The regularly scheduled mid -month meeting of Mayor and Council was held at City
Hall, Smyrna, Georgia on January 19, 1976, and called to order at 7:30 o'clock P.M.
by presiding officer Mayor Arthur T. Bacon. All Council members were present.
Also present were Willouise Spivey, City Clerk, Charles E. Camp, City Attorney,
Bob Birchfield, Administrative Assistant, J. E. David, Supt. of Public Works, Sherry
Reavis, Ass't. Parks & Recreation Director, Don Atkinson, Acting Fire Chief, Gene
Hoaster, Building Inspector, George Hardy of Mayes, Sudderth and Etheredge and
representatives of the press.
Invocation was given by C. 0. Canada, followed by the pledge to the flag.
No action under Citizen reports.
Mr. Glynn Jones, representing the Jones Intercable, Inc., appeared before Mayor and
Council requesting approval of transfer of the Smyrna Cable TV franchise. Mr.
Jones stated the sale of the company to Cobb County Cablevision Associates, to whom
Mayor and Council granted a transfer of the franchise on December 1, 1975, subject
to all taxes being paid, did not go through. Mr. Jones stated that Jones Intercable,
Inc., was now negotiating with Smyrna Cable TV (Anoconda) to purchase. They did
not present a plan of action, as to what improvements would be made. After
discussion a motion was made by Homer Kuhl to approve the sale of the franchise,
upon consummation of the sale between Jones Intercable, Inc. and Smyrna Cable TV
(Anoconda), subject to all taxes being paid. Mr. Kuhl also requested a meeting of
the Jones Intercable officials and the council, within 30'days, to discuss their
intentions of improving the service. Jerry Mills seconded the motion and the vote
was unanimous.
On motion by C. 0. Canada, seconded by Jerry Mills, a residential business license
was approved for Terry's Tax Service at 870 Wayland Court. The vote was unanimous.
Bill Darby made a motion'that we request bids for. (a) two out -door warning sirens,
and (b) installation of the two sirens, to be opened at the February 16, 1976
meeting. C. 0. Canada seconded the motion and the vote was unanimous. This equip-
ment is for the Civil Defense Department.
Mayor Bacon stated there was a vacancy on the Civil Service Board and three
vacancies on the Planning and Zoning Board. He asked all councilmen to submit
names of eligible citizens, especially in the wards not now represented on the board,
and they would be discussed Saturday morning before the regular meeting.
No commercial building permits to be approved.
C. 0. Canadakreported the building at King Springs Park was now being used for
classes and that grassing would be finished as soon as the weather permits.
Jerry Mills reported the heating system had been installed in the new fire station
building and work on the inside was progressing nicely. He said the building
should be completely finished within two or three weeks. Cement had been poured
for the back drive and it had frozen. He is to meet with the contractor to work
out this problem.
Jerry Mills reported a list of needed repairs on Fire Station No. 2-had been given
to Mayor Bacon and we should have a cost statement by Saturday. Bill Darby
requested another letter be sent to the contractor with reference to these repairs.
James David reported Cobb County had promised to furnish and install the pipe for
Jonquil Drive extension: He is to set up a meeting with Gene Jackson of Cobb
County this week.
Mayor :Bacon reported final approval was received January 12, 1976 by D. 0. T.
to resurface 3.67 miles of streets. James David stated Crabbe Paving Company was
awarded the contract and should begin work this week, weather permitting.
Mayor Bacon stated two suits had been filed against the City. (1) Johnny Pastic
against former City of Smyrna policemen William H. Allen and J. L. McCollum and
(2) R. L. Ruff against the City of Smyrna. Jerry Mills made a motion the City be
defended by Charles Camp, City Attorney, and all papers be turned over to him.
Homer Kuhl seconded the motion and the vote was unanimous.
Looking forward to the next two years, Mayor Bacon stated he thought we had a good
council and asked all councilmen to be open and above board in everything they do;
also, that everyone work together -for the good of the City.
Bill Darby read a letter from Lt. David Farmer stating he could find no reason
why John Nathan Brown, II', could not be approved as the new manager of Lums
Restaurant. On motion by Bill Darby, seconded by Jerry Mills, a manager change,
from Kenneth Albert Schaumberger to John Nathan Brown, II, was approved. Vote
on the motion was six to one. Homer Kuhl voted against.
Jerry Mills reported that on October 6, 1975, Mayor and Council passed a resolution
to amend 79 (House Resolution No. 208-855). This amendment provides a $6000 tax
exemption to the disabled. A letter supporting,this amendment is being mailed
to Senator Joe Thompson. Jerry Mills made a motion that a copy of this letter,
approved by this body, be made a part of the minutes of�this meeting. Bill Darby
seconded the motion and the vote was unanimous.
Homer Kuhl asked all councilmen to be aware of expenditures in their departments;
stated the personal taxes on automobiles has not been received as yet and that he
would like to have a meeting with'the committee members to go over the financial
conditions of the city. He suggested that everyone start working on budgets in
March.
Elbert Coalson made a motion that "no parking" signs be erected on the east side
of Cherokee Trail. C. 0. Canada seconded the motion and the vote was unanimous.
Rem Bennett inquired as to the final decision made on correcting the dangerous
traffic problem on Concord Road at Havilon Way. It was reported that John C.
Porterfield had written Commissioner Ernest Barrett asking for the installation
of an overhead flashing caution light to warn motorists. James David has also
contacted the county with reference to this problem and should have some answer
this week.
