joe Hardin is to arrange a meeting; at the Panters' convenience, at which time Mr. W. L. Westbrook, City Plumbing Inspector, will be notified in order that he may meet with both parties. A recommendation to correct this problem, as well as, the problem of other residents on Fleming Street tapping on to the sewer line will be made at the next meeting. Mr. Jerry Weiner, 3305 Sleepy Lane, also appeared before Mayor and Council regarding the backing up of sewage into his home. Mr. Weiner stated the county had waited at least two weeks on one occasion to pump out the man hole. Marston Tuck motioned that all building permits pertinent to that sewer,line-be brought before Mayor and Council before being issued by the building inspector.. Earle Cochran seconded the motion which carried by unanimous vote. Mayor Porterfield requested J. E. David to set up a meeting with Mr. Sutton of the Cobb County office in Mr. Sutton's office and inform him of the time of the meeting in order to work out a solution to the problem. The debris in the'area and low spot in Mr. Weiner's front yard was referred to J. E. David for check out and report at the next meeting. There were no zonings nor annexations to be brought before.Mayor-and Council. City Attorney Berl T. Tate reported there was no easement of -record on -the ditch in the Trailwood-San Fernando area. E. R. Coalson stated he understood that Mr. Faulkner's lawyer was trying to get an injunction against Mrs. Hyde to prevent filling in of the ditch. J. E. David was requested to talk with Vic Broyles on his checkout of the area. 267 (continuation of August 19th minutes) J. E . David reported that Love -Concord was scheduled for black topping on Thursday of this week, provided there was no rain. Commercial building permits were submitted by building inspector Leon Hood and upon his recommendation the following action is recorded: (1) Church of the Nazarene, Plaza Drive, 22 foot extension to the present building. The building inspector recommended approval subject to the Fire Marshall's approval. On motion by Earle Cochran, seconded by Jerry Mills, the permit was approved subject to the building inspector's recommendation. Vote'on the motion was unanimous. (2) Sign (bill board size) for Woodsong Apartments, South Cobb Drive adjacent to Brookview Gardens Apartments property, to be erected by Atlanta Sign Company -- Harvey,Nix, land owner. On motion by Earle Cochran, seconded by Jerry Mills, the sign was approved granting the variance required, with the stipulation that Mr. Nix give the City a 30 day option on removal of the sign, the same agreement he had with the land owner of the Woodsong Apartments. The vote was six to one, Homer kuhl opposed. Bids were opened on a movie projector for the Civil Defense Department. One bid from Spire Audio-Visul-,Company, Incorporated, was for $753.18. Another bid submitted by S. W. Kinman, Jr., Vice President, -(no company name listed) was $913.68. The bids were referred to committee for report at the next meeting. Mayor John Porterfield stated he had received an appraisal on the property on Concord at South Sherwood, being considered for a new fire station, of $39,400. Homer Kuhl motioned that Council accept the contract of $38,500 subject to checkout of title by the City Attorney. Forster Puffe seconded the motion which carried by unanimous vote. Mayor Porterfield stated he had received nothing in writing from Mr. Ralph Reimer giving his resignation as a member of the Planning and Zoning Board; however, since there was a vacancy, he requested all Councilmen to submit recommendations in writing at the next meeting. Forster Puffe was appointed to attend the Planning and Zoning Board meeting for the month of September. Lee Silver read a letter concerning recommendations of the Community Center on what should be done at the Canteen for the Senior Citizens program. He stated one of the staff members would be in charge of the program and a van would be borrowed from one of the other centers. Earle Cochran motioned that the City purchase one SR-8 radar at a cost of $1385.00 to be used in control of traffic in residential areas. Homer Kuhl seconded.the motion which carried by unanimous vote. Bids for the Century radar system are to be opened at the next meeting. Mayor John Porterfield is to write a letter to Colonel J. H. Cofer in regard to locations and state requirements of the radar. It was reported that the contract for the Civic•Center was in work and should be ready for the next meeting. However, since the City is proposing to buy only a portion of the original property; Forster Puffe motioned that authority be granted to have a survey made of the selected portion the City propose9 to purchase. Homer Kuhl seconded the motion. The vote was unanimous. Discussion on water and sanitation deposits was deferred. On motion by Earle Cochran, seconded by Jerry Mills, September 23, 1974, was the date set for public hearing on the sign ordinance. Vote on the motion was unanimous. In regard to complaints of citizens near the Golf Driving Range on Old'Concord, Mayor Porterfield stated he had scheduled a meeting with the owner on August 20, 1974. Lee Silver stated that 35 children attended the first day camp and 40 children went on the trip to Six Flags also; he hoped the ground breaking for the King Springs Park could be held the week of September 16. Finance Chairman Homer Kuhl requested all committee chariman to postpone purchase of all items that were not absolutely essential for the next thirty or forty days. R a u u (continuation of August 19th minutes) 268 It was reported that a water melon cutting for citizens of Smyrna was planned for Labor Day, provided the water melons could be purchased. Jerry Mills requested that the City Attorney and J. E. David obtain a contract in writing with Complete Refuse Company for pick up of garbage at apartment complexes. On the recommendations of Jerry Mills, Mayor John Porterfield stated that specifics on audits of equipment, etc. would be worked out in committee. On recommendation of the Police Committee, Earle Cochran motioned that the Police Department and Recorder's Court be authorized to accept checks from City property owners only;for police fines and bonds. The motion was seconded by Homer Kuhl. Forster Puffe amended the motion to follow this policy for a period of 90 days and then a complete report be submitted to Council. Jerry Mills seconded the motion. Vote on the amendment was unanimous. Vote on the main motion was unanimous. Marston Tuck motioned that all checks returned from the bank be run through a second time; and if they returned again, a $4.00 service charge be added. E. R. Coalson seconded the motion which carried by unanimous vote. J. E. David was requested to have shrubbery, grass, weed,; etc.,. blocking the sidewalks on Cherokee Road across from the Post Office, trimmed back; also, from the,- apartments to Cherokee Road on Ward Street. Homer Kuhl reported a very successful childrens' program at the library this summer, and a record high of 7,118 books and records checked out for the month of July. Mayor Porterfield reminded Councilmen of the Jonquil Breakfast at the new Smyrna Hospital on Wednesday morning, August 21. The meeting adjourned at 9:15 P. M. - Le - 342�a, J-J rC.
