11-07-1966 Regular MeetingNOVEMBER 7;'1966 The regular scheduled meeting pursuant to the Charter was held and called to order at 7:30 o'clock P. M. November 7, 1966. Mayor G. W. Kreeger presided. All Council Members were present Including Department Heads, Building Inspector, Consultant Engineer and G. W. Kreeger, Jr. for City Attorney Berl T. Tate. No citizens appeared with problems to be brought before Council. In the first order of business a petition was presented in Council requesting issuance of permit to park one mobile home on the W. J. Cochran property, 528 Roswell Street. Mayor G. W. Kreeger appointed, a committee of C. W. Armour, Chairman, Homer Kuhl and R. H. Wood to check out petition, location and compliance with existing Ordinance with authority to approve for issuance of permit on a temporary basis pending the next scheduled meeting (11-21-66). The above action approved by unanimous vote on motion by J. B. Ables, second D. L. Mixon. The Council on recommendation of the building inspector C. M. Hamby, LM approved for issuance the following permits: !t )n Artistic Sign Company (1) 3' x 5' sign, 632 Cherokee Road for W Interstate Credit Corporation. Motion U by D. L. Mixon. U Trade City (1) 6' x 8' sign, advertising Triumph cars. Motion by J. C. Porterfield. The Council rejected on motion by Homer Kuhl, second by J. B. Ables, a permit for an accessory building for the purpose of housing cats per petition of Florene Cook on Wills Street. Denial of the permit which was voted unanimous hinged on existing zoning ordinance pertaining to Section 4. of the R-1 Medium Density Resi- dential Districts. In further discussion on the problem of signs in the City of Smyrna, Mayor Kreeger recommended the removal of all signs on City rights - of -way, mostly pertaining to political, property sales, and directional type signs. In further discussion, J. C. Porterfield motioned that publication in a newspaper of general circulation shall call out the removal of all above described signs from the City rights -of -way, said removal effective on date of publication through December 1, 1966. After this date, the City forces will be authorized to remove all such signs from City rights -of -way. transmission poles, trees, fences, etc, and transport to the City dumping grounds. Motion seconded by C. W. Armour and voted unanimous. The drainage problem on San Fernando Drive came before Council for final action. In the discussion as to the sharing of cost, citizens versus City of Smyrna, R. H. Wood moved that this Council adhere to the current policy, that is, the citizens purchase the materials for the correction of drainage problems with the City installing said materials. Motion seconded by D. L. Mixon and the vote was unanimous. MEMO: Mr. Shirley, spokesman for the citizens In the affected area, re Tcted the proposal. Mayor Kreeger read in Council a memo from Mr. Fred Pass, Cobb Center Manager, 436-4356, concerning a proposal'to set the date for a meeting of Mayor and Council with the Center's store managers for the purpose of resolving City services to be in effect January 1, 1967. City services cover garbage collection, police and fire protection, business or occupation licenses, ad valorem and non - property taxes. The mayor requested committee chairmen relative to the above, to be prepared to discuss these services on November 21, 1966 at which time a meeting with the Cobb Center Managers will be scheduled. 4 (Continuation of November 7, 1966 Meeting) On a motion by J. B. Ables which passed, the procedure governing purchases in excess of $500.00 was waived and a contract in the amount of $3,894.42 was approved and awarded to contractor J. A. Bailey for the completion of meeting rooms in the lower level of the new City Fire Station. Motion seconded by Homer Kuhl. MEMO: See copy of specifications for contract on file. Amount to be paid from the Contingency Fund upon completion. Ward Road improvements, widening, drainage, sidewalks, etc, were discussed as well as Powder Springs sidewalk extension, with request that bids be let and brought back to Council next meeting date. Councilman J.-C. Porterfield and R. H. Wood commented in Council on the results of a recent meeting with the Cobb County Parks and Recreation committee referring to the committeets recommendation to approve reimbursement to the City covering Brinkley Park lights, Jonquil Park lights, heating and air conditioning? unit, Church Street Park, in the amount of $15,714..00. The petition submitted in Council from Mr. Claude Pierce for the purpose of selling and repairing fire arms and accessories from his C reat Trail address was'referred to the Chairman -of the Police Committee for check out and report November 21, 1966. The City Hall reported the lease purchase agreement dated February 1962 on one Pitney -Bowes mailing'machine had been fulfilled with the final payment October 1966 and that said equipment could be purchased per signed agreement in the amount of $157.05. On the recommendation of the Mayor and on motion by Homer Kuhl the purchase of said equipment was authorized. Council set November 21, 1966 at 7:30 P. M. as,the date to hear the appeal from the Recorders Court per letter dated October 25, 1966 from William T. Dillard. A letter from the Peace Officers' Annuity and Benefit Fund's secretary referred to misunderstanding of the various courts in Georgia regarding fines and bond forfeiture remittances to above named fund. Referred to City Attorney Berl T. Tate for check out and report 11-21-66. There being no further business a motion was made to adjourn at 9:20 P. M. Next meeting November 21, 1966. NOVEMBER 21, 1966 A regular meeting of Mayor and Council was held at City Hall on November 21, 1966 and called to order at 7:30 P. M. Mayor G. W. Kreeger presided. 'All Council Members present including Department Heads, Inspectors'and City Attorney. In the first order of business a complaint was brought to Council from citizens of 598 and 602 McLinden Avenue claiming apartment contractors, Mr. Rice and R. G. Walker, agreed to build a retaining wall and fence at their rear yards. In discussion, the City Council took no action on the complaint on the basis that the plat and building permit did not call out any provisions for fencing the area. To resolve the issue, Mayor Kreeger requested Councilman J. B. Ables, Homer Kuhl and the Building Inspector to meet with the developers on 22nd of November, 1966.
