The mid -month meeting of Mayor and Council was held at
City Hall, Smyrna, Georgia, above date and called to order by
Mayor G. W. Kreeger at 7:30 o1clock P.M. All Council Members,
Department Heads, City Attorney and City Clerk were present,
also'Mr. Frank Dagley, representing Hensley -Schmidt, Inc.
Items No. 1 and No. 2 of the Agenda called out citizens
reports and building permits. Nb citizens appeared and no permits
were submitted by the building inspector.
Three bids were received and opened covering the renovation
of sludge" drying beds and construdtion of grit chamber for the
westside,-,sewerage treatment plaht per advertised specifications:

Lord & Kirkendoll Constr. Co., Mableton, Ga. 6,699.00
Motion by Homer Kuhl to refer to committee for tabulation
and check out with consultant engineer and authority given to
approve the Lord & Kirkendoll bid with provision that specifi-
cations have been met. Second by C. M. Chapman and voted
unanimous. I
The Council accepted and approved the one bid received
covering �he duct work for the Church Street Recreation building
air conditioning. The bid covering complete installation of the
duct work was submitted by John H. Tinnell Heating and Air' Con-
ditioning Company of Mariet�a in the amount of $3,173. Councilman
R. H. Wood motioned to accept the bid. On Homer Kuhl's second
the vote was six to one-, R. J. McCurry voting against the
motion.
A petition received from the Rev. Clifton C. Duvall requested
Counc,i-1 approvai for a mobile home to be pl&ce�d, on the rear of i
Lot No. 3, Block A, Pinehurst Circle, for temporary occupancy.
Council denied the application, calling out excerpts from the
City Zoning Ordinance which states that mobile home permits are
limited for use only during construction of a dwelling by a
builder or developer.
The Business License Committee approved issuance of a permit
for the sale of produce from a truck located adjacent to Johnsonts
Trim Shop on Concord Road. (The license, $100.00, restricts
Mr. Johnson to the location called out and wholesale only.)
A letter from the Housing and Home Finance Agency dated
September 9 was read in Council requesting certain information
and signatures on the Assurance of Compliance Forms. The letter
further stated that Project No. P-GA-3054 (Sewer Facilities)
would be officially terminated on September 24, 1965 unless the
requested information was received. The $5,000 set aside for the
plans preparation (sewer facilities) and the $7,500 (water
facilities) was discussed by Mayor and Council and City Attorney
in connectlon�� with invoices of record from Hensley -Schmidt, Inc.
in the above.amounts. It was brought out that in all proposals
and agreements, the Council never requested or approved the
securance of an interest free loan, and further that no obli-
gation on the part of the City existed in connection with the
funds set aside for water and, sewdr study and.plans preparation.
6n this basis,-Co'tincilman R. J. MeCtirry -_ recommended and'moti - 6ned
that any request for payment by Hensley -Schmid - t, Inc. be and is
hereby denied. Motion second by Homer Kuhl and voted unanimous.
Public Works Superintendent J. 9. bavid submitted two directional
plans for sewer facilities on the east and west side of South Cobb
Drive and north of the intersection of Powder Springs. Memo :
The J. E. Lovern bid for sewerage to the Waffle Shop is recorded in
the amount of $5,105-50.

To afford sewerage on the west side of South Cobb, it was the
opinion that the sewer installation to the Waffle Shop would require
a deeper cut, thence under South Cobb,on the� west right-of-way,
thence, north to,the commercial structures to Bourne Drive at an
estimated $18,251. An alternate proposal from the above mentioned
Waffle Shop, costing $12,761, directs the sewer line under the highway
to the Winn -Dixie easement, thence, north to a LL line, thence, west
to the right-of-way of Old Concord Road, thence north -on Old Concord
right-of-way to Jones Shaw Road.
An agreement to approve a contract with Southern Bell Telephone
and Telegraph Company for installation and maintenance of teletype-
writer circuit in the City Police Department was discussed and
approved on mo'tibn by Homer Kuhl. The plan or agreement, known
as Metropol, would cost $30 per month for the teletype system, plus
$24 for setting up the radio equipment4 The motion to become a part
of Metropol as per agreement submitted was seconded by R. H. Wood
and carried. A motion duly seconded by the above Councilman,
recommends three officers assigned for a 100 hour training program
at the estimated cost of $25 for each assigned trainee covering
supplies, etc.
It was brought out in Council that the cost of preliminary
consultant engineering for the relocation of Spring Road utilities
as submitted bT Hensley -Schmidt, Inc. was $8,115. The first relocation
estimate ($551 was called out in a letter to the State Highway
DepRrtment stating the City was not' st'affed to make this type of study
and approved Hensley -Schmidt to perform the assignment. In further
d.iscussion,-Mayor Kreeger appointed the Street Committee and the
City Attorney to meet with Mr. -Sam P. Hensley to resolve any and
all questions pertaining to the above.
Complaints of speeding on Honeysuckle Drive was rd-f6rred to
Chief of Police, Robert L. Drake.
On R. J. McCurry's motion, seconded by J. C. Porterfield, the
Council approved a§ written and submiited the minutes of Mayor and
Council for the months of July and Au�ust 1965.
In final action, the Council:
1. Approved on R. J. McCurry's motion-, which carried, to cut
off water at three apartment projects on 9-22-65 and
further the existing procedure to residential structures
shall b'e applicable. The above cut offs refer to delinquent
water bills of the King -Williams Land Company.
2. Referred Miss Elizabeth Will's request for sewer tap'refund
to City Plumbing Inspector and Cobb County Health Depart-
ment for report on percolation test.
3. Recommended the discontinuance of citizens building up
driveway gutters with various construction materiAls
which, in effect, will collect trash and stop the flow
of'surface water.
4. Authorized preparation of State Highway applications to
erect, maintain and operate traffic signals on So. Cobb
Drive at McCauley and Glendale intersePtions, per notion
by Homer Kuhl, which carried.
There being no other business, a motion was made by Homer Kuhl to
adjourn, 9:35 P.M.
