02-15-1971 Regular Meeting(Continuation of FEBRUARY 1, 1971) as $300. Councilman J. C. Porterfield motioned that Council approve $300 expenditure to the Georgia Municipal Associatlon'for the purpose of obtaining a retirement„ plan and cost figures for study. The motion.was seconded by J. P. White.- Vote,,on,the,motion was unanimous. Councilman,Hubert Black motioned that Coucil proceed with the -plan to have City ordinances codified at a cost''' ofI�,840 subject to the fi: nance committee "receiving assurance we receive proper information on special ordinances. The motion was secondedb y*Councilman Marston Tuck. The vote was five to one. Councilman J.,P., White opposed. Councilman J. C. Porterfield brought to the attention of Mayor and Coun- cil the unsightly condition oftthe refuse receptacles around the Cit; placed at various points by Dixie Enterprises on a five year contrac- basis. Councilman Porterfield motioned tliat 'Dix.ie Enterprises be advised of the unsightly condition and poor maintenance of the o containers and given thirty days to correct the situation. Councilman J. d. Porterfield stated one new truck was set up in the water department budget, Nhd requested,opening of bids on February 15, 1971 meeting. Councilman J. P.' Councilman Homer Kuhl requested in the form of a motion that a report on the police de.par.tment be submitted at the next Council meeting. The meeting was called to order 'by presiding officer Mayor Harold Smith and all Councilmen were present, Also present were City Attorney G. W. Carreker, D. Scott Jackson, J.E. David, Leon Hood, N. Proctor, C. C. Porterfield Don Atkinson and a representative of the Mareitta Journal and WBIE. City Clerk L. W. Charles was out of town attending the annual Clerks and Finance Officer`s meeting in Athens. Invocation was by Dr. Boyd Israel and Mayor Harold L. Smith led the Pledge to the Flag. Under Citizen Reports,.Councilman J. C. Porterfield submitted for Bill Stewart ,�copy of a petition from the Cobb County Commissioners of Roads and Revenues concerning the rezoning of'the triangle property (Concord and North Cooper Lake Road). The`C�-1 zoning was approved with the stipulation that the C-1 development would not be permitted until such time that fifteen.single dwellings .had''been completed on the adjacent property and subject to the proposedshoppingcenter per plans submitted at the December.1963 meeting.' J Amdndment to the Comprehensive Zoning Ordinance to include a classi- fication for a skating rink was next on the Agenda. It was brought out that skating rinks.in the cotnty were placed in classification comparable to the C-2 zoning of the City. Charles "Pete" Wood spoke in opposition to skating rinks being placed 1n a C-1 district. The motion was seconded by Hubert Black and voted unanimously.. ,Mr. Jim Farley, Civil -Defense Director, appeared before Council I with a request that�a new Civil Defense Ordinance --be approved to up -date the City Ordinance and -bring tit in line with State require- ments. The ordinanceiwould replace the ordinance adopted in 1956. Councilman J. P. White motioned that the ordinance be adopted subject to check out by the City Attorney. The motion was seconded by J. C. Porterfield and approved unanimously. �. A petition was submitted .in Council by Mrs, Peggy Watson for a residential permit for a beauty shop at 1203.Medlin Street. The • petition was signed by all residents within a 300 foot radius. Mrs. Watson statbd she understood the stipulations,of no employees, no on -street parking, and no s i'gns . The permit was ,approved unani- mously on motion by Councilman Homer Kuhl, seconded. -by Councilman J. t. White. Commercial building permits were submitted by building -inspector Leon Hood and upon his recommendations the'f.ollowing adtion is recorded: 1. Request by Security National Bank to build a branch bank at 3393 South Cobb Drive. The permit was approved on motion by Councilman Homer Kuhl, seconded by Councilman J. C. Porterfield. Vote on the motion was unanimous. 2. Request by R & B Associates for ,building.permilt-for.Sussex Lake Club Apartmentg, 416 units with townhouses (Burson property LL8878, Lots 5, 6, and 7) located on Herodian Way at the 4-Lane Highway.