Regular meeting of Mayor and Council was held at City Hall on November 6, 1961
at 7:00 o'clock P.M. Mayor G. W. Kreeger presided, and all councilmen were present
except R. J. Austin.
In the first order of business, council accepted as read the certified election
results as follows: -

Motion by R. J. McCurry, second by W. L. Keck, and voted unanimous.
On motion by H. E. Ingram, the run-off election for Ward Nos. 2, 4, and 5 was set
for the hours of 7:00 A.M. to 7:00 P.M. at the city hall on November 18, 1961, and further
the election managers assigned to the regular election were reassigned for the November 18
run-off election. Motion was seconded by R. J. McCurry. MEMJ: Mayor G. W. Kreeger
called out the following council members to draw up a resolution commending the Smyrna
Jaycees for their performance in connection with the 1961 election: - J. B. Ables, R. J.
McCurry and Harry E. Ingram.
Citizens from Cliffwood Drive appeared in protest regarding the day nursery located
at 111 Cliffwood Drive. There was no action as council ruled the petition of Mrs.,Ruby
Cooper was in order and accepted prior to this meeting.
The following items were discussed, no action recorded: -
(a) C. 0. Head water line installation and sewerage line taps.
(b) Drainage easement from W. E Collett, Jr. in lieu of $100.00 paving refund.
(c) Drag and clean out creek in Dundee and Spring Street area per request of
William J. MacKenna Company.
(d) Day nursery petition South Cobb Drive and McCauley area deferred pending
remeasurement of 300 ft. radius.
Amendment to Rules and Regulations, Malt Beverage Ordinance: — Page No. 2, Item
No. 5 of existing ordinance reads as follows: "Only one license shall be issued to any
one person, immediate family, or company." Motion by R. J. McCurry, second by J. K.
Chastain as follows: "Restrictions shall hereby be removed to allow one operator to own
more than one establishment, Mayor and Council to rule on issuance of permit or denial
upon receipt of applicatinn for permit." The vote was five to one, W. B. Sanders opposed.

After discussion relating to specifications and costs, H. E. Ingram motioned to
purchase twelve school zone signals and the subsequent installation costs. Second by
R. J. McCurry and voted unanimous.
Councilman H. E. Ingram, referring to storm damage, requested documentary evidence
of expenditures shall be prepared and available as soon as possible.
CHARTER CHANGES
1. Extension of the qualifying date for candidates and voter registration from
fifteen days to forty-five days prior to the election, or prior to the first Saturday in
November. MEMO: Any citizen may register provided he is eighteen years of age and will
have resided in the city six months and the state one year prior to the date of election.
2. Permits or allows City of Smyrna to install sidewalks where deemed necessary
in the interest of safety by the Mayor and Council.
3. To permit elections to be held at any time on bnnd issues after Mayor and
Council have approved an election by majority vote and give at least forty-five days
notice to the registered voters after said approval. Said notice of pending bond issue
to be advertised in newspapers of general circulation weekly through date of election.
4. To permit realignment of wards based on submitted surveys and approved by
Mayor.and Council.
5. That the qualification fees of candidates or election entrance fees shall be
increased from $25.00 to $50.00 for mayor; Councilmen from $10.00 to $25.00.
Council on unanimous vote approved and endorsed the resolution of the Georgia
Municipal Association at their annual convention at Jekyll Island, which resolution
called out to return a portion of the state collected highway user taxes back to the
towns and municipalities on a formula basis. (The formula as of above date hinged on
10 per gallon return.) I

On Harry E. Ingram's motion, council accepted the low bid of Cobb County Tractor
Company and withheld issuance of purchase order pending receipt of available funds
through Civil Defense. The low bid covers one #641 Ford Tractor at $2,245.00; one
#502 side mower at $417.35 and one #19-150 blade and scarifier at $295.00, total cost
approved for thirty days only, $2,957.35• On J. B. Ablest second, the vote carried.
The following items were discussed, there was no action: -
1. Condemnation proceedings, L. M. Channell. Selection of three appraisers,
set value of the easement taken, or consequential damages or benefits to the property.
2. Set the next meeting of the Safety Council at November 11, 1961.
3. Approved issuance of building permit for the Campbell Restaurant addition.
4. Held in abeyance building permit for Ben Maxwell pending approval of Cobb
County Health Department.
5. Requested removal of all election posters.
6. Requested that removal or relocation of subdivision sign at Dundee and
Spring Street be referred to Councilman J. B. Ables.
7. Suggested further study of departmental hourly and salaried wage scales.
8. Heard a report from Civil Defense Director Beverly Dubuc which resulted
in the appointment of W. B. Sanders, R. J. McCurry and J. B. Ables to meet on November
11, 1961 to resolve the problems called out.
Building Inspector J. A. Bailey reported that he was the successful bidder for the
N completion of'Smyrna Christian Church on Concord Road. Council on J. B. Ablest motion
permitted the construction to proceed and authorized the city engineer to follow up on

Payment of balance due ($750.00) to Smyrna Volunteer Fire Department and Rescue
Unit was authorized to be made prior to the December 1, 1961 due date. J. K. Chastain,
H. E. Ingram.
On motion by J. K. Chastain, second by R. J. McCurry, Fire Chief C. C. Porterfield's
salary was increased from $475.00 per month to $500.00 per month effective November 1,1961.

Continued meeting of Mayor and Council was held at City Hall and called to order
by Mayor George W. Kreeger at 7:00 o'clock P.M. All council members were present except
J. K. Chastain and W. L. Keck. Councilman W. B. Sanders reported at 8:50 o'clock P.M.
In the first order of business, the Smyrna Guru Club was granted the usage of South
Cobb property for a turkey shoot on December 2 and 16, 1961. Motion by R. J. Austin
carried.
Council rejected, on J. B. Ablest motion, the petition for a day nursery at 681
South Cobb Drive, said denial hinged on a failure to secure two-thiW5 of the residents
within the area of influence. Motion seconded by R. J. McCurry and voted unanimous.
Building permit for remodeling property owned by J. R..Arrington on North Atlanta
Street was approved. Also approved, building permit to J. A. Bailey for church building
on Concord Road. Building permit to Ben Maxwell, Concord Road, was denied. Motion by
R. J. Austin, second by Harry E. Ingram, and voted unanimous.
The finalized minutes covering six meetings of Mayor and Council during October,
1961 were on J. B. Ablest motion accepted as submitted and corrected.
Discussion of C. 0. Head water line was referred to Mayor G. W. Kreeger.
In the discussion of the November 11, 1961 safety report by R. J. McCurry, it was
called out that all employees shall submit to a physical examination prior to placing
on the payroll.
Council listened to the complaint of citizen W. E. Ingalsbe of 515 Burbank Circle
and then ordered a meeting to be held at city hall on November 16, 1961 to resolve
similar problems. All members of the Police Department and city council were asked to
be present.
