d. Requested Councilman C. 0. Canada to prepare report for submission
in regard to sanitary sewer line on Birch Street for inclusion in
the 1970-71 fiscal budget.
e. Approved on J. P. White's motion,'seconded by J. C. Porterfield
to'secure one book drop at the Smyrna Public Library. Councilman
Hubert Black was authorized to negotiate with the Smyrna Post Office
to secure one U. S. Mail box to be repainted and installed at the
entrance door of the library. Other comments regarding the Smyrna
library.iridicated that new shelving had been installed, that 2900 books
were checked out during the month of March and further that 14,000 volumes
are now available at the city library.
f. Read a letter from the Civil Service Board Chairman recommending to
the Mayor and Council the selection of Sgt. John Young, Jr. to fill the
position of Lieutenant of the Uniform Division, effective 4-16-70,
with a salary increase of $75.00 per month effective 4-16-70. The
above approved on motion of J. P. White, seconded by Homer Kuhl, and
the motion was voted unanimous.
g. Schedule of bonds` that are to be posted in regard to city traffic
violations waa submitted for review. In discussion Councilman J. P.
White motioned the new bond schedule be and is hereby approved and
1-0 effective April 7, 1970. The motion was seconded by Marston Tuck and
voted unanimous.

h. Plumbing Inspector W. L. Westbrook submitted for approval the
V installation of a fiberglass one piece tub and shower -combination. The

Councilmon C. 0. Canada's motion authorized the recommendation to become
part of the city plumbing code. The motion seconded by J. C. Porters
field and voted unanimous.
i. Mayor H. L. Smith called out additional furniture, fixtures, railing
and glass doors for the new cnurt room and police station in the esti-
mated amount of $1800 more or less. Councilman J. P. White motioned
this Council waiver the city purchasing procedure and set up a special
appropriation for the furniture and fixtures called out. The motion
was seconded by Marston Tuck. Voting for the waiver, J. P. White
and Marston Tuck. Voting against the motion to waiver, Hubert Black,
Arthur Bacon, C. 0. Canada, J. C. Porterfield and Homer Kuhl.
Leon Hood, Building Inspector,.requested Mayor and Council to ammend
the requirements for issuance of commercial and multiple family building
permits to include approval of plans by the Fire Department as well as
a final inspection and okay of the Fire Department and all other
inspection departments. Homer Kuhl stated that the building inspector
already had the authority to get approval and assistance from the
other inspection departments mentioned and that action was not necessary.
There being no further business, the Mayor requested a motion to adjourn.

The mid -month meeting of Mayor and Council was field at City Hall, April
20, 1970, and called to order by presiding officer Mayor Harold L.
Smith at 7:30 o'clock P. M. All Council Members were present except
Councilman Homer Kuhl of Ward No. 4. City Clerk L. W. Charles was
absent due to sickness. Others present: D. Scott Jackson, G. W.
Carreker, J. E. David, C. C. Porterfield, V. M. Broyles, Elmer Wester,
Leon Hood, Truett Grogan, Cliff Drennon, W. L. Westbrook, N. Proctor,
Joe Bork of Hensley -Schmidt, Inc., and a representative of the Marietta
Journal and WBIE.
Invocation was given by the Pastor of the Smyrna Christian Church, Mr.
Ernest S. Blackman..
Boy Scout Troup 524 appeared in Council and was presented an award by
Mayor Harold L. Smith, for having the most imaginative float in the
Jonquil Parade on Saturday, April 18.
Chief C. C. Porterfield, Asst., Chief Don Atkinson, and Fireman Tommy
Harper of the Smyrna Fire Department, were presented an award for
having the most beautiful float in the Jonquil Parade.
Don Rakestraw, winner of the Optimist Oratorical Contest, also appeared
before Council and delivered the speech which gave him the honor of

