Continued meeting of Mayor and Council was held at City Hall,
September 17, 1962, and. called to order by presiding officer, Mayor
J. B. Ables, at 7:00 o1clock P.M. All councilmen were present, as
well as city engineer, consultant engineer, city attorney, and city
clerk.
Mrs. E, M, Groce, 178 Bank Street, presented a petition calling
out that citizens in her area are in agreement with the operating of
a day nursery at above address. On J. B. Rhodes' motion inspection
permit was granted pending ccompletion of inspections of Police, Fire,
Electrical and Building inspectors. notion seconded by R. H. Mood.
and voted. unanimous.
Petition was submitted with plat requesting rezoning from C-1 to
C-2 approxii,lately 156 feet on the east side of South Cobb Drive for
the purpose of Complete Garbage Company office and maintenance of
equipment, 161otion made by H. L. Smith -to advertise zoning request
and set date for hearing at October 15, 1962, seconded by VJ, L, Keck,
and. carried.
Council discussed Pined.ale Drive and, in particular, the delays
by reason of excess dirt, grates, back filling, and clean up. Sev-
eral citizens protestedthe condition of back fill earth. In d.is-
cussion J. B. Rhodes motioned. that the city assume the responsibility
of furnishing adequate grass growing soil on back fill areas of all
re-pavedand, curbed. streets. Motion refers to Pinedale and Oakdale
Drives and all other curbed, streets which shall be back filled with
approved. soil per negotiations through assigned engineer and the con-
tractor, Motion seconded by W. L. Keck, and. passed.
In discussion of Pinecrest Circle curbing, J. B. Rhodes motioned.
to split cost of curbing on East side which - through engineering
error - was curbed a distance of 800 feet (more or less). Motion
divides cost equally between City of Smyrna and. Hensley and. Associates,
Inc, There was no second.
Motion by R. J. McCurry that City Hall prepare invoice covering
cost of Pinecrest Circle curbing on East side for recovery from
Hensley and Associates, Inc. by reason of error of curbing both
sides. Motion seconded by H. L. Smith and carried six to one, J. B.

The following ac ion resulted from "no bids" received covering
back filling shoulders. Motion by H. E. Ingram that Street Depart-
ment be authorized to hire four additional employees to be assigned.
for back filling shoulders. J. B. Rhodes secondedand vote carried.
Hensley and Associates were requested to negotiate with con-
tractor for street grading on Magbee Street and report back to
council. Motion by H. L. Smith, second by H. E. Ingram, and. carried.
f Building permit for dry cleaning plant at 130 Cherokee Road.
(Pilcher-Livingston contractor) was approved. subject to building
inspector's check-out. Motion by R. J. McCurry, second. H. E. Ingram,
voted. unanimous.
Building permit for Do -Nut Shop, corner of Cherokee and. South
Cobb Drive, (Tor,,2 McCord, contractor) was approved subject to building
inspectorts check out. Motion by R. J. McCurry, second.W. L. Keck.,
and carried.

Council discussed.policy--overing water line charges, which
policy per prior minutes, calls for payi�er_t of line charges in the
absence of proof of payment from current or previous owner or dev-
eloper. The request of Mrs. R. J. Cook, 341 Lee Street, to delete
line charges on improved.property at above address was denied.
Drainage problem, Argyle Estates, was referred. to City Ehg;,z eer,
Don Stanley.
Council discussed completion of street interesctions and recom-
mended action through City Engineer in the following subdivisions:
Argyle Forest (D. Miller), Springhill (D. Bridges), and Rolling
View Acres-(W. J. McKenna).
Council approved on motion of H. E; Ingram, second. H. L. Smith,
to accept proposed change in the printing of malt beverage tax
stamps deleting the stamp value per unit (@ .03, .035, and. .08),
and, showing theron, pe_ purchase order #1513 dated. 9-13-62, the
quantity per unit: i.e., one to twelve ounces, thirteen to twenty
four ounces and. twenty five to thirty two ounces. The motion was
voted unanimous.
Councilman J. B. Rhodes excused. 9:45 P.M.
Minutes of Mayor and Council meetings during August, 1962, were
accepted. as submitted, on motion by J. W. Webb and second. by R. J.
McCurry.
All other items on September 17th agenda were d.eferred.. Com-
mittee meeting was scheduled, by J. W. Webb for September 19, 1962,
to resolve policy and enforcement of "clean-up ordinances".
Around the Table
Traffic light, Cherokee Road at intersection of North Atlanta
Street. Council authorized, per H. E. Ingramts notion, to -secure
bids for this needed improvement and further, if purchased, to
reimburse from funds which may be granted to municipalities for
street maintenance, per Georgia Laws of 1962, Page No. 641. Motion
was seconded by H. L. Smith and passed.
Water consumption by Highland Garden Club was brought up by
Rx H. Wood on basis of excess cost. W. L. Keck motioned, that the
wholesale rate shall apply as follows: $2.00 minimum charge for first
3,000 gallons and $.22 per thousand. -gallons in excess of minimum.
This action retroactive to March 12, 1962, and. billings, October 1,
1962 and thereafter, shall be withheld, pending absorption of over-
charge, if any.
Amendment to Section No. 1 of City of Smyrna Zoning Ordinance
(Page 7) under t1p sub -heading of "trailer use rerriilts" was author-
ized for publication and hearing date set for nctoaer 15, 1962 for
the purpose of acting on proposed amendrc-nt affecting trailer use
permits within the City of Smyrna. Motion, H. L. Smirch, second.

Council authoria_ed the building inspector find fire chief to
inspect and report by letter their recosn:aendations regarding repair

Councilman R. J. McCurry commented on Right of Way problem in
Gilbert Street which was called to council attention early in the
meeting by cittizens H. E. McCollum and v1. L. Black. Mayor J. B.
Ables requested R.J. McCurry and. H. E, Ingram meet with S. P. Hensley
and citizens affected to resolve rights of way and. tree removal on
Gilbert Street prior to curb and. gutter installation.
Councilman H. E. Ingram referred to prepar%ation of a letter
to State Highway Department requesting surveys, etc., in connection
with the widening of State Highway No. 3-through Smyrna, and. re-
questedhis motion of September 10, 1962, Page No. 1, Item No. 3,
be corrected. andentered in the minutes to read, as follows: "Motion,
H. E. Ingram - The Mayor and. Council advise the State Highway Depart-
ment of Georgia that the City of Smyrna will participate in the
acquisition of rights of way for the purpose of widening State High-
way No. 3 to a four -lane major thoroughfare through the City of
Smyrna and., further motioned, that this body request a survey be
made and submitted determining the boundaries of said. rights of way."
The motion as stated was seconded. by R. J. McCurry and voted. unan-
imous.
Mayor J. B. Ables appointed the following committee for follow
up on Urban Renewal: H. E. Ingram, chairman, R. J. McCurry, and
G. Conley Ingram,
