was called to order at 7:30 otclock P. M. by presiding officer
Mayor G. W. Kreeger. All Council Members except Councilman J. B.
Ables were present, including Department Heads, Building Inspector,
and City Attorney.
In the first order of business, the advertised zoning petition
(Mrs. Della Gebauer) came up for hearing. The petitioner requested
rezoning of a parcel of land on the northwest corner of Grady and
Powder Springs Streets from R-1 Residential to R-2 Duplexes,
Restricted. No citizens were present in opposition to the proposed
zoning. The applicant Mrs. Gebauer requested two duplexes to be
built on the property, approximately 21,000 sq. ft. of land, which
is in violation of the comprehensive zoning requirements for duplexes
which calls out 13,000 sq. ft. per structure. On motion by D. L.
Mixon the property above described shall be zoned .from R-1 to R-2
Duplex, restricted (one unit). The motion seconded by R. H. Wood
and voted unanimous.
The advertised zoning hearing per applicant Bob Leonard Realty
Company came up for hearing. Applicant requested the property
located at the northwest intersection of Powder Springs and Birch
Streets be rezoned from R-1 Residential to C-1 Commercial for the
purpose of a convenience type grocery store. The applicant repre-
senting the petitioner (Fortner property) stated the zoning was for
a Seven -Eleven Store facing Powder Springs Street with buffer area
at the rear residential lot line. Six citizens in the area appeared
in opposition stating the usual objections. Motion by D. L. Mixon
that the proposed rezoning of the above described parcel be rejected
by reason of the opposition in attendance. Mr. R. H. Wood seconded
the motion. The vote was five to one in favor of the motion.
Councilman B. F. Stewart abstaining.
The building permit for the construction of the Security National
Bank located in Cobb County Center, Smyrna, Georgia, was issued on
recommendation of the building inspector on motion by D. L. Mixon,
second by J. C. Porterfield. Motion passed. Total cost $134.000.
The building permit per application of Glenn Ford on Glendale Circle
for an addition to the present structure was not granted on the
evidence presented that the addition would be constructed over an
existing utility easement.
Bids were received and opened per specifications submitted covering
two 1966 pick up trucks for sanitation and treatment plant usage.

Motion by J. C. Porterfield to reject all bids and resubmit speci-
fications.for two 1967 pick up trucks. Second by Homer Kuhl and
voted unanimous.
The petition of Miss Loraine Whitley requested the placing of a
mobile trailer in the back lot of 475 Glendale Place for the purpose
of furniture storage only. A petition was presented signed by eight
citizens adjoining the above property who claimed they had no
objection to the above request. Motion by D. L. Mixon to deny the
applicant's request, second by C. W. Armour. The vote to deny
carried, Councilman J. C. Porterfield voting against the motion.

Issuance of a business license for the sale of new and used
furniture at 150 Roswell Street was granted on motion by D. L.
Mixon, second C. W. Armour. The vote was unanimous. The issuance
of business license will not include furniture auction sales at
the above address.
The committees assigned for reporting on Atlanta Gas Light Ordinance
and apartment zoning amendment were deferred. Also deferred was
committee report on amendment to malt beverage ordinance.
On motion by D. L. Mixon, Mayor G. W. Kreeger was authorized to vote
in favor of deletion of the 96d malt beverage tax on 32 oz. contain-
ers and to go along with the decision of C. M.

Membership in
their meeting of August 23, 1966. The adjustment,
96d to 8V per
case, represents a .Old reduction in tax on 32
oz.
containers. The
motion carried. (Effective 9-1-66)
Pending receipt of deed to the Old Health Center,
Council on motion
by Homer Kuhl gave authority for tear down of
the
structure and
clean up of the premises. Motion seconded by
J. C.
Porterfield and
voted unanimous.

City Attorney Berl T. Tate reported on Spring
Road
right-of-way and

stated that condemnation cases were scheduled
for
hearing in
December 1966.
Mayor G. W. Kreeger discussed Agenda Item No. 18, Ward Street im-
provements. Council agreed on grading and widening the roadway
from the school area to Cherokee Road and installation of side-
walks (see 1965 County Bond Issue - Sidewalks). Curb and gutter
costs to be borne by the property owners.
Water rate and method td fill private swimming pools was assigned
to D. L. Mixon.
Councilman Homer Kuhl presented bids covering monthly police radio
service as follows:

Motion by D. L. Mixon to award contract to the low bidder, Georgia
two -Way at $35.00 per month. Second by B. F. Stewart. The call
for a vote on the motion resulted in a tie. Mayor G. W. Kreeger
voted against the motion and referred the matter to committee for
action and report on purchases of service parts.
Mayor Kreeger referred to the Police Department the placing and
or burning of trash and debris in the drainage area of Parkwood
and Powder Springs intersection.
There being no further business, a motion was made to adjourn at
9:30 P. M.
The next meeting per prior minutes was set for September 12, 1966.
