02-03-1964 Regular MeetingFebruary 3, 1964 E:3 A regular meeting of Mayor and Council charter at the City Hall February 3, 1964, Mayor G. W. Kreeger presiding. Councilman C. M. Chapman, R. W. Wood, B. A. Thomas, J. J. C. Porterfield. was held pursuant to 7:00 o'clock p.m., present R. J. McCurry, W. Webb, Homer Kuhl, Mr. E. H. Civils, Superintendent of the L & N R.R., was introduced by attorney G. C. Ingram. Mr. Civils appeared con- cerning the City complaint on trains traveling at excessive speeds through the City and stated the railroad would not tolerate these violations. However, in order to correct, the police should furnish engine number, time of violation and direction train is traveling. Mr. Civils requested that trains be permitted to resume speed after the engine has cleared the last crossing in the City. Mr. Civils was also requested to check the blocking of crossings for excessive length of time and follow up on the request for installation of warning device at Hawthorne Street crossing. Mayor Kreeger thanked Mr. Civils for his personal attention to this problem and pledged the cooperation of the City. Hearing was called on the petition to rezone the property on the southwest corner of Church Street and Concord Road from R-1 Residential to C-1 Commercial (Restricted, -Mortuary). Mr. Bill Bullard, spokesman for the petitioner, stated plans were to use the property for a mortuary. Mr. H. Kuhl, reporting for Committee, stated the premises had been checked by City plumbing, building and electrical inspectors and that the proposed plans provided 30-40 parking spaces and bringing the building up to minimum code standards prior to occupancy. Approximately 30 citizens were present in opposition to the rezoning on the grounds that this type of business would create a safety hazard for children due to proximity to school; disturb church activities; spot zoning; desire to keep area residential. A motion H. Kuhl second J. W. Webb to deny petition for re- zoning lost 4 to 3, voting as follows: for motion Kuhl, Webb, Wood; against motion McCurry, Thomas, Porterfield, Mayor Kreeger; C. M. Chapman abstaining and Mayor casting deciding vote. R. J. McCurry motioned, second J. C. Porterfield to grant petition to rezone the Blanche Rice property at Church Street and Concord Road (per legal description as advertised) from R-1 Residential to C-1 Commercial (Restricted -Mortuary), subject to building being brought up to minimum electrical, plumbing and building codes of the City and provision for off street parking as outlined to committee; motion voted unanimous. Mayor G. W. Kreeger named the following committee to make a study of the 1963 Tax Appraisals to determine whether Hunnicut system equitably applied, said representatives -having been selected by each ward councilman. Mr. Geisler was named chairman. Ward 1 Robert B. Tolbert Ward S Richard B. Dibble Ward 2 Robert M. Yoder Ward 6 Luther M. Geisler Ward 3 J. C. Johnson, Jr. Council at Large C.M. Armour Ward 4 Wm. H. Black Mr. Wm. J. MacKenna presented revised plat of lots on west side of Spring Creek Place (Argyle Forest) for approval, said lots previously having been declared unsuitable for development. R. J. McCurry motioned second J. C. Porterfield to approve plat subject to compliance with FHA stipulations and that plot plan of each individual lot be furnished before building permit application(s) considered; motion carried 6 for, B. A. Thomas abstaining. 0 (Continuation of February 3, 1964 Meeting) Mr. J. W. Kelly reported request for building permit from Southern Bell Tel. and Tel. for expansion of their Spring Street facility. Motion R. J. McCurry second H. Kuhl to approve permit subject to further examination of parking area, traffic flow and building set- back was voted unanimous. Mr. Kelly to coordinate these items with others where necessary. Barge -Thompson, Atlanta, General Contractor, applied for permit. A motion R. J. McCurry second B. A. Thomas to adopt amended Malt Beverage Ordinance was voted 5 to 2, H. Kuhl and R. H. Wood voting against the motion. (Copy of the ordinance attached hereto and made a part of these minutes.) J. C. Porterfield reported County has not made commitment to participate in cost of widening Concord Road. Progress on widening Old 41 static; Mr. Porterfield will write Oil Companies re options. J. C. Poeterfield reported the Public Works Department was spending an excessive amount of time cleaning out sewer lines and the Committee recommended purchase of mechanical equipment needed. Porter- field motioned second B. A. Thomas to waive bids and purchase one Flexible, Inc. 3 H. P. Flexible Power Drive and Carry -All Xiailer with accessories at a cost of $820.00 delivered was voted 6 to 1, J. W. Webb voting against motion. (J. E. David to check Harold's Sales and Service re possibility of purchasing through them at same price.) License for new Redford's 5 & 10 referred to license committee to establish rate. City Clerk L. W. Charles reported withdrawal of application Bob Leonard to rezone Marston Street property from R-1 to M-1 Restricted. R. J. McCurry motioned second H. Kuhl to name Mr. Ted Bowman to serve on the Tax Assessing Board for 1964 for a period not to exceed 30 working days at rate same as 1963. Voted unanimous. A motion-J. W. Webb second R. H. Wood to hire a new man in the Sanitation Department at the minimum rate for a period not to exceed six months and add $600.00 to the Department Budget, effective date 2-7-64, said man being substitute for laborers on vacation. Motion carried 5 to 1, R. J. McCurry voting against and H. Kuhl abstaining. Mayor Kreeger read letter from Lemons Civic Club inviting Mayor and Council to attend meeting February 10, 1963 at 7:30 p.m. which they moved to accept. A motion R. J. McCurry to deny license to any applicant who has any any past due amounts owed the City was, on second H. Kuhl, voted unanimous. It was moved J. C. Porterfield second H. Kuhl to include the property of H. Poss on King Springs Road in the 1964 annexations and House Bill, voted unanimous. Mayor Kreeger reminded Council that the new time for Council meetings is 7:30 p.m. Meeting adjourned 10:25 p.m. Next regularly scheduled meeting - February 179 1964 at 7:30 p.m. at the City Hall.
