The regular mid -month meeting of Mayor and. Council was held at City Hall July 16,
1962 and called to order at 7:00 o'clock P.M. Mayor J. B. Ables presided. All
council members present except J. B. Rhodes.
The first order of business per submitted agenda, called out curb and gutter
hearing in area No. 1-A representing the property fronting or abutting on the following

Mayor, Council and Engineer S. P. Hensley discussed with citizens present the unit
cost of the improvement by streets. The result of the one hour discussion hinged,
entirely on the unit cost per linera foot in excess of submitted estimated cost as
reported in a letter to all citizens in the affected area dated June 30, 1962.

The petition yepresenting 60% of Sharon Circle property owners.in favor of the
improvement was declared a dead issue by reason of verbal requests by affected
citizens to withdraw their name from accepted petition. Action came when Councilman
R. J. McCurry motioned as foli.ows: "We recess the hearing of this date (7-16-62)
to July 302 1962 at 7:00 o'clock P.M., to allow sufficient time to secure four or
more sealed bids covering firm contract price for curb and gutter improvements on the
streets called out in increment (1-A)" and further motioned "That letters be mailed
notifying and directing all citizens of area (1-A) to be and appear at City Hall
July 30, 1962 at 7:00 o'clock P.M. at which time and place all sealed.bids will be
opened and read in council." The motion seconded by H. L. Smith and was voted unanimous.
Motion R. J. McCurry seconded by H. L. Smith that: "City Hall mail letters to all
property owners in area No. 2 stating the schedule hearing on curb and gutters is
hereby postponed from July 23, 1962 at 7:00 o'clock P.M. to July 30, 1962 at
7:00 o'clock P.M. at City Hall." Change in hearing date required to allow additional
time to secure four or more sealed bids covering firm contract price for curbing
the following streets:

BUILDING PERMITS - COMMERCIAL
(1) Standard Oil Station, South Cobb and.Cherokee•Road, add two bays on south
side. On motion, H. E. Ingram, second H. L. Smith the permit was granted.
(2) Laundrey Pick -Up Station -new construction north end of Jonquil Plaza.
Building permit granted on motion, H. E. Ingram, seconded. H. L. Smith.
(3) Cabinet Shop -new construction rear of W. P. Stephens Lumber Company.
L.L. No. 559. Permit granted per plat submitted on motion, R. J. McCurry and
seconded by H. E. Ingram.
(4) Pure Oil Station -new construction located at northeast intersection of
Powder Spring Street and South Cobb Drive. Motion by H. E. Ingram, seconded by
R. H. Wood. "We approve the permit for the Pure Oil Station subject to modification
of the plans to call out a four foot cement sidewalk and curbing along the Powder

Pure Oil Property on the north side of Powder Springs Road'. Vote on the above
motion was unanimous.
(5) Motion: H. E. Ingram, seconded by R. J. McCurry: "We grant permit for a
two bay addition to the existing structure of Tenneco Oil Station located on
South Cobb Drive and Joneshaw Road, provided a city building permit is secured and
City Business tax is paid by the contractor." Noncompliance to the motion within one
day will result in police action stopping all construction on the premises. The'
motion carried.
Council discussed street paving increment No. 3 and authorized on motion by
H. L. Smith to extend the ,Sam Finley Inc., contract into increment No-3 based on
unit price per record (Increment No.l) and the submission of performance bond.
W.L. Keck seconded the motion which carried.
The following resolution approved, on motion by R. J. McCurry, seconded by
H. E. Ingram as follows:
"Resolved, that Bank of Smyrna is hereby designated as the depositbry.-of''City
of Smyrna and that checking accounts be opened and maintained in the name
of -City of Smyrna -Street Improvement Bond Mind- and -City of Smyrna -Parks
and ecrea ion Bond Fund, and further-motioned.Ehat any two of three D. t e

receipts or orders for payment or withdrawal of funds deposited to the
credit of the City of Smyrna"
Council authorized investment of all bond funds in excess of requirements
for current contracts in United.States Treasury Notes, the Maturity dates of said
investments to coincide with completion dates of approved contracts. Motion by
R. J. McCurry, seconded by W. L. Keck. The motion carried.
Council voted on H. E. Ingram's motion to withhold all building permits requested
by ;(McNeal-Fett) on San Fernando Drive pending acceptance by City Engineer or
correction of street drainage problems. Motion seconded by R. J. McCurry.
Councilman R. H. Wood reported closing the W. S. Peacock property (Lake Park)
was scheduled for July 18, 1962; the Brown and Tatum property scheduled closing
date was set for July 21, 1962. Amount required at closing is $44,000.00 less
option, revenue stamps and pro -rated taxes.

Motion by H. L. Smith seconded by H. E. Ingram: "Due to shortage of manpower
in Police Department, pay acting Chief Herbert E. Brown, cumulative 1962 vacation
days earned in lieu of time off" The vote was four to two; J. W. Webb and
W. L. Keck voting against. Motion carried.
Motion by R. J. McCurry, "Pay Elmer Wester, Sewerage Treatment Plant supervisor
full 1962 vacation earned''in lieu of time off. The motion carried five to one.
MEND (All payroll records and documents supporting above action (H.E. Brown and
Elmer Wester) shall carry marginal entry for audit purposes.)
Item No. 10 and Item No. 11 of agenda; June minutes and Health Center deferred.
R. J. McCurry authorized on motion to declare surplus and dispose of office
appliances not required of acquisition of Burroughs Accounting Machine. Unanimous.

(G) On R. J. McCurryts motion authorized city attorney, G. C. Ingram to report on -
all ordinances in violation by peddlers on North Atlanta Streets, and further to
revoke and.refund.business license tax paid to the City and instruct police depart-
ment to act on the reported results.
(H) Mayor J. B. Ables read in council a letter from Hensley and. Associates, Inc'.
relating to sewerage fees collectible per agreement,(of7-20-60) in the construction
of the joint project and out -fall line west of the City on Church Road in South
West Cobb County. All action and/or connections to this facility, the fees payable
and policy for collection of same, were; per Mayor J. B. Ables recommendation,
referred to councilman W. L. Keck for resolving and reporting on this joint agreement.

Under Item�•No. 1 "Citizens Reports", Mr. L. G. Turner requested Sanford Place
be closed to traffic from 5:00 P.M. to closing during State Play-offs of the Pony
League scheduled August 6th through August 9th 1962. Motion R. H. Wood, seconded
R. J. McCurry - Motion carried.
