JULY 21, 1975
The regularly scheduled mid -monthly meeting of Mayor and Council was held at City Hall,
Smyrna, Georgia, July 21, 1975, and called to order at 7:30 P. M. by presiding officer
Mayor John Porterfield. All Councilmen were present. Also present were L. W. Charles,
City Clerk, Willouise Spivey, Assistant City Clerk, Lee Silver, Director of Parks and
Recreation, Jim David, Supt. of Public Works, Bob Burchfield, Administrative Assistant,
Leon Hood, Building Inspector, Don Atkinson, Asst. Fire Chief, B. T. Tate, City Attorney,
and representatives of the press.
Invocation was given by Councilman Homer Kuhl, followed by the Pledge of Allegiance.
Under Citizens reports the following action is recorded: Betsy Hosea of the Smyrna
Federated W6mens Club reported the Club's Project for the year was a "Tornado Warning
System". They wish to work with the City of Smyrna Civil Defense Department to set up
this system. She stated she had been in contact with Jim Farley, Director of Civil
Defense and Marston Tuck. Mayor Porterfield said he would be happy for the club to
work with the Civil Defense Department on this worthwhile project and stated the city
would help in any way possible.
John Williams of the Boys baseball League appeared before Mayor and Council, requesting
permission to have a bucket brigade the first week in August, to help defray the cost
of the tournament. Elbert Coalson made a motion permission be granted to hold the
bucket brigade, provided they work wi.th our Police Department as to intersections, etc.
Forster Puffe seconded the motion and the vote was unanimous.
James M. Dean, owner of the property at the corner of Ldce Drive and Green Forest Lane,
asked permission to put up a fence four feet beyond his property line, on property
owned by the City. City Attorney Berl Tate advised Mayor and Council to secure a letter
from Mr. Dean, stating he was aware his fence extended four feet beyond onto property
owned by tthe'City of Smyrna. This letter would prevent any misunderstanding in case
Mr. Dean sold the property. Earle Cochran made a motion Mr. Dean's request be granted,
subject to receipt of a letter stating his fence is four feet inside the City of Smyrna
right-of-way, that he would be responsible for any repairs if the city should have to
go on the property to repair sewer lines, etc., and submit $4.00 to cover the cost of
recording this document. Forster Puffe seconded the motion and the vote was six to one.
Homer Kuhl voted against the motion.
Commercial building permits were submitted by Leon Hood, Building Inspector, and
upon his recommendations the following action was taken;
American Oil Company requested a permit to erect a self-service service station at
the corner of Herodian Way and U. S. Highway 41. Mr. Hood stated a building permit
had already been approved for a service station at this location and this request
was to change the type station to a self-service, with a car wash located in the
rear. Mr. Hood stated the plans had been approved by the Fire Department and he
recommended they be approved. On motion by Jerry Mills, seconded by Forester Puffe,
therpermit was approved by unanimous vote.
Boling Construction Company, Dr. Ben Norton and Dr. Matthews requested a permit to
renovate a portion, approximately 2500 square feet, of the Cherokee Medical Building
at 939 Cherokee Road, to be used as dental offices. Mr. Hood stated the plans had
been approved by the Fire Department and he recommended they be approved. Homer Kuhl
made a�motion the permit be approved. Elbert Coalson seconded the motion and the
vote was unanimous.
Building Inspector Leon Hood stated he and C. J. Sanford from the Fire Prevention
Bureau had inspected the Stephens Woods Apartments and found them in dire need of
repair. He stated a registered letter had been mailed to K. T. Dornbush, 1st National
Bank Tower, Peachtree Street, Atlanta, Georgia, with copies to Al Brooke, the Insurance
Company of North America, and the resident Manager of the Apartments listing the
following violations:
1. Simulated bricks falling off the buckling on exterior ends of each building.
2. Wood trim needs caulking and painting.
3. Vertical openings in electrical and heating rooms must be closed.
4. Door in washeteria broken.
5. Combustible storage of materials in mechanical room in washeteria.
6. Gutter and doNn spouts need securing.
Mr. Hood advised Mr. Dornbush in this letter that he must have a written reply from
him within 10 days as to his position on this, and that repairs must begin within 30
days, or further action will be taken.

