The'drainage problems on Birch Street and Creatwood'Trail
referred back to Councilman Kuhl for further checkout. i A request
was also made by Mrs. Johnson,'1690 Mohawk Place, to clean out th
creek.
Councilman Hubert Black reported another meeting on fiscal budgets
had been scheduled for Tuesday night, June 2; and further four
'proposed budgets stillbhad not been submitted.
Mayor Harold L. Smith read.a letter he had written to Atlanta
Postmaster Gearge Camp in regard to the Atlanta Post Office
'
encroaching on the territory normally served by the Smyrna Post
Office. A resolution was also submitted criticizing the Atlanta
Post Office for this' encroachment. Marston Tuck motioned for
the adoption of the Resolution by Council. The motion was
seconded by Homer Kuhl and approved unanimously. ;
Mr. - James B. Farley, Civil Defense Director, appeared before
Council with a request that Council sign a letter of intent
that the City of Smyrna would agree to participate in full
federally funded community shelter planning program. -Also, in

addition to the letter of intent being signed, a community shelter

planning advisory committee be appointed, consisting of the Civil
Defense Director and at least one member of Council. The above
request referred to chairman of Civil Defense 'Committee for

further study' and recommendations*.

Dan Mixon reported to' Counci-1 that in Cobb and Fulton Counties
citizens -who had been denied rezoning of property were,.required
to wait twelve months -before -the request coulb,. be .resubmitted,
as opposed to six months in Smyrna. He thought this to be in
the best interest of citizens. Mayor Harold L. Smith -stated a
".616hml ttee -zis now working' on a modular home ordinance and updating
the old zoning ordinance, ,and ,this,.wo.uld -be added.
Councilman Marston Tuck .re'ported 'the City -pools would open Friday
June 5, and cards are available for citizens at the pools.
Councilman Hubert Black reported the• "Welcome.to Smyrna" sign on
Spring Road had been completed. '

The mid -month meeting of Mayor and Council was held at City
Hall, June 15'.. '1970, and called to order by "presiding officer
Mayor Harold L. Smith'at 7:'30 o'clock P.M. All Council members
were present. Staff members present: L. W. Charles, D. Scott
Jackson, J. E. David, Leon Hood, G. W. Carreker, and represent-
ative from the Marietta .Journal, :Atlanta Journal and WBIE'.

In the first order of business,i the Council approved 'on unanimous
vote, the motion of Marston1;Tuck, ,-seconded by Hubert Black to
set zoning hearing on July 6,•1970, for the George Elliot property
'on Atlanta Road to change zoning from 'C-1 -to C, Commercial Cobb
`County, to C-2, Commercial City of Smyrna.
A'commercial building permit was submitte'd'by Building Inspector,-
Leon Hood, for an addition to the dinning room of the north side
of Gino''s, located at 21.61 South Cobb Drive. Upon his recommend-
ation,' a subject to -check out of proper number of parking spaces
the permit,was approved on motion of John Porterfield, seconded
by Marston Tuck. The vote was unanimous.
Consideration was given 'to the issuance of 'a Malt Beverage License
for the Tenneco -Retail Service Store, N6::8209, located at the
corner of South Cobb Drive and Jones Shaw Road. Motion of J. P. White,

seconded.1by Arthur Bacon to grant license was denied on a
five to two 'vote. For the motion: J. P. White and Arthur Bacon.

