The first regular meeting of Mayor and Council for September,
1962, pursuant to city charter, was held on September 10, 1962.
Mayor J. B. Ables presided and calledthe meeting to order at 7:00
P.M. Present: Councilmen H. E. Ingram, J. wd. VTebb, R. H. Wood,
W. L. Keck, and R. J. McCurry. Absent: H. L. Smith and J. B.
Rhodes.
+ There were no citizens present to report in Council per agenda
Item No. 1. Item No 2, application to re -zone a parcel of land in
L.L. 413-414 was deferred by reason of absence of petitioner.
Councilman R. J. McCurry reported on Hasty Grill and stated.
the requested certified audit supporting sales of food in excess
of malt beverage sales was not submitted per agreement. Motion by
R. J. McCurry: "In the absence of requested audit the privileged
malt beverage pouring license issued to Hasty Grill is hereby per-
manently revoked. at the address calledout per license record."
Motion seconded by H. Z. Ingrar,3 and carried unanimously.
Progress -Street Resurfacing Program
1. Mayor J. B. Ables signed prepared contract of Sam Finley,
Inc., covering Increment No. 1-A and Increment No. 2. on
basis of current and accepted unit prices of Increments
No. 1 and No. 3 as follows:
Tncrement No. 1-A 2.2 miles of paving $23,735.48
Increment No. 4.5 miles of paving $43,429.68
2. H. E. Ingram motioned. the street lighting installation,
Cherokee Road to Pat ivlell Road on North Atlanta Street
shall proceed per agreement and contract with Georgia
Power Company. Seconded by R. W. Blood and carried..
3. Council voted to participate in the State, Federal aid
program to widen Georgia No. 3 to a proposed four lane
highway through the city and further to authorize the
initial survey (by letter) with agreement to assist in
the acquisition of Rights -of -Way. Motion: H. E. Ingram,
second H. J. McCurry, carried unanimous.
4. Potion, H. E. Ingram, second R. J. McCurry: "We secureā¢
bids and set opening date of said bids on September 17,
1962) ( 7 :00 P.M.) for the grading of Ivagbee Street to a
maximum depth of eighteen inches, the linear footage
estimated at 400 feet . . Specifications submitted shall
include cost of replacing damaged utility lines. Motion
carried.
5. Councilman H. E. Ingrain requested additional man -power
to back -fill uncurbed strt_ets'. In discussion, R. H. Wood.
motioned (second: H. E. Ingra,-) to secure bid.s based on
subrittedspecifications for back -filling the shoulders
on repaved. and uncurbed stre ts. 1-:lotion carried.
6. In connection with other street problens to be resolved.
prior to resurfacing, council called out September 24,
1962, as the date for bid opening for v3hitfield, wlalker,
Fleming, Powder Springs, and Bank Streets.Specifications
are to be submitted through assigned. engineer.

7. Bids for curbing of Oakview Drive and one catch basin were
opened and read in Council as follows:

Motion by R. J. McCurry, second !:. L. Keck, to accept
low bid. of J. E, Lovern for 13" curb and gutter on both
sides of Oa view Drive L$1.68 per linear foot (total:
$2 91i50) (Memot Catch basin to be installed by same
contractor, cost of labor and material to be borne by
City of Smyrna and paid through Street Bond Fund.)
8. Property owners (2) on south side of Marston Street at
Gilbert Street intersection were permitted, per notion
of R. J. McCurry, to install curbing through private
contractor at their expense., the City to submit speci-
fications, inspection, supervision by city engineer, and
absorb cost of turn radius at above intersection. Noted

On R. J. McCurryts motion City Hall as authorized to write a
letter to Maxwell Easy Shop on South Cobb Drive requesting sewer
tap payment of $200,00 within ten days from above date, and stating
that unless payment was so received services will be discontinued.
Motion second.ed. by W. L. Keck and. carried.
On motion, R. H. Wood, second, R. J. McCurry, the date for
hearing on Jonquil Park Zoning was set for October 1, 1962.
Parks Department committee was authorized to secure bids for
Jonquil Park swirmaing pool to be opened. at City Hall October 8,
1962, on motion by R. H. Wood. Motion seconded by H. 9,. Ingram
and, voted, unanimous.
Appointment of legal representative to "Committee on Decent
Literature" was deferred.
In other action the Council: -
A. Authorized City Hall to resolve 1963 tax billings using
Burroughs Equipment and r-vised forms.

July 1, 1963.
C. Suggested, calendar year (for budgetary control) be
changed from calendar year to fiscal year ending June 30,
1963.
D. Authorized 1962 year end audit of 'city books be let -to
Napier, Hamric V, and. Company for an amount set at'$2,000.00.

a fund ( tem, porary) to reiribursc contractors for curb and.
gutter installations pending reimbursement as called out
in City Charter.
F. Requested. City to place barricades and signs in parking
lot allowing five minute parking for voters on Septem-
ber 12th (Election Day).
G. Heard. letters readin council by the Mayor relating to
complaint from Cobb County Health Department, First
Baptist Church, and a pending suit directed against
two Smyrna police officers for false arrest. All of V
the above were referred to comrjittee chairmen for
action.
H. Requested. three d.epartnent heads to attend conference on
water and, sewerage to be conducted. by Georgia Tech during
current week.