Mayor John Porterfield read a sample resolution by HUD, aking the City of Smyrna to
participate in 'the Federal Rent Supplement Program at the Stephens Woods Apartments.
Jerry Mills made a motion the resolution be approved. After much descussion, the
motion died from lack of a second. Mayor Porterfield asked Attorney Berl Tate to
check into Section 101 of the Housing and Urban Development act of 1965 as to the
legal aspects of'the program. Ms. Judy Pilgrim, resident manager of the apartments,
is to have a representative of HUD contact Berl Tate with reference to this resolutio
Mayor Porterfield will then call a meeting.
Jerry Mills reported that plans for Fire Station #3 had been received from the
Architects and the only change made was the mechanical room and the storage room
switched positions. Earle Cochran made a motion the plans be approved. Clarence
Canada seconded the motion and the vote.was unanimous.
The Architect recommended bids for the Fire Station be 1st as (1) Maximum price, (2)
Cost plus and (3) Cost plus maximum with 50-50 rebate. Jerry Mills motioned that
bids be let on the three proposals. Forster Puffe seconded the.motion and the vote
was unanimous.
Mayor Porterfield reported that a proposal had been made on the purchase of the
building for the Purchasing Department and we -were waiting on their.reply._

Lee Silver reported good progress on King Spring Park. He stated the grading and
irrigation had been completed, curb and gutter work was to begin today, the building
was under construction, a proceed order had been issued for the lighting and the
sprigging of grass was being started this week.
Forster Puffe read a letter addressed to the Mayor from Earnest Barrett advising us
of a 60% increase in sewer rated, effective August 1, 1975. Mr. Puffe stated this
increase in cost of sewerage would amount to an additional expense to the City of
approximately $7,200.00 per month. Referring to the increase in water and sewerage
rates to our customers as of July 1, 1975. Mr. Puffe said we were still the lowest
in the County, that Cobb County customers paid more than double our rates. Mayor
Porterfield stated the Water Revenue Savings Certificates, in the amount of $380,000,
have built up over the year, due to the many water related expenses being paid from the
General Fund. All water related expenses are now bing paid from the Water Revenue Fund.
Mayor Porterfield read an excerpt from a letter from Attorney Berl Tate stating that
Public Notice of the election shall be published at least thirty (30) days prior to
the election; that notice of candidancy shall be filed at least fifteen (15) days but
not more than forty-five (45) days prior to the election. Homer Kuhl made a, motion
the opening date for qualification be September 22, 1975 at 8:30 A.M. through
October 2, 1975 at 5:00 P.M.. Jerry Mills seconded the motion and the vote was
unanimous.
Homer Kuhl motioned that voter registration be closed October 2, 1975 (30) days prior
to election). Earle Cochran seconded the motion and the vote was unanimous.
Mayor Porterfield reminded alj,:candidates for the upcoming November 1, 1975 election
they must comply with the Disclosure Law.
Mayor Porterfield reported a good turnout for the Bicentennial meeting July 15th.
An executive Board was appointed and are recorded as follows: Chairperson, Joe Reynolds;
Vice -Chairperson, Tom Corso; Secretary, Ruth Canada; Treasurer, Lewis Reagin. The Board
of Directors are: Jeanette Coleman, Margaret Dunn and Barbara Greeson. A steering
Committee composed of one member was selected, from each of the fourteen (14) Civic
Club represented. Homer Kuhl was appointed to the committee to represent Council.
Mayor Porterfield said he was on Ex-Officio member for the City, as well as being on
the Committee for Cobb County. Joe Reynolds stated he had appointed a Liaison Committee
as follows: Joe Thompson, Government; Bob Fortwood, Church, Ken Nix, Business.
Jerry Mills made a motion to donate $500 to the Smyrna Bicentennial Committee, to be
paid from the Contigency Fund. Forster Puffe seconded the motion and the vote was
unanimous. Mr. Reynolds said there was a possibility we could 'get a Federal
Bicentennial Grant and Mayor Porterfield is going to ask John Kidd to interpret this
Grant.
Departmental Financial statements were deferred to the next meeting.
The amendment to the Electrovision Contract was withdrawn.
The Sign Ord.ilnapce Public Hearing will be July 28, 1975.

JULY 28, 1975
A public hearing on the City of Smyrna Sign Ordinance was held at City
Hall, Smyrna, Georgia, July 28, 1975. Mayor John C. Porterfield called
the meeting to order at 7:30 P. M. All Councilmen were present; also,
L. W. Charles, City Clerk, Bob Burchfield, Administrative Assistant and
fepresentatives of the press.
Several owners and representatives of sign companies attended the hear-
ing. The ordinance was read aloud and discussed at lenght. A motion was
made and seconded to adopt the ordinance as read and amended. Vote on
the motion was unanimous.

Clarence Canada reported that Horace Crowe, Sports writer for the Marietta Daily
Journal, is retiring this year and that friends are collecting funds to buy him
a new car. Mayor and Council made a personnal donations for this gift.
Mayor Porterfield stated he will set up a meeting to schedule capital purchases
from Revenue Sharing at an early date.