- Mayor Harold L. Smith rema'r:ked on the- possibility the City might not be able to tie in to the temporary Sewerage treat- ment plant proposed by the county but stated a'_solution would be workedoaut for sewerage for the apartments.. Mr. Burson stated they would like to start work --on the 3T million do.11ar..development immediatdly• The permit was approved on motion by Councilman J. P. White, seconded by Arthur T. Bacon. Vote on the motion was unanimous. Mr. Dave Miller, represented.a groupvof doctors who requested a building permit for a professional building adjacent to Brawners Hospital, The question of the. zoning classification, on- the pro- 364 (Continuation of FEBRUARY 15, 1971Y perty, and whether the ownership was the same as for Brawners, had been brought up at the last meeting. Dr..Gould stated they were prepared to sign the contract on the February 16, 1971 and if the property had to be advertised again, it would beybeyond the date to sign the contract., City Attorney G. W. Carreke'r was of the opinion the building permit could be approved with present zoning. On motion by Councilman J. P. White, seconded•by Councilman C. 0. Canada, the permit was approved by unanimous vote. Mr. DeWeese appeared in Council again regarding the,241, strip of land on Hill Street, (formerly designated as McGriff Street but never used as a street).,) City Attorney G. W. Carreker was asked to check ontthis and report back at next meeting.. Councilman Homer Kuhl stated he had talked with,Bob Sutton and Mr. Sutton stated they had 'completed the survey on 'At•la.nta, Street Widen- ing, were now working on the drawings, and would try to get the infor- mation to us within the next few days. �. J Reporting on ;Concord. and Love Street progress, .Mr. Kuhl/stated that stakes had been placed from Dunton Street to Medlin Street and he would start tomorrow trying to close out acquisitions on,these pieces of property. Coundilman Homer Kuhl stated a letter had been.received from the State Highway Department dated February 3, 1971, listing improvements to be made in various parts of the county. One of the jobs concerning the City, is the widening of Campbell Road and State Route,3 at.their intersection. The City will cooperate with the State Highway Department on this project. Mayor Harold L. Smith stated he would meet with the Street Committee within the next few*days to work out priorities -on various street projedts. j Mayor Harold L. Smith reported on the meeting, -'with the State Water Quality Control-, Board last Tuesday regarding the, program submitted to them by the City of.Smyrna. Mayor Smith stated -after the formal meeting adjourned the engineers talked with them and they, tentatively approved the proposal. It was also the impression that the State would not close the Church Street treatment plant as long as it is pumping sewerage although. the City might have to take over.., Nothing -has been received in writing from that meeting., Mayor Harold L. Smith reported that Councilman Homer Kuhl and Councilman J. C. Porterfield attended, the Cobb Municipal Association Meeting with him on February 9,,1971. The Animal Control Ordinance was discussed, business licenses, taxes, etc. but no official action was taken. Councilman J. C. Porterfield stated he had furnished the Joint Municipal Retirement system with City of Smyrna employee census and hoped to have a proposal back within,the next two or three weeks., The Minutes of Mayor and Council for January 4, 1971 and January 16, 1971 were=:approved as submitted on motion by J. C. Porterfield, seconded bu Homer Kuhl. The votenwas unanimous. Revisions for Unit A. Deerwood Subdivision, were approved as 'submitted on motion by J. C. Porterfield. The motion was seconded by Arthur T. Bacon, and voted unanimously. . Councilman C. 0. Canada reported,that work on-the'Birch_Street sewerage project would start Monday, February 22, 1971. .{J City Attorney G. W. ,Carreker read Section 34A-601 and 602, of the Georgia Municipal Election Code and further noted that any changes made must be, reported in detail to -the Jis,tice Department.' Reapportionment of City wards was also discussed: I I Mayor Harold L. Smith stated that a citizens committee for Joint City- Coubty Voter Registration had'been appointed. The committee is chair- maned by Ed Riley and others working with Mr., Riley are: Charles "Pete" Wood}, of the Cobb -County Hospital Authoity, Mrs.,Frances Carson and Mrs. Milton Bennett, of the Cobb -Marietta League of Women Voters, and Mr. Forster Puffee of the Smyrna Jaycees. Mayor Smith requested C. 0. Canada to work with the committee to represent Council. Councilman J. P. White stated he would like to name a person to serve on the committee. Mayor Harold L. Smith transferred the Chairmanship of the Civil Defense Department to Councilman Marston Tuck, effectively immedeately. Meeting adjourned 10:27 P.M.
