September 12, 1960
The regular meeting of Mayor and Council was held at City Hall, Smyrna,
Georgia on September 12, 1960 at 7:00 o'clock P. M., Mayor G. W. Kreeger presid-
ing, with all councilmen present.

The first item on the agenda called out citizens reports. As, there were
no citizens in attendance at the opening of the meeting, Mayor G. W. Kreeger in-
vited Mr. Hardy of the Portland Cement Association to address Council. Mr. Hardy
distributed literature, gave a short resume on the value of concrete sewer pipe,
and answered all questions directed.to him from council.
The council accepted a signed agreement to remove and grade an area at
Hawthorne and Gilbert Streets to correct a traffic hazard.
Council unanimously adopted.., on H. E. Ingram's motion and second by W. B.
Sanders, the ordinance drawn up by City Attorney to construct and install standard
type curb and.gutter on the north side of Oakdale Drive a distance of 320 linear
feet. Said improvement substantiated by petition signed by property owners re-
siding at 432, 434, 436 and 438 Oakdale Drive. Motion further sets the date for
hearing on October 3, 1960.
Council authorized City Attorney G. Conley Ingram to continue investigation
and/or interpretation of the Mackenna Contract to determine any obligation on
the part of the City for sewer lines and laterals in excess of 200 units as
called.out in the 1957 contract pertaining to landlots 700, 701, 739, 7403 and. 741.

Five sealed bids were received.f or one new garbage truck body. A question
from the Finance Chairman hinged on deferment of opening the bids by reason
of current finances. R..J. Austin moved this Council purchase one new garbage
truck to be used for the purpose of stand-by service. H. E. Ingram seconded
the motion. Councilman J. B. Ables amended the motion as follows:
The bids shall be opened and consideration given toward the purchase of
garbage truck and further, no action shall be taken until September 19, 1960.
On the amended motion seconded by W. B. Sanders, the vote was unanimous.
To select the garbage truck best suited for our needs. -Mayor G. W. Kreeger
appointed the following committee: R. J. Austin, W. B. Sanders, and R. J.
McCurry to report September 19, 1960.
Summary of 1959 taxes returned and considered uncollectible by the Marshall
of the Town was presented in Council. On H. E.Ingram's motion, City Hall was
authorized to write off all uncollectible personal property taxes estimated at
$730.00 and record taxes on all real property estimated at $275.00. Voted
unanimous on J. B. Ables' second.
The following action was recorded and. passed in the meeting as of above
date:
(a) Council authorized City Engineer to conduct survey for installation
of sewerage on South Atlanta Terrace and secure easements as required.
(b) Motion by H. E. Ingram, second. by W. L. Keck, all employees to be
placed under social security coverage effective January 1, 1961.
(c) Established on J. B. Ables' motion $25.00 annual license fee covering
.transportation of students by bus.
(d) Requested City Hall to reproduce the August 26, 1960 safety minutes
and.distribute to department heads.
(e) Authorized. City Hall to record. all unpaid paving assessments as
of December 31, 1960.
(f) Ordered City Hall to prepare and submit invoices to all citizens of
record including firms or corporations requesting reimbursement to
the City for installation cost -of sewer tap-ons in the amount of
$200.00 per tap.
(g) Instructed City Attorney to review all records and prepare letter
calling out original agreement regarding repairs to Cardinal Lake
' Manor lift station.

Engineer Sam Hensley submitted in Council the first phase covering general
provisions and classification of residential zoning, business districts, and in-
dustrial zoning and recommended the drafting of a comprehensive city zoning map.
Also in discussion were the requirements for a zoning board and the.necessary
ordinances. Council requested Mr. Hensley to report September 19, 1960 calling
out date of completion of City of Smyrna zoning map.
Council requested City Attorney to draw up amendment deleting the

Meeting of Mayor and Council recessed September 12, 1960 was called to
order at 7:`00 o'clock P. M. September 19, 1960 at -City Hall. Mayor G. W. Kreeger
presided, all Councilmen present except R. J. Austin.

In the first order of business, Council accepted on H. E. Ingramts
motion the application of H. I. McArthur to zone from residential to business
two lots known as 632 and'638 Concord Road located -in landlot 413. Motion
seconded.by R. J. McCurry and date of hearing called out as October 3, 1960.
City Attorney G. Conley Ingram spoke in Council referring to dis-
continuance of sewerage line installations and.services and the letting of con-
tracts to independent contractors to install, for the present time, said sewer
systems under city supervision and in accordance with accepted city policies.
Mr. Ingram mentioned certain inconsistencies in prevailing ordinances that were
in conflict with accepted -,policy of Mayor and Council as called out in the
finalized minutes dated.April 13, 1959 and August 8, 1960. Mayor and.Council
concluded to accept as read the following ordinance. (Motion R. J. McCurry,
second J. K. Chastain.)
ORDINANCE
NOW, THEREFORE, IT IS ORDAINED by the Mayor and Council of said City as follows:
1. That the minutes of the previous action taken by the Mayor and Council at
the August 8, 1960 meeting be amended to reflect the policy presently in
force and effect in the City with respect to the installation of sewer
taps and services and the payment therefor by adding thereto the following:
Paragraph 703 on page 20 of the City of Smyrna Land. Subdivision Regulations
is therefore and hereby amended by striking the following sentence there-
from: "The'City of Smyrna shall install sewer system within the development
at a complete cost of $200.00 per tap."'
and the following language is substituted.in lieu thereof:
"The sewer system shall be installed either by the City or by an independent
contractor under a contract with the City at a cost of $200.00 per tap to
the owner in addition to the actual cost of any pump or lift station that
the City may deem necessary for the effective use of the sewer system and
any rock excavation encountered, in the sewer installation. The owner shall
furnish the City surveys and plats showing streets, layouts and sewer line
profiles in the area in which sewer taps and service are requested and
same will be subject to approval by the City to insure that engineering
standards prescribed by the City for such projects are met. The estimated
cost of each sewer project shall be paid cash in advance by the owner at the
time of each request for sewer services."
2. That all ordinances, or parts of ordinances, heretofore enacted by the""
Mayor and Council of the City of Smyrna that are in conflict with this
ordinance be, and the same are, hereby repealed. MEMO: (See amendment dated
