12-02-1968 Regular MeetingDECEMBER 2, 1968 The regular meeting of Mayor and Council pursuant to the Charter was held at•City Hall, December 2, 1968, and called to order*at 7:.00 P.-M. by presiding officer Mayor G. W. Kreeger. All Council Members present except Ward 3 Councilman R. H. Wood. Other City employees in attendance, J. E. David, Berl T. Tate,-C. M. Hamby, L. W. Charles, and press representatives from the Marietta Journal and the Smyrna Herald. No citizens were present to speak before the Council. In the first order of business, the petition to rezone Mrs. Marion L. Coppenger's property, Atluta at Love, from R-1 to C-1 came up for hearing. Mr. Htigh Dobbins, spokesman for the Coppenger zoning, stated in Council the purpose of the rezoning but did not call out any specific use of the land and requested the Council to consider a change in the advertised petition from C-1 to District "C". City Attorney Berl T. Tate ruled that a change to District I'd? was per- missible under the Comprehensive Zoning Ordinance. Mr. Raymond Reed, spokesman for the opposition, stated his belief that the Council should continue the hearing as per advertised petition. L0 -7� During further discussion around the table, Councilman J. B. Ables motioned to grant the.request for continuing the hearing under W District "C" classification. The motion was seconded by J. C. Porterfield and did not carry. Voting for the motion J. B. Ables U and J. C. Porterfield. Voting against a hearing under District "C" classification, B. F. Stewart, C. 0. Canada, Homer Kutil and C. W. Armour. Mr., Hrigh Dobbins for the petitioners Mrs. Marion L. Coppenger and Mrs. Geneva B. Arnold withdrew the petitions as advertised. The Council voted unanimous approving the withdrawal of the petitions R-1 to C-1 involving the Coppenger.and Arnold properties which allows said petitioners to request rezoning under District "C" waiving the six months waiting period per ordinance. The above on motion by J. B. Ables, seconded by B. F. Stewart. MEMO: The above action covers two separate rezoning petitions. The first being Mrs. Marion L. Coppenger, Atlanta at Love; the second petition by Mrs. Geneva B. Arnold joins the Coppenger property on Atlanta Road. The following commercial building permits were submitted in ORuncil and on the.recommendation of the building inspector C. M. Hamby were approved for issuance on unanimous vote except as noted: 1. Replace one sign, Car Wash on Cherokee Road. Motion by J. C. Porterfield, seconded by C. W. Armour. 2. Pure,Oil sign (pole.type) on Spring,Road. Motion by C. W. Armour, seconded.by C. 0. Canada. 3. Gulf Oil Corporation, Cherokee Road, building permit granted with stipulation that radius northeast corner Cherokee Road and Cherokee Trail be widened. Motion by Homer Kuhl, seconded by B. F. Stewart. The vote was f ive.to one for the motion. J. C. Porterfield voting against. 4. Levin Sign Company, two window signs, 2506 Spring Road, Marti- nizing Plant. Motion by B. F. Stewart, second C. W. Armour. 5. Young Electric, two neon signs for the Bavarian Alpine Inn. Motion by C. W. Armour. seconded by B. F. Stewart, that appli- cation be approved with deletion of all reference to "beer sold here". MEMO: As of this.ahte malt beverage application was not presented for approval. 6. Hickory Lake apartments on Smyrna-PowdirzSprings Road. Permit for the structures (110) was issued by the Council pending check out and approval of the water runoff problem and the holding reservoir by City engineer. Motion by J. B. Ables, seoonded by C. W. Armour. The vote was five to one, C. 0. @anada voting against the motion. (Continuation of December 2, 1968 Meeting) 7. Car Wash adjacent to the Crown Central Service Station, Atlanta Street, was authorized a permit on motion Homer Kuhl, seconded by B. F. Stewart. MEMO: See 10-21-68-Minutes. The Council was informed per Agenda -Item No. 5, that the develop- ment of Unit No. 5, Bennett Woods, was scheduled for construction of 101 homes. This information places on notice all personnel regarding preliminary and final plats, profiles, streets, street lighting, -water, sewerage, and the securance of all required easements. A boundary survey showing sewer line locations of the City property in LL 379 on South Cobb Drive was submitted in Council., The property, recently sold to Cobb County investors, was.sold with the agreement that the City would submit the above mentioned survey. MEMO: The survey called out in Work Order #9-E in the estimated amount of $480.00 is payable by the City (f Smyrna to Hensley -Schmidt, Inc. -Progress on the East Side Project was reported as follows: the sewerage lift station for the apartments has been delivered, the condemnation and acquisition of right-of-way is in work, and the buffer required per Ordinance at the rear of the Sinclair Station, Woodlawn Terrace and Spring Road; was approved. On motion by J. C. Porterfield, shrubbery would act as a buffer on -the top of the embankment instead -of -at the property line. The motion seconded by J. B. Ables was voted unanimous. MEMO: A chain - link fence has been erected on the property line separating the commercial service station from the residence of Mr. Brooks: Annexation of Spring Road right-of-way into the corporate limits and the patrol of the right-of-way lying in the unincorporated area were reported in work by Berl T. Tate and J. B. Ables. A parcel of land recorded in the minutes as the -third lane at the Bank of Smyrna parking lot was reported in work and the deed, Bank of Smyrna to City of Smyrna in process. Public Works Superintendent J. E. David reported that some corrective action had been completed in connection with the deterioration of the shoulders on Campbell Road. A discussion around the table resulted in a suggestion that a fact finding study and an accurate traffic count be submitted in connection with reported complaints regarding the truck traffic on Campbell Road. The Ordinance under the caption -RESIDENTIAL TAX RETURNS BY CITY