The regular meeting of the Mayor and Council of the City of Smyrna
was held September 9, 1968 at City Hall.' This meeting rescheduled
per.prior..minutes by reason of the September•2, 1968 Holiday. The
meeting was. called 'to order at _7:30 o'clock P. M.. by the .presiding
officer Mayor G. W. Kreeger. All Council Members were present.
Also present, City Attorney, City Clerk, City Tax Assessor,
Building Inspector, Consultant Engineers and the press.
Under the heading CITIZEN REPORTS Mr.-J. P. White.requtsted access'
to the City of Smyrna water department records. Request was denied
on the premise that water records are personal and individual
accounts of.our citizens. There was no vote though Mr. White
requested a vote of denial'and copy of the minutes submitted to:
him.
In connection with a commercial operation conducted from a resi-
dence on Sharon Circle (catering. business) Councilmen Homer,Kuhl
and C. 0. Canada reported that the owner of the business Mr. Lou
Schreibman was in the process of selling.
Building Permits: The following commercial building. and sign
permits were brought before Council and on the recommendation of
the building inspector C. M. Hamby permits were issued as follows:
1. ALevin Sign Company, plastic illuminated signs for Big Apple. -
Store -on East Spring Road. Permit issued on motion by C; W.
Armour, seconded by C. 0. Canada.
2. Levin .Sign Company, - one °set -of letters mounted on new store at
Rich's at Cobb County Center. Motion by J. B. Ables, seconded
by J. C. Porterfield.
3." New structure for Foto-Mat Corporation, a 4 foot by.9 foot
buildingto be located'on the southeast corner of South Cobb
Drive and Bank Street. I ssuance of the building permit was
withheld pending check out of specifications of the Wallace
Service Station land fill and water run off agreement.
4.. A building permit was issued on motion Homer Kuhl, seconded.
by-C. W.. Armour, to rebuild the American Oil Company Service
Station at Powder Springs and South Cobb Drive.
-5. C. W.,.Armour's.motion authorized issuance of a building permit
_ to. Mr. J. D. Page for a four unit apartment.building, Powder
Springs at Grady. Mr. Page agreed in Council to comply with
the plans and specifications submitted previously in Council.
Motion seconded by J. B. Ables and voted unanimous.
6. Motion J. B. Ables for issuance of building permit for Humble
Oil Service Station at'iritersection Cooper Lake.& Concord Rd.
Motion seconded by Homer Kuhl. Motion carried six to one.
B. F. Stewart voting against.
The following report refers to progress. East Side pump station,,
force main, and' roadway
1. Robert Sutton, Consultant Engineer, reported -that -NOTICE TO
PROCEED with the'staiion and force wain had been issued., The
completion'.date of this project -estimated at 12-18-68.
2. In connection- with the roadway easements from property owners
in, the cemetery area, it was reported they'were in work with
one exception. - Mr. .Bill Brooks of Bell Uri ve- refused to sell
or sigm--an-easement for the proposed road at the rear yard
area. The-mut-ion -of- J-.. B. Abler authorizes the City to enter
condemnation proceedings on the Bill -Brooks, . property for:"the
purpose of a 26 foot right-of-way on Woodlawn Terrace including
curb and gutter. The motion seconded by C. 0. Canada and
voted unanimously.
Mayor G. W. Kreeger, reporting on progress of New Spring Road,
stated (1) Mr. Emory Parrish of the State Highway Department will
approve a contract for lane marking of the new road, (2) lighting
of the road with 79 luminaries on 16 foot brackets and 51 new

