03-02-1964 Regular Meeting13 March 2, 1964 A regular meeting of Mayor and Council was held, pursuant to the Charter of the City of Smyrna, Georgia, March 2, 1964, at 7:30 o'clock p.m. Mayor G. W. Kreeger presided and all Council members were present. No citizens were present to submit reports to the Mayor and Council. Mr. William F. Law, Jr., representing Adair Realty Company, submitted in Council a rendering of a plat for proposed building to be erected on the land now occupied by Estes Heating and Plumbing Company on South Cobb Drive. In discussion the Council agreed as follows: a. Annex to the corporate limits 25 feet of land north of existing property line of the Estes Heating and Plumbing Company property under the existing zoning as per Cobb County records. b. Waive 50 feet set back as per current regulations on commercial property to 40 feet set back from South Cobb right-of-way. c. Waive the 30 feet rear yard set back per existing regulations to 15 feet set back which shall be paved to Old Concord right-of-way with proper drainage thereon. The above recorded in the minutes on motion R. J. McCurry second J. W. Webb and voted unanimous. Council voted unanimous to accept a petition to rezone from R-1 Residential to C-1 Commercial area, two parcels of land owned by the Baptist Chyrch of Smyrna, Inc. located in LL 522 on the west side of King Street and known as 152 and 166 King Street. The date of the hearing was set for April 6, 19641 7:30 p.m., on motion J. C. Porterfield. Bids covering gas and oil for City usage were opened, read and referred by Mayor G. W. Kreeger to the following committee for study: R. J. McCurry, C. M. Chapman, Homer Kuhl. Mr. James B. Sellars appeared in Council stating he had purchased the property of Stanford's Service Station at 763 No. Atlanta Street, and requested malt beverage package store license, he having submitted a notarized application at City Hall February 291 1964 On motion R. J. McCurry, second J. W. Webb, Council approved on a five to two vote to issue retail malt beverage license to the petitioner. Trailer permit on the property of Robert L. Gardner, Cober Terrace, for storage purposes only was reissued for one year from above date on motion J. W. Webb, second J. C. Porterfield, which carried. In the discussion of highways, street and sidewalk report, Mayor G. W. Kreeger called out the meeting set by the State Highway Department to be held in City Hall, March 12, 1964, in connection with the Spring Street project. Also recommended was a resolution to be drawn and submitted to the State Highway Department supporting the Spring Street connector. The resolution in part stated, "that the Mayor and Council of the City of Smyrna acting for and on behalf of the City for its citizens to help voice and speed approval of the 4-land highway planned for construction in the City of Smyrna and known as the Love -Spring Street Extension and urge the completion of same at the earliest possible date by the State Highway Department of Georgia.,' 14 (Continuation of 3-2-1964 Meeting) Councilman J. C. Porterfield reported that he had contacted Mr. James E. Lovern regarding sidewalk contract on Concord Road and further that Mr. Lovern agreed to withdraw his bid for the construction_ of the Concord Road sidewalks. In connection with this withdrawal, J. C. Porterfield motioned to add sidewalk installation to the Neel Contracting Company, said sidewalks to be installed under the terms of the recorded bids. The above put in motion J. C. Porterfield, second R. J. McCurry and motioned carried. On a vote of six to one Council rejected affiliation of the City of. Smyrna Library with the Cobb County -Marietta Public Library system. Motion by Homer'Kuhl second J. W. Webb, C. M. Chapman ,voted against. On a motion by Homer Kuhl the services of Mrs. Mazie W. Nelson (library staff employee) was terminated effective March 15, 1964. Votiizg for the motion Homer Kuhl, J. C. Porterfield, J. W. Webb, B. A. Thomas, voting against motion C. M. Chapman, R.'H. Wood. R. J. McCurry abstained. Also, on motion Homer Kuhl, Mrs. Kathryn Jones, library staff employee, was classified"as a full time salaried employee at $200 per month, effective