DECEMBER 7, 1964
The regular meeting, pursuant to Charter, was held at City Hall, Smyrna,
Georgia above date and called to order at 7:30 p.m. by presiding officer,
Mayor George W. Kreeger. All members of council were present.
-Mr. Charles Sharpe of Kennesaw.Way spoke in council protesting the action
which denied rezoning of his property from R-1 to C-1. MEMO: Denial was hinged
on block zoning and failure to call out purpose and land usage per prior minutes.
Mr. Uselton, spokesman for Estelle Court annexation, stated he would secure
petition from affected home owners and requested information on benefits, cost
and approximate date of sewer installation.
Request for permit (Dr. R. D. Weber) to erect one electric sign at structure,
444 Cherokee Road, was denied on basis of codes covering installation' of signs
in residential areas. Motion J. C. Porterfield, second H. Kuhl. The vote for
denial was five to two. J. B. Ables and R. J. McCurry voting against the motion.
Application for building permit, Huskey Cleaners, for block wall addition
to building on Concord Road was withheld pending receipt of plans and speci-
fications. Motion, H. Kuhl, seconded by J. C. Porterfield, unanimous.
Permits were authorized for builder Jack D. Smith for four lots on Trailwood
provided lots will be shaped and drained, creek cleared of all debris and that lots
will be sodded. City engineer and building inspector to check out prior to final
inspection. All this to be stipulated in signed letter from J. D. Smith to
council and prior to issuance of the first permit. Council approved these
provisions on motion J. C. Porterfield, second, Homer Kuhl.
Council voted to set hearing date to December 28, 1964, on disposition
of Recorder's Court, case of John Frank Moore.
Council voted six to one requesting City Clerk to demand immediate reim-
bursement from King -Williams Land Company for 52 sewer taps, $2900.00 covering
Unit No. 1 apartment project on Ward Street. Motion R. J. McCurry, seconded
by Homer Kuhl. J. B. Ables against the motion.
Bids opened for Treatment Plant chlorinator as follows:
Wallace & Tiernan Inc., of New Jersey
Murphey Equipment Co., Decatur, Ga.
$1090.00
$1215.00
Both bids in compliance with specifications submitted, C. M. Chapman
motioned to accept low bid of Wallace and Tiernan Inc. in the amount of"$1,090.00.
Motion seconded by J. C. Porterfield and carried. MEMO: See Purchase Order
No. 1294.
On recommendation of committee and H. Kuhl's motion, Council approved the
specifications of Banner Uniform Company and accepted their bid covering police
uniforms. I o
Mayor, Council and City Attorney discussed tine function of new civil and
criminal court, the 1965 House Bill, heard a report calling out' an increase
in cast iron water pipe and a stop payment order covering check to City for
1964 taxes from Georgia Land Company. Council deferred committee report on
City Attorney appointment.
Sewer installations, Cooper Lake, Reed Road and Roswell Street depleted
the Extension and Construction fund. Account as of this date in overdraft.
Motion by R. J. McCurry "We sell $7,000.00 U. S. Treasury Bills, invested
from 1954 Sinking Fund and transfer proceeds to E & C fund to meet accounts
payable, J. E. Lovern Construction Company for balance due on Roswell Street
sewerage." Motion seconded by Homer Kuhl and voted unanimous. NOTE:
Revenue from tap-ons to these three trunk lines will not be due until May
or June 1965.
Council, on J. C. Porterfield's motion and R. J. McCurry's second, approved
as submitted the November 1964 minutes.
Council approved hiring seven safety patrol ladies and one alternate @
$1.50 per hour, at estimated two hours per day for assignment at school cross
over areas in the City. Training and purchase of 'uniforms was discussed.
Motion by D. L. Maxon, second by C. M. Chapman to proceed with plan and hire
personnel to start assignment January 4, 1965.

R. J. McCurry discussed acceptance of part payment on police fines and
reported the policy of non -acceptance had long been in effect. Motion by
R. J. McCurry and seconded by Homer Kuhl to adhere to policy and that no part
payment shall be accepted by police personnel in payment of fines or posting
bonds. Motion carried.

Council authorized discontinuance of service to M. B. Ware Laundry on
So. Cobb Drive on Friday, December 11, 1964 if balance due on sewer line
$725.00 has not been paid.
Motion by R. J. McCurry, second H. Kuhl, to adopt resolution as read
pertaining to locating Atlanta Gas Light Office and appliance outlet in City
of Smyrna.

DECEMBER 14, 1964
Mayor G. W. Kreeger called a meeting of council members to resolve City
employees social security contract approved in July, 1964. The contract was
held in abeyance by Atlanta Director pending clarification of federal regu-
lations relating to coverage of City police and fire department personnel.
Motion by Homer Kuhl, seconded by J. C. Porterfield to declare the
meeting as an official meeting of Mayor and Council. Motion carried.
Present: Presiding, Mayor, G. W. Kreeger and all council members except
C. M. Chapman.
Councilman R. J. McCurry reported on the July 1964 contract, reports,
transmittal letters and statistics supporting the contract of record and City
check in the amount of $1900.00 covering remittance of one -twelfth of total
advancement required to cover City employees under Social Security.
Council discussed and approved R. J. McCurry's motion to approve and sign
a new ordinance and all papers thereto covering all employees except Police and
Fire personnel, Elective Officers and employees retained on fee basis. Advance
remittance covering one -twelfth of contractual payment adjusted from $1900.00
per check submitted covering third,quarter to,$1068.47. Further, the motion
requires one employee of City Police Department to apply for membership in
Police Officer's Annuity and Benefit Fund. Above motion, deleting discussion
and contract detail, was seconded by J. C. Porterfield and voted unanimously.
Application for building permit covering apartment structures on Medlin
Street was deferred to 12-21-64 pending clarification of entrance on Love Street,
sewer easements, etc.
Council agreed to reconsider and discuss (see previous minutes) erection
of illuminated sign for Dr. R. D. Weber's professional building at 4" Cherokee
Road. Interpretation of ordinance was the,issue; although adverse opposition
was heard regarding the application and issuance of permit, Councilman R. J.
McCurry moved to recind previous action of Council and release permit for
installation of sign. The vote was four to two - J. C. Porterfield, Homer
Kuhl voting against the motion.
Committee assigned to screen applicants for City Attorney reported. R. J.
McCurry moved (per committee approval) the appointment of Mr. Ber-1 T. Tate of
Beaver Creek Road, Smyrna, Georgia, as the new City Attorney replacing G. Conley
