Councilman B. F. Stewart stated that negotiations are under
way in regard to transfer of county and city water customers.
Future meetings are scheduled with Robert Sutton of the
Cobb County Water System.
-Discussed in Council and deferred to the new administration t
was the loss in City of Smyrna revenues by reason of the
increase in wholesale water rate from 22� per thousand
to 25q1 per thousand, effective January 1970, which accord-
ing to submitted figures will average $18,000 loss in
re venue .
Minutes for November 3 and November 17 meetings were sub-
mitted in Council. Reference was made to Page 4 of the 11-17-69
minutes to insert the effective date (1-1-70) in connection
with the adoption of the recently published ameddmdnts to
the National Electrical -Code. The minutes as submitted
for the above dates called out were approved on motion by
J. C. Porterfield, second by C. W. Armour, and voted unanimous..
The four months cumulative financial re orts (July through
October) showed actual expenditures of 337, 511 under the
cumulative budget for this period. Several- accounts in
the following departments were reported in red: Administrative
Garage, Library, Street, Fire and Sanitation. Explanations
of these accounts were"reported and accepted.
Mr. D. Scott Jackson reported that a residential structure
was being built on Lot 22, which parcel of land lies south
of the previously annexed subdivision on Ann Road. On a
motion of C. 0. Canada, seconded by J. B. Ables, Lot #22,
of Block C. Section 6, Argyle -Estates, lying and being _in
LL773, was annexed into the corporate limits of the City
of Smyrna as part of Ward No. 2. The petitioner W. J.
MacKenna agrees to abide by all ordinances, codes, regula-
tions of the City of Smyrna and to pay regular taxes -:to the
City of Smyrna, effective 1971.
Mayor G. W. Kreeger referred to the Chief of Police the
securance of bids covering wrecker service for all city
vehicles including personal cars and trucks authorized to be
moved from city rightPof-ways. Councilman J.-B.-Ables to
follow up.
In final action, J. B. Ables motioned for bids covering two
police patrol cars, said bids to be opened and publicly read
in Council meeting December 15, 1969 at 7:00 o'clock P. M.
The purchase of the two patrol cars to include trade=ins.
Motion seconded by B. F. Stewart and carried.
There being no further business, a motion was made to adjourn.

DECEMBER 15, 1969
The mid -month meeting of Mayor and Council was held at
-City Hall, December 15, 1969. Mayor G. W. Kreeger presided
and called the meeting to order at 7:00 o'clock P. M. with
all Council Members present except Ward #3 Councilman, R. H.
Wood. Staff members present were: L. W. CHarles, City Clerk,
Berl T. Tate, City Attorney, Inspectors L. W. Boring, C. M.
Hamby, W. L. Westbrook, Chief of Police, Robert L. Drake,
J. E. David, D. Scott Jackson, V. M. Broyles and Nora Proctor.
Also present, Joe Bork of Hensley -Schmidt Associates, and a
representative of the Marietta press and WBIE.

Under Citizens Reports, the first item ,,on the Agenda, Mr.
Bob Beverly and Mr. Kenneth L. Burson came before Council in
reference to property annexed into the corporate limits of the
City of Smyrna on June 2, 1969. The property is in LL 878
of the 17th District, Second Section, and known as lots 5, 6,
and 7 of Cobb County Georgia. On July 21, 1969 the above
described property was rezoned by Smyrna City Council from
R-1 (AA) (county) to R-2, multiple family dwellings,
apartments (city). The rezoning was approved unanimously.
Mr. Beverly and Mr. Burson stated they would like to start
construction by March 1, 1970; therefore, would need sewerage
by July 1, 1970 and asked assurance this would be available.
City Attorney Berl T. Tate stated annexation meant utilities
would be provided. Mayor Kreeger informed the Burson Property
developers he could forsee no problems involved in getting
construction under way and that sewerage would be available.
The next person to appear before Council was Mr. Tom Mathis
who made a short talk in appreciation of the progress made
in Smyrna during the present administration.
No opposition appeared in Council in connection with the
G� zoning hearing District "C" & R-1 to C-1 local commercial,
U Old Concord and Benson Poole Road. The property composed
U of approximately nine acres will be used as retail commer-
cial. On motion by J. C. Porterfield, -seconded by C. W.
Armour, the property was zoned as advertised. The vote was
unanimous.
The discussion regarding the rezoning of the Maud R. Parks
property on Atlanta Road to C-1 and R-2 resulted in a request
by Mr. Cagle to withdraw the petition. Approximately 25
citizens appeared in opposition to the rezoning and it was
brought out there was a technical error in the listing of
the Cobb County zoning classification in the advertised zoning
petition. On motio by B. F. Stewart, seconded by C. 0. Canada,
and voted unanimously, the application was ruled out of order,
and was withdrawn by Mr. Cagle. MEMO: Before adjournment,
Mr. Cag;e requested that a new hearing g date be set for
rezoning the property. On Motion by Homer Kuhl, seconded by
J. C. Porterfield., January 19, 1969, was the date set for the
hearing. The vote was unanimous.
The thii^d zoning petition was published for W. J. MacKenna
Company to rezone property on Rollingview Drive from R-1
ztesidential to R-2, town houses. Approximately 70 citizens
appeared in opposition to the rezoning, with the usual objections:
overloading of schools, sewage, general depreciation of homes
in the area, buffers, etc. After a lengthy discussion, a
motion was made by C. W. Armour,that the petition be denied.
The motion was seconhd by J. C. Porterfield. The vote was
four to two. C. W. Armour, J. C. Porterfield, Homer Kuhl and
B. F. Stewart voting for. J. B. Ables and C. 0. Canada voting
against.
Mr. Ron Cochran represented petitioner L. F. Daniell in the
zoning;.hearing for property located in LL 600 (approximately
38.5 lacres) R-1 to R-2. Mr. John Scamehorn, 1491 Spruce Dr.
was spokesman for the opposition. Per certificate from
Cobb County Planning Commission, submitted by Mr. Scamehorn,
the zoning notice as advertised should have read R (Cobb County)
to R�42 (City of Smyrna). On motion by C. 0. Canada, seconded
by J. C. Porterfield, the petition was withdrawn, on unanimous
vote.
No opposition appeared before Coun&il on the zoning hearing,
"C" to C-1, office use only, Cobb Lane. (First .house facing
Cobb Lane from Floyd Road). J. B. Ables moved the application
be approved as advertised provided adequate off street parking
is available and it is restricted to -office use only. The
motion was seconded by C. 0. Canada and voted unanimously.