It` *as determined -that the 'most recent .applicant for the .Pizza
Inn, 2282 Old Concord Road, was only an assistant manager and
because of same could not comply with the City of Smyrna Malt 11,
Beverage License of Pizza Inn was approved by a 5 to 2 vote.
For'the-motion: John Porterfield, Homer Kuhl, Marston Tuck
Hubert -'Black and C. 0. "Canada. Arthur Bacon and J.- P. White
opposed.
Councilman-J. 'P. White read`a letter from -James- D..Ruffner,--as the
one. resident found to -'be*, located' within a 200 foot -radius of the
Pizza but on -South Cobb'Drive expressing his approval of beer
sales within 200' of his residence. Action was delayed on the
Malt Beverage ordinance -to -determine the- legality of a waiver
of the di stance ' requirement in the ordinance: City Attorney,
George Carreker, was asked to report back on the matter of.the
July 6th meeting. 1. '
Councilman Hubert Black presented recommendation from committee
of Janitorial bids that the low'bid (Minutes June 1, 1970) of
S & S Janitorial Service be accepted. John Porterfield lead
discussion as to possibilities of hiring a part time employee
.(4 hours ker day) thereby getting better setviee for less money.
Mayor Smith inturn, added John Porterfield -to -committee of
Hubert Black, Mar-ston Tuck, and J. P. White and asked for.-
reconsid-eration of the matter with recommendation of July 6, 1970.
Councilman Homer Kuhl reported that prior to the -regular Council
meeting on June 15th�an informal meeting of Mayor and -Council
various City of Smyrna,' Cobb' County and State Highway Departmentt
officials was held. Among those present were Cobb County
Commission chairman Earnest Barrett, Cobb County Engineer Bob
Sutton, and Asst'. Director of:State Highway Department, Emory
Parish, Councilman Kuhl was pleased to report that Emory Parish
had found engineering and survey notes on Atlanta Street and had
agreed to let Bob Sutton of Cobb County have the notes for use
on current Atlanta Street project. Councilman Kuhl stated
'further that Commission Chairman Earnest Barrett had agreed to let
county engineer Bob Sutton take notes and furnish necess-ayr
design work thus speeding up project greatly. Councilman Kuhl
said that property owners were being contacted daily with
favorable results:
J. E. David reported that dredging and drainage projects were
progressing satisfactor,ly,
Mayor Harold Smith asked council to refer to information supplied
them earlier in the week as to rates charge to apartment projects
for garbage collection. After a lengthly discussion the matter
was referred to C. 0. Canada for clarification of requirments as
to the type of .containers used under present sanitation ordinance.
Mayor Smith told council that the City of Smyrna had an -offer to
purchase the Brawner property located at 2807 Atlanta Road with
a lot size of approx. 26, x-50' for $8000.00. After some
discussion the motion was made by Marston Tuck and seconded by
-Hubert Black to purchase same, from funds on deposit in the 1965
Road'Improvement Bond Fund. The vote was unanimous. -
Mayor Smith related to,council his desire to move Sanitation
Headquarters and Garage for Sanitation trucks out to the treatment
plant, off North Cooperlake Road. The building, approximately
301 x 45' was estimated at $11,200.00 and will require one full
time mechanic. It was'agreed by all that this was a good move
and was referred to a committee for study on size and number of
doors 1n the building with a report due at the July 6th meeting.

On motion by Marston,Tuck., seconded by C. 0. Canada the minutes
of May 18th 1970 were approved with a 5 - 0 vote with Homer Kuhl
and John C. Porterfield abstaining by reason of absence on this
date.
Councilman J. P. White, after considerable discussion with otherr
members of the council on various sections of the City of Smyrna
Malt Beverage ordinance, made a request of City.Attorney, George
W. Carreker to investigate and render his opinion as to the legality
of requiring the manager of an establishment wishing to sell Malt
Beverage to be a resident of the coporate limits of,the,City of
Smyrna in order to obtain a Malt--Veverage License: k.
Councilman J. P. White read the following bids on floor covering
for 2 rooms in the basement of the police station known as officers
lounge and ready room:

Councilman Hubert Black reported that the Library now had '15,000
books and 755 records on inventory with a circulation of 3,000
f or the month of May, 1970i
Mayor Harold Smith stated that the owner of six lots on Smyrna
Powder Springs Street, between Hickory Lake and Overbrook apartments
had contacted the City in regards to Sanitary Sewer in the area.
It was estimated that it would cost approximately $6500.00. Mayor
H. L. Smith requested J. E. David to check the posibility of tieing
into the manhole at Leafmoore Drive thus lowering the cost considerably.
Question was raised by councilman C. 0. Canada as to status of
sewerage to Southern Bell Telephone Company located on Corn Road.
Mayor Smith directoed Jom David to have estimate of cost on Corn
Road project for July 6th meeting.
Councilman C. 0. Canada made a motion that Smyrna Boys Baseball
Association be allowed to block off Sanford Place at both`ends
during week of tournament play for both city and district
tournament. The vote was unanimous.
Councilman Marston Tuck reported that our Assistant Fire Chief is
on a 3 day Seminar attending Fire Prevention Bureau Training in
Macon, Georgia.
Councilman John Porterfield stated that a suppliment Drivers
Training Class would be scheduled on an 8 hour day basis and
requested all Department heads to submit a record of attendance by
cem'pJ:qyee-Ft, ogether with make up hours to complete the required
training.
On motion of Marston Tuck, seconded by John Porterfield, Councilman
approved by a unanimous vote, permit of Belmont hills school for
a Bicycle Safety Parade at 3:00 o'clock P.M., on Friday, June 19,
1970 with Police escort.
Councilman Clarence Canada reported that he had talked with
Commissioner Earnest Barrett and that Mr. Barrett had stated he
would be available to discuss with Council a plan wereby Cobb
County would pick-up animals in the City of Smyrna, all in
accordance with existing Dog Leach Ordinances. Q
