JANUARY 6, 1969
The regular meeting of Mayor and Council pursuant to the Charter
was held at City Hall, January 6, 1969, and called to order at
7:00 P. M..by presiding officer Mayor G. W. Kreeger. All Council
Members present, also, City Attorney, Berl T. Tate, Public Works
Superintendent J. E. David, Plumbing Inspector W. L. Westbrook,
Building Inspector C.•M.'Hamby, Tax Assessor D. Scott Jackson;and
representative of Marietta Journal. City Clerk L. W. Charles absent
due to illness.
No citizens were present to speak before the Council.
In the first order of business, Berl T. Tate, City Attorney, reported
that all necessary papers had been received and that the 1969 House
Bill was nearing completion. Mr. Tate requested that Mayor and
Council consider annexing into the corporate limits the present
right-of-way of Woodlawn Terrace, formerly Loudermilk Drive, into
the corporate limits of the City of Smyrna, to be included -in -the
1969 House Bill. Reason given was legal difficulties in condemning
property not in the corporate limits of Smyrna. After discussion
of the matter, a motion was made by John. Porterfield, seconded by
C. W. Armour, to include the right-of-way of Woodlawn Terrace in
the 1969 House Bill. The motion passed with unanimous vote. -Mayor
and Council directed Scott Jackson to work with Berl Tate in -
acquiring necessary -plats and paper work for annexation of above.
B. F. Stewart, Chairman of the Water Committee, stated that Mrs.
Melvin was presently compiling a list of all uncollectable.garbage
and water bills. This list to be approved.by the Water Committee
and upon approval to be forwarded to the collection agency -for
collection.
The following commercial permits were submitted in Council and on
the recommendation of -the Building Inspector, G. M. Hamby, were
approved for issuance on unanimous vote except as noted:
1. T. V. antenna at the Chateau Deville Apartments near Spring
Road. Approved upon receipt of written notice -from Federal Aviation
Agency okaying construction of antenna to Building Inspection
Department. Motion by Homer Kuhl, second by B. F. Stewart.
2. The permit for ---the Shrimp Boat Restaurant building on South Cobb
Drive. Motion by B. F. Stewart, second by C. 0. Canada.
3. Pole type sign for Shrimp Boat Restaurant located on South Cobb
Drive. Motion by B. F. Stewart, second C. 0. Canada.
4. Fifty (50) by seventy-five (75) metal warehouse located on the
rear corner of Cobb Center parking lot. Motion by Homer Kuhl, second
by B. F. Stewart.
5. A ten (10) by thirty-two (32) addition to the Davis Food Service
Rounder Restaurant on South Cobb Drive. Mayor and Council directed
Building Inspector, C. M. Hanby to withhold issuance of permit until
necessary building specifications and plans, including plot plant,
were submitted.
6. Location of -house trailer near main sign in Zayre parking lot
on South Cobb Drive for Mr. Tax -for a period of four (4) months in
1969. Motion by B. F. Stewart, second C. 0. Canada.
7. Large sign incorporating clock located at corner of Church and ,
Atlanta Streets. Motion by J. C. Porterfield, second C. W. Armour.
8. Permission to insert the word "BEER" on already approved sign
for Bavarian Alpine Inn. located on South Cobb Drive. Motion by
John Porterfield, second by C. 0. Canada. Voting against motion were
Roy Wood, Homer Kuhl and J. B. Ables. Voting for the motion, C. W.
Armour, C. 0. Canada, J. C. Porterfield, and B. g.'Stewart. Motion
carried.

9. Sign on front of Standard Oil Station located at corner of
Cherokee Road and South_Cobb Drive advertising "Davis Sporting
Goods." Councilman Homer Kuhl directed Building Inspector, C.
M. Hamby to*hold approval of permit until License Committee
could check to see if necessary business license'were in -order.
Motion by Homer Kuhl, second by C. W. Armour.
10. To erect five.(5) by sixteen (16) foot sign on front of
office building located at 700 Old Concord Road. Motion by B.
F. Stewart, second by John Porterfield.

Contracts were received from Baldwin and..Cheshire, Architects
and were given -to Berl Tate, City Attorney, for study and recom-
mendation.
Mayor and Council directed Berl Tate, City Attorney, to arrange
for a meeting with Cobb Representatives to the Georgia General
Assembly. At which time, annexations to be included in 1969
House Bill and deletion of fire district tax due Cobb county_
per House Bill No. 706 of 1966 would be discussed.
Upon receiving no report on Atlanta Road widening project,
Mayor Kreeger expressed strong desire to speed up work on the
project by committee appointed. -
City Attorney, Berl Tate, reported that necessary paper work
and plats had been acquired and Spring Road annexation of
right-of-way was included in 1969 House Bill, presently being
compiled.
Mr. Tate further reported having some trouble with condemnation
.proceedings. on Eastside project due to property being condemned
being located outside corporate limits of the City of Smyrna.
The subject of bucket -brigades was introduced by Councilman Homer
Kuhl and fully discussed by Mayor and Council. No action was taken.
There being no further business, the meeting was adjourned at 8:14
P.' M. on motion by J. C. Porterfield and seconded by C. 0. Canada.
MEMO: Mid -month meeting regularly scheduled by Mayor and Council
for January'20, 1969 was re -scheduled to February by reason of 1969
Annual Mayor's Day activities'in Atlanta, Georgia.