No commercial building permits were brought before Council.
Superintendent of Public Works..J. E.-David reported that
drainage pipes had been installed on Parkway Drive and LaVista
at Pinehill would be next project.
Mr. JoeBork of Hensley -Schmidt Associates stated he would'
find out the status of the traffic studies and report back
to Council. He stated there had been no action on the
treatment plant at the 4-Lane by the State Water Control
Board. Mayor Kreeger to talk to Mr.-SamP. Hensley on this
matter.
No report on proposed road, Atlanta to Ward. Mr. Ray Newton
to contact County Board of Education on easement.
Bids on two new police patrol cars were opened and read
in Council as follows:

cess of budget. The bids: The Clynn Thompson Equipment
Company, Birminghac;, Alabama, in the amount.of $13,780.60,
and Nickson Machinery and Su ply Company, Chattanooga,
Tennessee, in the amount of 313,810.30, were rejected on
motion by C. W. Armour, second By B. F. Stewart, and
voted unanimously.. On motion by C. 0. Canada, seconded_
by B. F. Stewart, bid procedure was waived, and purchase
of one c.y. Leach sanitation truck from Brackett Equipment
Company, Atlanta, Georgia, in the amount of $13,588.05 was
approved unanimously. Delivery to be madei mmediately.

City Attorney Berl T. Tate reported.there was no change in
the tresspass suit filed by W. L. Turner. Mr. Tate also
stated that no satisfactory sum had been proposed by Mr.
Gilstrap for damage to city property. Proper forms have
been filed with Department of.Public Safety. It was also
reported that the account of the Lexington Apartments has
been paid in full, Fi-Fa marked satisfied and drainage
project completed to satisfaction of City.
It was reported by B. F. Stewart that 36 meters (city) had
been traded with the county. Those traded to the county
are on Dan Place; meters on Campbell Road and Pat Mell Road
now city water system, effective January 1, 1970.
Preparation of Smyrna House Bill for 1970 to begin in Dec-
ember 1969, and members of legislature notified that bill
will be submitted.

Chairman Homer Kuhl reviewed November and Five Months Cum-
ulative financial Reports and motioned that the following
amounts be transferred from General Fund to the.three
departments listed below:
Sanitation $13,000 (Capital)
Garage 21500
Library 2,500 (Capital)
The motion was seconlded by J. C. Porterfield and the vote
was unan imous .
MEMO: Capital to library was to cover cost of replacing
air conditioner. Garage - gas, parts, etc. (Mr. Canada
to secure bids on maintenance of air conditioners.)
No applications for malt beverage were submitted for
consideration.
Application for permit for mobile office, Mr. Tax of America,
at Belmont Hills Shopping Center, was brought before Council.
Permit approved on motion of C. 0. Canada, second by J. C.
Porterfield. The motion was approved by unanimous vote.

Councilman J. B. Ables read ordinance pertaining to.prohibiting
trucks haveing a weight of five thousand pounds from traveling
on Campbell Road. The ordinance was amended to read, "all
trucks haveing a weight of 18,000 pounds or more are hereby
prohibited". The ordinance was adopted as amended by
unanimous vote on motion.by J.B. Ables, seconded•by Homer
�Kuh1. .
Councilman Ables also brought up the matter of chairs for
the adult reading room at the Library. The cost of redec-
orating the now vacant room was quoted at $6832.26, and a
fee of 1076 of the amount to be paid to interior decorator.
Deferred.
Councilman C. W. Armour read a request from W. S. Payne,
Educational Director of the Bethel Baptist Church, asking
permission to distribute literature at intersections and
on street corners on December 20�., 1969 from one until
five P. M. On motion by J. B. Ables, seconded by-J.-C.
Porterfield, approval was given for literature to be
distributed on sidewalks, in shopping centers, and door
to door, but not in the streets or at any intersections..
Approved unanimously.
Mr. J. A. Bailey made a report on progress of the new
police station. He also stated he needed to start grading
and had requested Atlanta Steel Company several times
to pick up surplus steel. Attorney Berl T. Tate to
write a letter -to the company giving them five days to
remove the steel.