winning first place in the contest. 'It was enjoyed by all whd were
present.
Under Citizen Reports, Mr. Pete Mangum requested Council approval for
the purchase of an ad in the Cobb County Directory and Guide.' The
book prepared and edited by Mr. Mangum included the seven municipali-
ties in Cobb and will sell for $2.00 per copy, with publication date
set for October 1, 1970. Cost of the ads: $175for full page,
$100.00 for one-half page and $55 for one-fourth page. This item
referred to full Council for further consideration by Mayor Harold
L. 'Smith for report next meeting.
Bill Sanders again requested Council waiver of set back (fifty feet
to forty-two feet) on King Street, for a proposed chapel. Motion
by Arthur Bacon to give Mr. Sanders a definite answer the next
meeting night died for lack of a second. It was the general opinion
that no definite answer could be given until requirements for right -
of way had been secured from the State Highway Department.
The petition as advertised to rezone the H. S. Ray property on Concord
Road from District 'C' to c-1 was withdrawn prior to the Council
meeting per request of Mr. Ray.
A residential permit for Paul's Print Shop, 1071 Bank Street came
up for hearing. Attached to permit was a list 'of signatures of all
residents within the required 300 foot radius stating they had no
objections. Councilman Arthur Bacon motioned the permit be approved
with the stipulations there will be no on street parking, no employees
and no signs. The motion was seconded by Hubert' Black and approved u
unanimously
Underground garbage containers was the next item to be discussed.
Arthur Bacon and Vic Broyles reported that of the'forty questionnairs
mailed out, 37 were returned and only one person stated he did not
like the underground system. 'Sealed bids on cost of installation
of the new containers were opened and read in Council:

On motion by J. C. Porterfield, seconded by Marston Tuck, and voted
unanimously, all bids were rejected.
It was further reported that the cost for containers and installa-
tion of the new system would be between $86,000 and $88,000. It
was suggested that each resident pay $3.50 per can, this amount
to be included on the water bill. Cost to the resident -for a
second can would be approximately $19.50, this amount to be paid
in advance of installation. Four or five citizens objected to the
underground system with statements one can would not be sufficient,
therefore, the individual would have to pay for an additional, did
not want to take garbage to the street, the containers would detract
from lawns, etc. After further discussion, Mayor Harold L. Smith
referred the item to the finance and sanitation committees with
the recommendation that definite figures be submitted at the next
meeting showing total proposed budget with new system included and
total proposed budget without the new system.
Commercial building 'permits were submitted by building inspector
Leon' Hood as follows
1. Burdett & Company, enclose remaining portion of vacant buiidings
next north of Miracle Theatre, So. Cobb Drive. Approved unanimously
on motion by C. 0. Canada, seconded by Arthur Bacon.
2. Artistic Neon Sign Company, one 112' x 33�1' Neon Sign to be erected
at Smyrna Taxie Company, 2714 Atlanta Street. Approved on motion
by Marston Tuck, seconded by J. P. White. The vote was unanimous'.
3. Young Electric Sign Company, one 819" x 16' double face lighted
sign, at Smyrna Church of Christ, 770 Church Street at So. Cobb Dr.
Motion to approve by Marston Tuck, seconded by J. P. White, the vote
was unanimous.
4. Hudgins & Company, Inc:, Demolition Specialists, Belmont Hills
Shopping Center did not have permit or business license. Mr. Hood
recommended that fee for wrecking companies for commercial structures
be $100.00 per year. On motion by Hubert Black the Business License.

fee of $100 for wrecking companies was approved. The motion was seconded
by Marston Tuck, and voted unanimously.
Mayor Harold L. Smith brought to the attention of Council two new
chairs delivered from Office Sales and Service, stating the same type
chair listed"in'Black Mfg., catalog, #107 SA and #106 SC, could be
purchased from several companies. One of the swivel type chairs had
enclosed arm, the other had open arm. The enclosed arm was preferred
by Mayor and Council and Canyon Tan 6493 was the desired color. On
recommendation of Mayor Smith, and on motion by Hubert Black seconded
by Marston Tuck, authorization was granted to secure sealed bids for
ten new chairs as listed above, or the equivalent. Sealed bids to be
opened May 4, 1970. Vote on the motion was unanimous."
Securance of bids on parts and tires for the garage was deferred due
to the fact all necessary information was not available.
It was brought out by Mayor Smith that no --bids had been secured on
uniforms for Police and Fire Departments since May 6, 1968. After
*discussion, this matter teferred to Police and Fire committees to
work out specifications for leting of*bids to be effective July 1, 1970.
Councilman J. P. White stated he had bids for additional fixtures and
LM furniture for the Police Station; however, they were not sealed bids.
�., Mr. White was asked to give a report of the bids anyway.