HALL (1-1-69) was read, discussed in Council, and adopted as amended on motion -by J. C. Porterfield, seconded by B. F. Stewart, and the motion carried on -unanimous voted. (The Ordinance as approved attached hereto). A report was called out in Council with reference to investment of City of Smyrna funds in U: S. Treasury Bills. The date of -purchase, November 27, 1968, is for 120 days at which -time the funds if needed shall be authorized for sale or rolled -over: The yield on the investment is 5.576. (1) From the City of Smyrna General Fund, $100,000; (2) From the City of S myrna General Fund --- sale of South Cobb property,-$85,000; (3) From the City of.Smyrna Water and Sewerage Revenue Fund, $85,000. The minutes as submitted covering November 4 and 6 Council meetings were approved on motion-J. C. Porterfield, second J. B. Ables. The minutes of November 18, 1968 were approved as amended on motion J. C. Porterfield, second J: B. Ables. Both motions carried. The -request of six local civic organizations to conduct a fund raising project for the Empty Stocking Fund covering six locations within the corporate limits of Smyrna was approved by unanimous vote on motion by Homer -Kuhl, second C. BA. 30060 422-soon c *I O R D I N A N C E BE IT ORDAINED by the Mayor and Council of the City of Smyrna, and it is hereby ordained by authority of same as follows: SECTION 1: (a) The Tax Department of the City of Smyrna shall, beginning on January 1, 1969, and during years subsequent thereto, be authorized to return for the computation of ad valorem taxes due the City, all property, real, personal or mixed, located within the City limits without -,the necessity of the property owner having to make an appearance at the Tax Department of the City of Smyrna to accomplish same. (b) This Ordinance shall have no applicability to automobiles, trucks, automobile, truck and boat trailers, motorcycles, scooters, etc., the taxes upon which are paid upon issuance of the operating license by the proper agency of Cobb County. 1 SECTION 2: Subsequent to the date hereinabove referred to upon which the Ordinance shall become effective, 'it shall not be necessary for a taxpayer to personally file a return for ad valorem taxes due on property, real, personal or mixed, unless the property which is to be returned for ad valorem taxes falls into one of,the following categories: (1)_,Property other than as described in Section 1 (b) above which has been sold or transferred to a new owner or owners; (2) New homes or buildings purchased or constructed at any date _prior to the return date; (3) All stock, fixtures, equipment or merchandise inventory owned by commercial establishments; (4) Boats, motors, airplanes, farm equipment, machinery and grading equipment. SECTION 4: All laws and parts of laws in conflict with this Ordinance are hereby repealed. SECTION 5: Be it further ordained, however, that all powers belong- ing to said City, as now incorporated, and all rules, ordinances and regulations of said City, not in conflict with this Ordinance, shall be and remain in full force and effect. -- (Continuation of December 2, 1968 Meeting) Under departmental reports Councilman J. B. Ables spoke on traffic violations mostly in excess of speed limits and sug- gested that the Council consider the purchase of fifty signs, 24" x 30", with the caption imprinted, SPEEDERS LOSE LICENSES. The cost of aluminum signs are $14.00 each and the posts are $4.85 each. In further discussion,J. B. Ables motioned for the purchase of the fifty signs and posts, the total cost $962.50. The motion was seconded by B. F. Stewart and voted.unanimous. MEMO: The above purchase upon receipt of invoice shall be paid from the State Grants Fund, Security National Bank. _ The Council agreed to hold off until the subsequent meeting the addition of or training of two police officers to be classified as City of Smyrna detective force. The Council approved the first renewal on the Land Use Permit for one mobile home located at 1141 Dell Avenue on the property of Howard Medley. W U U DECEM BER 16, 1968 The regular scheduled mid -month meeting of Mayor and Council was held at City Hall, Smyrna, Georgia, and called to order at 7:00 o'clock P. M. Mayor G. W. Kreeger presided. All Council Members present with the exception of Councilman J. B. Ables of Ward #2. Others present: Building Inspector, Public Works Superintendent, City Attorney and City Clerk. There were no citizens in attendance to bring problems before the Council and no zoning hearings or petitions were scheduled. In the first order of business, Building Inspector C. M. Hamby called out commercial permits.and on his recommendation the follow- ing action, is recorded : 1. One sign four by sixteen feet by Artistic Sign Company for Kim's Hair Fashions, Spring Street. Issuance of permit on motion by C. W. Armour, seconded by C. 0. Canada. Motion carried. .2. The second permit was approved for issuance for a mobile home office for Mr. Tax covering a period of four months and lo= cated on the north side of the Belmont Hills Shopping Center restaurant. Issuance of permit on motion by Homer Kuhl, seconded by B. F. Stewart,. Motion carried. MEMO: No water or sewer tap -on shall be .permitted. Mr. W. L. Reece attended the Council meeting to explain his company's procedure regarding collection of delinquent water bills and rec- ommended the City use his company's service, the Jewel Collection Agency of Marietta, Georgia. Councilman B. F. Stewart motioned that after completion and approval of the water committee's study that we authorize and turn over to the Jewel Collection Agency all delinquent water bills for collection at 50% of the gross amount due. Motion seconded,, by_ J. C. Porterfield and voted unanimous. In connection with the East Side Apratment Project, it was reported that the pump station installation would begin early in January 1969 and condemnation procedures on two parcels of land were in work by Attorney Berl T. Tate and Kyle Yancey.
