The regularly,scheduled .mid -month meeting of,Mayor and, Council
was held at City Hall,, Smyrna, Georgia, on Decembe-r'.. 19,. 1970 and
called of order by presiding officer Mayor Haiold,,,L. Smith at 9:30
A.M. All Council Me�bers,were present. Also present -_City Clerk
L. W. Charles, D. Scott,Jackson, Leon Hood, J. E..DaV d and Bill
Grier of Mayes, Sudderth and Etheredge. Gity Attorney G. W.*Carreker
was.absent.
Invocation was by Councilman Homer Kuhl and all present participated
in Pledge of,Allegiance to the Flag.
No citizens appeared with problems to be brought before Council.
:Commercial buildng;.permits were submitted_by building inspector
Leon Hood and upon -his recommendations the following_action is recorded.
1. Artistic Sign Company, erect one 4f x 161 sign.for Pants Circus
(formerly Shift Shack) at..Belmont Hills Shopping Center. Ap-
proved unanimously on motion by J. C. Porterfield, seconded by J. P.
White.
110 A discuss ion followed in regard, to electrical, .plumbing and heating
�+ and, air conditioning ,permits being issued at the time the building
M permit is issued. Councilman Homer Kuhl recommended that the
�=+ various forms for electrical, engineering, driveways, etc. contain
the proper signature before being brought before Mayor and Council.
Building inspector Leon Hood,stated he would see -that all electrical,
heating, driveway, etc. permits for commercial buildings were pro-
perly signed before submitting to Mayor and Council for approval
and also that4 the builders now building would oe ,,not`ified that all
permits must be picked up,at the same time. ti
The- Birch Street sewar proect,was the next `items on the Agenda.
Mayor Harold L. Smith stated that he nor any -of Council had seen the
proposed engineering on the Birch Street project prior to asking
for bids and questioned•,the direction of the proposed line, due
to the problem of moving several underground • garbage cans, gas lines
and tearing up of sidewalks., -.After further discuss ion, ' it was sug-
,,.gested that the City could probably save.arouria $5,000 by running
the line down the middle of the street. Councilman C. 0. Canada
motioned that we rejuct the bids,,return them to the bidders,
sealed, and request new bids with construction in the middle of the
street. The vote was unanimous on second by Homer Kuhl. Mayor
Harold L. Smith referred the matter to C. 0. Canada to follow through.
Replacement of the existing water main on Love Street and Concord
Road with a 12." line was discussed. On motion by J. C. Porterfield,
Council approved the preliminary engineering to replace the water
main on Love Street and Concord Road with a 12" line. The motion
was seconded by Marston Tuck and voted unanimously.
Mayor Harold L. Smith reported, that engineering construction plans
for Atlanta Street widening from Spring to Love Street had been
requested from the county some time ago and a preliminary plan had
been received at this time; however, no specifications whatsoever
had been included. Mr. Grier of Mayes, Sudderth and Etheredge
stated there were two ways to handle the cost of the project:
(1) through a. percentage of the construction costs as set forth in
the contract, and (2) -on a cost plus basis. Mr: -Grier -was of the
opinion the second proposal -would be less expensive to the -City.
Councilman Homer Kuhl stated he would contact Mr. Emory Parrish
again to determine what part the State would take in the project.
The jiont sewer project between the City of Smyrna, Mr. Julian Le -
Craw and Kassuba Development Corporation was discussed. Mayor
Harold L. Smith reported on his proposal to the Cobb County Com-
missioners regarding sewerage disposal in the eastside 'temporary
plant scheduled for completion August 1, 1971, and also, his dis-
cussion regarding cost to the City of Smyrna for the eastside sewerage
transported to the new permanent treatment plant scheduled for com-
pletion December 31, 1972 at a rate of �5� per thousand gallons.
The item was deferred on the suggestion of Councilman C. 0. Canada
in order that the City of Smyrna's proposal to -the county could
be submitted in writing. •• ,

Mayor Harold L. Smith reported: (a) right= of -way deeds for the
Concord & Love Street project were in progress.,-•. (b) the, -downtown
redecorating and -restoration -program is in work and another meeting
will be held the first of the - year, (c) the-1971-House Bill is -in
progress and everything must be in final form by,the second -meeting
In January,, (d) only 100 more underground garbage cans remain to
be installed, (e) the third lane at South Cobb and Concord Road
was referred to Homer. Kuhl for follow through.
The November 2nd and 16th, 1970 minutes were approved as -.submitted
by unanimous vote on motion by Arthur T. Bacon, seconded by C. 0.
Canada. '
Councilman Hubert Black commented on financial reports and cited the
sanitation d.epartment•as being very much over the current budget.
He suggested a meeting the first of the year to realign or make
adjustments in the sanitation'department budget. Five men were
reported -to be dropped * from •the payroll on Friday.
On motion by Homer Kuhl, the second meeting in January was changed
from January 18, 1971 at 700 otclock P.M. to Saturday January 16,
1971, at 9:30 A.M.-in order that Mayor and Council •c`ould• attend the
Mayor's Day program An Atlanta. The motion was seconded -by C. 0.
Canada and voted unanimously.-

Councilman Marston Tuck reported he had tried -to -reach -an agreement
with Mr. Jim Farley for use -of a large siren now in,the.Civel
Defense office to be placed on the water tower a•nd used to notify
volunteer firemen when they,are needed.Councilman-J. P. White
stated the siren could not be used by the ,C ivil •Defens e`,off ice in
conjunction with the fire -department due -to the sequence used by
Civil Defense. Mayor Harold L. Smith appointed a committee of
Hubert Black and Homer Kuhl to -cheek out and make,a recommendation
as to the location of the siren at the January 4,11971 meeting.
Councilman C. 0. Canada reported there were signs on telephone
'poles and various places all over the City, particularly real
estate and apartment -'signs, which is against the City ordinance.
Councilman Homer,Kuhl to -instruct Mr. George Hood to remove the signs.
