Continuation of September 12, 1960
Engineer Sam Hensley submitted in Council the first phase covering general
provisions and classification of residential zoning, business districts, and in-
dustrial zoning and recommended the drafting of a comprehensive city zoning map.
Also in discussion were the requirements for a zoning board and the.necessary
ordinances. Council requested Mr. Hensley to report September 19., 1960 calling
out date of com
,pletion of City of Smyrna zoning map.
Council requested City Attorney to draw up amendment deleting the
____VoO.00 sewerage tap -on fee from "Land Subdivision Rules and Regulations."

Meeting of Mayor and Council recessed September 12, 1960 was called to
order at 7.-;00 ot clock P. M. Se ptember 19, 1960 at -City Hall. Mayor G. W. Krebger
presided, all Councilmen present except R. J. Austin.

In the first order of business, Council accepted oh H-. E. Ingramts
motion the application of H. I. McArthur to zone from residential to, business
two lots knowft as 632 and'638 Concord Road located,iii landlot 413. Motion
seconded.by R. J. McCurry and date of hearing called out as October 3, 1960.
City Attorney G. Conley Ingram spoke in Council referring to dis-
continuance of sewerage line installations and.services and the letting of con-
tracts to independent contractors to install, for the present time, said sewer
systems under city supervision and in accordance with accepted city policies.
Mr. Ingram mentioned certain -inconsistencies in prevailing ordinances that were
in conflict with accepted -,policy of Mayor and Council as called out in the
finalized minutes dated.April 13., 1959 and August 8., 1960. Mayor and.Council
concluded to acbept as read the following ordinance. (Motion R. J. McCurry,
second J. K. Chastain.)
ORDINANCE R
NOW, THEREFORE, IT IS ORDAINED by the Mayor and Council of said City as follows:
1. That the minutes of the previous action taken by the Mayor and Council at
the August 8, 196o meeting be amended to reflect the policy presently in
force and effect in the City with respect to the installation of sewer
taps and services and the payment therefor by adding thereto the following:
Paragraph 703 on page 20 of the City of Smyrna Land Subdivision Regulations
is therefore and hereby amended by striking the following sentence there-
from: "The,City of Smyrna shall install sewer system within the development
at a complete cost of $200.00 per tap."'
and the following language is substituted.in lieu thereof:
"The sewer system shall be installed either by the City or by an independent
contractor under a contract with the City at a cost of $200.00 per' tap to
the owner in addition to the actual cost of any pump or lift station that
the City may deem necessary for the effective use of the sewer system and
arq rock excavation encountered, in the sewer installation. The owner shall
furnish the City surveys and plats showing streets, layouts and sewer line
profiles in the area in which sewer taps and service are requested and
same will be subject to approval by the City to insure that engineering
standards prescribed by the City for such projects are met. The estimated
cost of each sewer project shall be paid cash in advance by the owner at the
time of each request for sewer services."
2. That all ordinances, or parts of ordinances',, heretofore enacted by' 'the"'
Mayor and Council of the City of Smyrna that are in conflict with this
ordinance be, and the same are, hereby repealed. MEM : (See amendment'dated

1. City Attorney shall be in attendance at Merit Board Hearing September 21
1960 regarding suspension of one employee of City Police Department. (Motion
and. second - J. B. Ables, R. J. McCurry.)
2. Approved purchase of fall uniforms, Police and Fire Departments.
3. Held in abeyance, bids on altitude valve and agreed on W. L. Keck!s
recommendation to paint water tank green.
4. Deferred selecting a successful bidder on one garbage truck to Thursday,
September 22, 1960, 6:00 o'clock P.M.
5. Requested further check by Sam P. Hensley and J. L. Holmes on,Atlanta
Terrace sewerage tap, cost, and easement.
6. Set date to October 3, 1960 for completion of over-all city zoning
map and zoning classifications.

Upon submission in Council statistics pertaining to accounts receivable
(sewer taps), water line repairs and requested materials credit for unused
pipe in Creatwood Forest Unit No. 11 R. J. McCurry moved, seconded. by H. E.
Ingram', that City Hall analyze footage of water lines purchased against foot-
age of water lines installed by sub -contractor J. E. Lovern, taking into con-
sideration any substitut ' ions of transite pipe by reason of savings to the sub-
divider orby reason ' of relo�aiion of main lines. Motion further states upon
reconciliation,and engineer's approval of said analysis, all city services
shall be discontinued pending receipt in full of accounts receivable as called
out in statements presentedin council above date. The vote on this action
was unanimous.
Councilman J. B. Ables discussed departmental reports covering variance of
actual expenditures for the eight months ending August, 1960 as measured
against approved.budgets for same period. All departments were over budget
except Streets and Parks. City Hall was over by virtue of Council action
which authorizedinterim audits 1960 and change in carrier of Workman's
Compensation Insurance. It was agreed this meeting to classify and set up
Police Officers' Annuity and Benefit Fund as a liability rather than an ex-
pense charge in 1961, Variance., actual over budget in Sanitation Department
was deferred to determine a proposal to adjust rates and/or the purchase of
new equipment.
A request was submitted in Council by Lea's Inc., together with plat and
petition signed by fifteen property owners to rezone for business the property
on west side of'Atlanta Street from Belmont Hills to Love Street. Citizens
in attendance were reminded that zoning map was in process as well as over-
all city zoning classifications for residential, commercial, andindustrial.
Council approved on unanimous vote to accept plat, petition, and application
for zoning and withheld the date for public hearing pending receipt inCity
Hall of legal description of all properties involved. Above action put in
motion by J. K. Chastain, duly seconded by Harry E. Ingram.
Councilman R. J. McCurry moved, seconded by J. B. Ables, the minutes of
Mayor and Council meetings held.at City Hall on August 1, 3, 8, 10, 15, 22�
and 29th be accepted as corrected. Voted.unanimous.