The low"bid of'Michael's Glass Distributing Co., Inca, was accepted
on motion by J. C. Porterfield, seconded by C. 0. Canada, Voted

"Two bids were'quoted covering costs of one console cabinet, desk, 15
foot railing in matching paneling with swinging doors, installed, and
addition to judge's bench for court 'room in new police station as
follows: ` "

Councilman Marston Tuck motioned we waive the bid"procedure and approve
bid of H & S. Woodcraft for furniture and completion of work in court
room in the amount of $1185, and further this work be inspected by J. A.
Bailey.' Motion seconded by'J. C. Porterfield and voted unanimous.

Mayor Harold L. Smith referred to letter of April 9, 1970 to City Clerk
regarding purchasing procedure; the letter to be made an official part
of minutes of this meeting as required by Charter.
In reference to bid by C.. J. Thomas Construction Company to ave addi-
tional area for parking at police station, in the amount of 550, it was
the general.agreement of Mayor and Council to drop this.item from
agenda since"only about three.parking spaces would be gained.

Hensley -Schmidt, Inc. in the ne-ighborhood of $5,000 was rejected by reAson the
report was much in excess of what the city had asked for and much in excess
of what is required by the State Water -Control Board. The motion to reject
the report was seconded by Marston Tuck. The vote was unanimous.
Councilman Marston Tuck stated he had no -report on modular home ordinance at
this time. After discussion on feasibility of raising square footage of R-1
and R-2 classification, as well as increasing footage on modular homes, the
matter was referred back to committee for report May 4, 1970.
Mayor Harold L. Smith reported he hoped we would soon have requirements for
rights- of -way -on Atlanta Street Widening. A letter from Hensley -Schmidt was
read in Council. The estimated cost for engineering services were listed as:
Atlanta Street, between Spring Street and Love Street, survey and plats`
$3,500; Atlanta Street, between Spring Street and Powder Springs Street,
$3,000. The report from Hensley -Schmidt deferred to 5-4-70 meeting.
Councilman C. 0. Canada rec ommeded dredging of area beyond Brookview Apartments.
Referred to J. E. David for action.
Councilman Marston Tuck reported that the Parks Committee had met, along with
Jim David, and studied bids on two trucks for the Parks Department. Mr. Tuck
made the following recommendation in the form of a motion: That bid (per
specifications) from Trade City Motor Company of $2468.55, with trade in, on
(1) One ton truck be accepted with immediate delivery; and further, that bid
(per specifications) from John Smith Chevrolet of $1631.65 with trade in, on
(1) one-half ton pick up truck be accepted with delivery after June 1, 1970,
thus accepting the low bid in each case. Motion seconded by J. C. Porterfield
and voted unanimously. Bid on the rescue unit for Fire Department was deferred
to May 4, 1970 meeting.
On motion by Councilman J. C. Porterfield, water rates for customers outside the
city were increased from $3.00 minimum to $3.50 minimum, effective May 1, 1970.
Increase for inside city residents was deferred until budgets are completed. On
second by Hubert Black, the vote was unanimous.
Mr. Porterfield stated he had not had a majority at any meeting on employee
retirement plan; therefore, a meeting was called for Saturday, 10:30 A.M.
Driver improvement classes were called out as follows: Police department only
--two separate nights, April 27 and 29, 6:00 P.M. to 10:00'P.M. Fire department
and all others: four Tuesday nights, April 21, April 28, May 5, May 12, 7:30 P.M.
to 9:30 P.M. On motion by J. C. Porterfiled, authorization was given to pay
all employees, excluding department heads, one day's pay for participating in
the driver improvement classes. Motion seconded by J. P. White. The Vote
was unanimous.
It was reported by J. C. Porterfield that although he had not received the
experience modification rating from the Southeastern Workmen's Compensation
Rating Bureau -as requested sometime ago, the Argonaut Insurance Company had learned
that the rating for the City of Smyrna is now .83 instead of 1.65. Mr. Porter-
field stated he had asked the c anpany to'increase salaries 20% on police and
fire personnel, and 10% on all other employees, over present rate. This included
in $8,404.00 premium.
Report on Pat Mell annexation was deferred to future meeting. George W. Carreker
submitted model copy of new annexation form to be used for future annexations.
Councilman Hubert Black stated that investment of idle funds program approved by
Council had been completed. Total investment since last meeting $470,000, deposited
last month $100,000, 8,000 in.Savings Account, and already invested in U. S.
Treasury Bonds,,$310,000, making a total of $888,000 investment in idle funds.
It was reported by Marston Tuck that the Fire Department had burned the old
building (Davenport House) on Medlin Street with permission from owner.
On motion by J. P. White, seconded by Arthur Bacon., -malt beverage application
was approved for Haze E. Bryan, Pizza Inn, 2282 Old Concord Road. Voting for
the motion, J. C. Porterfield, Arthur Bacon, C. 0. Canada and J. P. White.