poles was per engineering plat approved as submi.tted•Septembee
5; 1968.
Mayor G. W. Kreeger reported on the South Atlanta Street Project
which�6alls for three-laning of the road from -the Spring Street
light to a point 1000 feet south of.Love Street intersection.
Also the Mayor reported that -Cobb County would resurface Roswell
Road.from Mathews to Spring. A question arose -as to the need
.for sidewalks on, Roswell Road for the Hawthorne,Elementary School
children.
Councilman J. B. Ables motioned for the removal of a flashing
signal on Spring Road at Glenroy since it serves --no useful
purpose and.further motioned that this flashing signal shall be
reworked. -and installed at the intersection of Cherokee Road
and' Burbank Circle at the quoted price of $300 "from, the 'A & P
Signal�Company of Tucker, Georgia. -,Motion seconded by J. C..
Porterfield +and voted unanimous.- `
On July 5, 1968 a complaint in writing was received at City Hall
in reference to Mrs. J.;D. Crowe -of Cloudland Drive using her R-1
single_ family .residence for R=2 multiple family. purposes.' The
d� investigation that followed allowed.Mrs. Crowe to remove the
tenants granting thirty days or September 1, 1968 as a reasonable
W time for said tenants'to relocate. As of date of this meeting,
Usince no action'was taken by Mrs. Crowe, Councilman B. F. Stewart
`requested time to contact Mrs. Crowe regarding the above mentioned
violation. City Attorney Ber1'.T. Tate to follow up with letter
to Mrs. Crowe sighting the violation as per Section 18 of the
City of Smyrna zoning ordinance:
The'financial reports for the first' fiscal month of-1968 were
distributed and comments from the Mayor relating'to over expending
the budget, mostly in salaries and wages•in.garage,.sanitation,
parks and water.
It was requested that the library budget calling-out-the:salaried
personnel and. part-time personnel be consolidated in the August
report and thereafter.
The Council approved the minutes as subonitted-=covering the meetings
of August 5 and August 19, 19681, on motion J. B. Ables, seconded
by C W. Armour.
The Council agreed 'to- review the fiscal audit -of the City -of
Smyrna for 1967-68, Monday,- September 16, 1968, 7:30 P. M.
Councilman;J. C.'Porterfield'deferred'action on additional premium
claimed,by-the•Travelers Insurance. -Company pending-securance of
an ,audit report • from the insurance company, r
The appeal letter of Charles A. Blankenship from Recorder's,Court
decision was read in Council. Public hearing of the appeal was
set for October 7, 1968.
Mayor G W. Kreeger appointed X. C. Porterfield and C. O. Canada
to investigate and report on a-requested;.businessrlicense.for
Bob Brown's T. V. repair -office at.859 Cherokee Trail:
The Council voted unanimous,on'C. W.•Armour4s.,motion-that the
contract -,submitted by the First National- Bank,, for - tax -r payments
by Bankamericard shall not be negotiated or -approved by -the Mayor
and Council. -J.-B. Ables seconded the motion:
The' -Council !requested 6ids-.;for police'patrol cars-3-and'-4-and -set
the date•" -for opening -said., bids on October-7, 1968. This on -motion
J. B.'Ables; seconded.by Homer Kuhl. Motion carried.
Councilman J.. -B, ,Ables`agreed `to followfup-l.on the -,request for -
additional patrol service for the first traders at'Hawthorne School..

A settlement with.Hensley-Schmidt, Inc.*per.,their*contract for
water and sewer study of 1964 was.deferred to 9-23-68 fora
firm decision.
The q= ueation of police patrol of , new Spring Road including that
partiow�lying and -being in Cobb County was discussed in the area
of jurisdiction and referred to City Attorney for report 9=23-68.
Also discussed was the feasibility of annexing the 100 foot
right -of -,Way from Atlanta Street to the 4-Lane.
The Council deferred action on the clean up of the Bill Reed
property'by reason of proposed new structure.
Presented in Council by Mr. Harvey Nix was a contract for sale of
the City owned property on South Cobb Drive. The price per
contract was $85, 000. ' The � Mayor recommended ' thesale--of the prop-
erty as. is. A question arose- as to thelegality of ;a sale in the
absence of advertisement for bids. City•Attorney to check out
and report.
There being no' -further business, a motion was made to adjourn..

SPECIAL 'CALLED' MEETING
Special meeting September ll,..1968 called to odder at 7:00 o'clock
P. M.. All,Councilmen and,Mayor present.,. Motion made by Homer
Kuhl--and-seconded by C..W. Armour to designate meeting as a regular
meeting to 'consider sale of City owned property_ en South Cobb Dr.
Preliminary discussion regarding property to be sold as is with
reservation of sewer easement to City of Smyrna at location to
be designated by City Engineering'Department if -line is to,be
moved. Moving to be at option of buyers. Property to be sold
in its present condition with present incumbrances.
Motion by Councilman J. B. Ables to sell property to Tillman
Nowlin Realty Company. Sales contract to be drawn with City of
Smyrna to retain.existing.sewer easements,,and if to be°moved
at option of buyers, to be re -located at expense, of buyers -to a
mutually"agreeable location. Sales price to be eighty-five
thousand,and no/100.($851,000..00) and -proceeds to be used for
capital. improvements only for .the City of Smyrna. Motion seconded
by Councilman B. F. Stewart. Approved unanimously. Meeting
adjourned at 7:25 P. M.

The-amid-nonth-:Meating of Mayor and- Council was, held_ at. City Hall
September*23, 1968 and called to order at 7:30 o'clock. P. M. by
Mayor_ G.i.W.-Kreeger:. All. the_ Ward -.Councilmen were present except
Ward 3 J Councilman . R., H.: Wood. "Others in attendance, Berl T. Tate,
,�.zL..W.._Charles., .J.. E.. David, C. M. Hamby, V; M. Broyles, Consultant
Engineer'George S. Adams and members of the press.
In the -first -order of business, Dr. Donald F. Marshall requested
that the-1968 Ad Valorem tax on the -,church property, 1330 Love
Street, ' be" deleted by - reason of non use as rental property. The
Council _agreed and on motion by C. W.. Armour the 1968 tax ($53.60)
shall be refunded by a General Fund check.-Motiou.seconded by
Homer. Kuhl,_ and vote& Amanimous .
Mayor.G. W. Kreeger called out the plans to.correct the traffic
pattern at the intersection of Love and Atlanta Street. This by
virture of complaint of citizen R. D. McNelley regarding traffic
hazards at the intersection.