March 15, 1964. Mrs. Mary T. Wills and Mr. C. Mayes Hamby were appointed by Council as members of the City of Smyrna Library Board replacing Mrs. Ruby Carmichael and G. W. Kreeger who resigned. The other members of the Library Board are as follows: Mrs. G. C. Green, Chairman, Mrs. Corinne Hosch, Mrs. David Cano, Mr. W.Hubert Colquitt, and Councilman Homer Kuhl. The new appointees per motion by Homer Kuhl'second R. J. McCurry and voted unanimous. An Ordinance was read and adopted above date pertaining to the operation of commercial billiard rooms and tables. Excerpts from this Ordinance are as follows: a. It shall be unlawful for any person, firm or corporation to operate billiard rooms or tables for monetary pur- poses between the hours of midnight and six o'clock a.m. b. It shall be unlawful for any billiard rooms or tables to be operated on Sunday. c. It shall be ianlawful for any person who has not'reached the age of 18 years to play billiards or to remain on the premises'unless said person or persons have reached the age of 16 years and are accompanied by a parent or guardian, or have notarized permit signed by parent or guardian. d. Penalty clause applicable to City of Smyrna ordinances applies to violations of above.. Passed by Mayor and Council in meeting City Hall March 22 1964 on motion Councilman Homer Kuhl second J. C. Porterfield and voted six to one, J. W. Webb opposing.' Council listened to W. J. Ma.cKenna's request for consideration of sharing the cost of 1200 feet of fencing to be constructed as a barrier'separating the Jonquil Park property and the developer's residential property. There was no action; however, the Council recommended that the City bear no cost toward the erection of the above mentioned fence. Action to Repeal Malt Beverage Ordinance dated February 3, 1964. 1. On Mayor G. W. Kreeger's recommendation, put into motion by Homer Kuhl, that this Council repeal or rescind -the 15 (Continuation of 3-2-64 Meeting) action recorded February 3, 1964 and further this Council adopt the malt beverage oidiniiice- in effect prior: to Flgb- ruary 3, 1964. The motion lost five to two, Councilman Kuhl and Wood voting for the motion. 2. Motion by Homer Kuhl, second R. H. Wood, to delete malt beverage sales from grocery stores as per 2-3-64 minutes, excluding superettes. The motion lost five to two, Kuhl and Wood voting for the motion. 3. The number of malt beverage licenses shall as of this date be limited to two licenses per person. The motion by Homer Kuhl lost five to two. Councilman J. C. Porterfield presented the first plan for re- alignment of the six voting districts within the corporate limits. This proposal was discussed and referred by Mayor G. W. Kreeger to a committee of J. C. Porterfield, Chairman, Homer Kuhl and J. W. Webb. Council, on B. A. Thomas' recommendation, voted to install two stop signs to control traffic on Old Concord Road at the intersection of Powder Springs. The discussion of high water bills was referred by the Mayor to the water committee for resolve and report. Motion to adjourn 9:40 p.m. Next meeting March 16, 1964, 7:30 p.m. March 16, 1964 A meeting of Mayor and Council was held March 16, 1964 at 7:30 p.m. at the City Hall - Mayor G. W. Kreeger presided; Councilmen present, R. J. McCurry, C. M. Chapman, R. H. Wood, B. A. Thomas, Jas. W. Webb, H. Kuhl, J. C. Porterfield. The meeting was opened with invocation by R. H. Wood. Mr. Wm. J. MacKenna again requested fence be constructed as buffer between Rolling View Acres and Jonquil Park. No action. The hearing was called on petition of Wm. Reed (for W. A. Ward) to rezone from R-1 Residential to C-1 Commercial that parcel of land lying on the east side of South Cobb Drive between Powder Springs and Bank Streets. Mr. Wm. Reed represented petitioner and asked that area be rezoned to C-1 proposing to reserve a 25 foot buffer zone between existina residential and the proposed commercial area. Eighteen area residents appeared to protest proposed rezoning. Dr. Wakefield, spokesman for the group, stated development of commercial area would de -value residential properties in the area; represents "spot" zoning; rear of business area unsightly. B. A.