J. E. David requested Council approval of bid from W. P. Lord, Inc..in the
amount of $925.00,to correct drainage problem on Alexander Street. J. P. White
moved the bid be accepted. The motion seconded by Marston Tuck with notation
the cost be paid from State Grants fund. The vote was unanimous.
Councilman J. C. Porterfield reported there would be no Safety Committee meeting
April 29, 1970 in view of safety driving classes.
Letter from James B. Farley, director of Civil Defense, :.regarding liability coverage
for Civil Defense volunteers was referred to City Attorney G. W. Carreker.
Mayor Harold L. Smith stated he would have Mr. J. A. Bai ley investigate plumbing
leaks in Civil Defense area of new police station and have same corrected.
Councilman J. P. White keported he would like a committee of three to study feasibility
of foot or bicycle path between Campbell School and Pi;netree. Parks Department
working on similar routes reported Councilman Marston Tuck.
J. P. White reported a great need for a traffic control light at the intersection
of Creatwood Trail and Atlanta Street and was reminded of state regulations prohibiting
a light at this intersection due to lack of having at least 7% of total volume of
traffic coming out of side street.

LO Mr. Earnest Thompson, Cobb County Health Department.

U Councilman J. P. White reported a problem with the creek at the residence of T. R. Amico
U 3422 Creatwood Trail, and Mr. Bagwell, 3418 Creatwood Trail. Mr. White stated that
yards were eroding and it was a definite health hazard.

Marston Tuck reported he had received many phone calls and many thanks in person for
the fire department making the truck available for taking Children for a ride at Open
house April 18, 1970.
Marston Tuck proposed that a request be made to the Georgia State Patrol for units to
patrol high speed areas, especially Spring Road. The matter was referred to the"
police committee for investigation.
Councilman Clarence Canada reported problems with dog packs in various areas of the
city. City Attorney to suudy new county leach law and report back 5-4-70 meeting.
Janitorial service for Police Station was referred to administrative committee and
police committee for study.
Councilman C. 0. Canada reported that buildings of a nature as the one located at
2807 Atlanta Street be inspected before occupancy. This item referred to building
inspector and fire department for check out.
On the recommendation of Mayor Harold L. Smith, and on Motion by Marston Tuck, authorization
was granted for the purchase of a tape recorder for use in Co uncil meetings and the
tapes to become a permanent record. Motion seconded by J. C. Porterfield. The vote
was unanimous.
On motion by J. P. White the meeting was adjourned at 11:07 P. M. Next meeting May 4,
1970.
