FEBRUARY 4, 1974
The regularly sehbduled meeting of Mayor and Council was held pursuant
to the Charter at City Hall, Smyrna, Georgia, on February 4, 1974,
and called to order at 7:30 P. M. by presiding officer Mayor John
C. Porterfield. All Councilmen were present. City C1erk.L: W.
Charles was absent due to illness. Others present were: Willouise
Spivey, Asst. City Clerk, Nora Proctor, Clerk, J. E. David, Supt.
Public Works, C. C. Porterfield, Chief of Fire Department, W. L.
Westbrook, Plumbing Inspector, A. L. Coleman, Heating and Air
Conditioning Inspector, and a member of the Marietta press.
Building Inspector Leon Hood was absent due to illness.
Invocation was given by Councilman Earle Cochran.
Under Citizens Reports, Mr. 0. B. Logan appeared before Mayor
and Council requesting aid in having the creek between the Brookview
Gardens Apartments and his property rechanneled to the original
creek -bed in order to prevent drainage waters from.flooding his
property.. Mayor Porterfield stated we would -do whatever we could
to get the county equipment back to the location to correct the
problem, and requested Councilman Forster Puffe to coordinate'the
work with Gene Jackson of Cobb County.
`A,�representative of King -Williams Realty Company, appeared before
Mayor and Council and apoligized for a misunderstanding on the
zoning hearing of the Geneva Arnold property on Atlanta Street.
He stated the doctor who was interested in purchasing the property
had . contacted him about 5 :00 P. M. on the date of the hearing
stating he could not afford to buy at the present time and he
did not realize someone should have been'at the meeting.
A request was submitted by James M. Chamblee and J. B. Dutton to
set a hearing date to rezone property at the corner of Concord
Road and Hollis Street'(known as the Dutton property from District
"C" to C-2 for the purpose of a Tire Store and Garage. Mayor
Porterfield explained that the new zoning ordinance would become.
effective March 1, 1974, at which time, all requests for rezoning
would go before the planning board and then be referred to Mayor
and Council for a hearing date. Mayor Porterfield requested that
the petitioners leave their telephone numbers and they would be
notified within the next few days of the zoning hearing date.
f A petition was submitted by F. R. Davis, Jr. and J. G. Russell
for annexation of Lot #8, New Spring Road, 150' west of Jonquil
Drive R.O.W., under present Cobb County zoning, General Commercial
the property is located between Jonquil. Liquor Store and Mac's -`
Bar-B-Que. On motion by Homer Kuhl, seconded by E. R. Coalson,
the property was annexed as requested under Cobb County zoning,
General Commercial, and made a part of Ward #2. Vote on the:cmotion
was unanimous.'
A petition was submitted by Howard Ellis to annex Parcel "C"
and �B", approximately 3.657 acres northwest corner of Spring
and Hargrove Road, westerly to property line of Mt. Bethel Baptist
Church, under Cobb County Zoning R-20. On motion by Forster Puffe,
seconded by Earle Cochran; the property was annexed into the
corporate limits, under Cobb County zoning R-20, and made a part
of ward #1. Vote on the motion was unanimous. _
A hearing date to rezone the above annexed property from R-20
County, to City of Smyrna General Commercial,,was postponed due
to the new zoning ordinance effective March 1, 1974. L. W.:Charles,
City Clerk, is to contact Mr. Howard Ellis as soon as the hearing
date is determined.
A request to set a hearing date to rezone three parcels known
as 1352, 1366, and 1370 Love Street from R-1 to District "C"
was deferred.
A residential permit for a one chair beauty shop at 2861 Sherwood
Road was requested by Mrs. Mary Brookshire. All residents within
300' had signed a petition stating they did not object and Mrs.

Brookshire stated she understood all regulations; no on street
parking, no employees and no signs. The permit was approved on
motion by Jerry Mills, seconded by Earle Cochran. Vote on the
motion was unaimous.
There were no commercial building permits to=come before Mayor
and Council.
A report on Ventura Road progress was deferred in the absence
of Leon flood, Building Inspector.' Bids were opened on surplused
Police Car 411 and'Civil,Defense Car, at1970 Chevrolet, and,are
recorded as follows:

C. 0. Canada motioned that all bids be rejected and requests
sent to'all firms that had previously purchased surplused equip-
ment. The motion was seconded by Jerry Mills. The motion lost
on a four to three vote. Voting for the motion, C. 0. Canada,
Jerry Mills, -Earle Cochran. Voting against the motion, Marston
Tuck, Homer Kuhl, E. R. Coalson-and Forster Puffe. A list of
the firms that requests bids had been mailed to, along with tte
two bids received, and referred to the garage committee to
negotiate with the companies and report back at the next meeting.
J. E. David stated -he had a meeting at 10:00 A. M. Tuesday,
February 5, with Ron Colvin with the Department of Transportation,
in regard to height of the curb at South Cobb*and Concord and
the fifth lane in front of Dicksonfs Shopping Center.
It was agreed by Council Members that requests for bids would
be let for traffic signals on South Cobb Drive, per state
specifications, for opening at the next meeting.
J. E. bavid reported that he had talked to the telephone company
today and they promised to remove the old telephone poles on
Concord4Love this week. Installation of 6torm sewers would be
next and then the curbs could be installed. Mayor Porterfield
requested Mr. David to set up a meeting with C. W. Matthews'
or his foreman, the street committee, himself, and J. E. David
for Wednesday or Thursday afternoon.
Mayor Porterfield stated he,would request George Kreeger to set
up a meeting with the Cobb County representatives and the.Depart4
ment of Transportation and Council Members as soon as possible
after the General Assembly adjourns. -
A list of streets per priority was read by Mayor Porterfield.
This list to be studied and revised prior to meeting with
Department of Transportation and legislative group.
Councilman C. 0. Canada reported there would-be a meeting next
Monday night at 7:30 o'clock P. M. with the Parks and Recreation
Commission. Also, that a meeting with the Parks and Recreation
Commission'and the Teen Canteen Board would-be held at 8:00 P. M.
Tuesday night, February 5, and he would like very much for all
Councilmen to attend.
City Attorney Berl T. Tate reported he had talked to House Council,
Jersey Mortgage Company „ doncerning Kassuba property on Hargrove
Road. Mr..Paul Stedman, General Manager, of Kassuba Enterprises,
appeared before Council stating the company was in the process
of trying to reorganize. He reported Kassuba equity at
$153,000,000. The next meeting pertaining to the Kassuba hearing
was reported scheduled for February 26, 1974.' City Attorney
Berl T. Tate withheld a ruling on whether a building permitt
could be issued on Phase 3 of Apartment Project until he.received
papers on *hat has been done so far, and what is proposed in the
reorganization of the Kassuba Corporation. Mr. Stedman stated
he would deliver the papers to Mr. Tate on February 5, 1974.

City Attorney Berl T. Tate stated the title check on the, Blaine
property, across the street from the police department, -should
be completed by the end of this week.
Finance Chairman Homer Kuhl noted the Sanitation and Garage
Departments are in the red per budgets approved for the fiscal
year July 1973 - June 1974. Mr. Kuhl also stated adjustments would.
be made to correct charges on Concord -Love, South Cobb in the
Water Department report.
Councilman C. 0. Canada stated bids would be requested for wrecker
service from eight firms; however, ,he felt the prices would be
higher than are being paid at present. Mr. Canada stated the;list
would be -submitted at the next meeting.
The self service gasoline station ordinance was discussed._ Council
was remined that the City has an ordinance prohibiting self-service
stations at this time, and until such time that certain legal
formalities have been settled.in other couft. cases, it would be well
to abide by the ordinance at this time.
Earle Cochran reported that modification, per state requirements,
rf� at the police station were well under way and invited Mayor and
Council to inspect the progress made to date. In connection with
the modification, Mr. Cochran motioned that four civilian personnel
be added to the,police department at a salary of $420 to $5B0 to
take_calls_and work the front desk. Each employee would work
and eight hour shift, three shifts, one person would_be.on stand-
by. Councilman Homer Kuhl seconded the motion which carried by
unanimous vote.
Walkie Talkies for the police *ere reported ordered, and call letters
for the Fire Department were received today. Call letters for
the -public works department were reported in the mail and expected
in about a week.
Councilman Forster Puffe moved that Mayor John Porterfield attend
the meeting of National League of Cities and Conference of Mayors
to be held in Washington on March 3. Homer Kuhl seconded the motion
which carried by unanimous vote. -
E. R. Coalson requested a report on Mark Turner and house on Cherokee
- Trail. It was reported that Mr. Turner had paid a fine of $600.00
- in Recorder's Court on Thursday.
Marston Tuck reported that he had received two additional quotations
on installation of radios - change over from the fire department
to public works trucks•,., in addition to the original from Motorola;
one from G. E. and one from Jimmy Hiatt's new company. Marston
Tuck motioned that all bids or letters be referred to the fire
department committee with.permission to act on;lowest or best
bid. Earle Cochran seconded the motion which carried by unanimous
vote. -

Councilman C. 0. Canada stated he had complaints in his ward on
un-kept lots. All Councilmen were requested to submit a list to
Jerry Mills who would follow through in sending letters to
property owners in violation of the City,ordinance on clean up
of property.
