A regular meeting of Mayor and Council was held at City Hall on
Monday, June 24, 1963 at 7:00 o'clock P. M. Mayor J. B. Ables pre-
sided, and Councilmen R. J. McCurry, R. H. Wood, James W. Webb and
John C. Porterfield were present. Absent:- H. L. Smith, W. L. Keck
and J. B. Rhodes.
Mr. Howard Winslett, representing the Smyrna Junior Chamber of
Commerce, brought a request that the week of June 29 through July
69 1963 be declared Soap Box Derby Week. Mayor Ables read and
signed a proclamation to that effect.
Mr. R. H. Hicks of 183 Sanford Road appeared relative to his
appeal of the,1963 tax assessment. Mr. Hicks also requested some-
thing be done about the ditch in front of his house. The first item
was covered in the Mayor's letter of June 21 designation procedure
for appeal of,1963 tax assessments. The second item was referred
to Councilman John C. Porterfield for examination and recommendation.
A motion was made by R. J. McCurry seconded by R. H. Wood to
waive the $20b.00 balancedue for sewer tap fee for the Aiken
Building at 145 West Spring Street, such action adjusting the
original charge from $1,200.00 to $1,000.00, with the condition
that an additional charge of $200.00 be made at such time as an
increase in,the number of tenants should occur. Voted unanimous.

Dr. W. V. Patterson, representingtthe Conwick Corporation,
appeared on behalf of the corporation's petition to rezone their
properties from R-1 and R-2 Residential to C-1 local commercial area.
No citizens appeared to protest the rezoning. Motion byz.R. J.
McCurry, second by James W. Webb, to rezone the Conwick Corporation
properties'as,advertised from R-1 and R-2 Residential to C-1 local
commercial restricted to include:- auto sales room, bakery, bank,
barber shop, beauty parlor, catering -and delicatessen, florist,
restaurant (but not including night clubs or places where amusements
and recreation are incidental), theaters (but not drive-in theaters)
studios of artists and photographers; all other businesses not
specifically mentioned herein are to be omitted. Voted unanimous.
In action on the petition of G. R. Barnette to rezone the Henry
Fortner property, no citizen appeared to protest the rezoning. R.
J. McCurry moved to rezone the property known as the Henry Fortner
property, 488 Glendale Place, (Parcel 37 in landlot 376) from R-1
Residential to R-2 Residential, Multiple Family Housing - restricted
with the condition that the buildings now on said property shall be
dismantled. Second by R. H. Wood. -And voted.unanimous.
A request by Mr. G. R. Barnette for a building permit for apart-
ments on the Henry Fortner property at 488 Glendale Place subject to
approval of plans by building inspector was denied on the basis
that preliminary plans only had been submitted to council for their
examination.
Bids on construction of sidewalks were opened and recorded as
follows: - i

J. E. Lovern Construction Co:, Smyrna, Ga. $349565.00
A motion by John C. Porterfield seconded by R. J. McCurry to
accept low bid of J. E. Lovern Construction Company was withdrawn
after discussion. A motion by John C.'Porterfield seconded by
R. J. McCurry to accept the low bid of J. E. Lovern Construction
Co. subject 'to deletion and deduction for Item 9, "Headwalls", and
Item 10, "Tree Removal", with these twoitems to be negotiated, cost
not to exceed that outlined in the original bid, was carried by
unanimous vote. 1
John C. Porterfield, to whom bids had been referred at previous

meeting, reported the Contracts Committee recommended purchase of
International Model #3414 Diesel Tractor with Front End Loader and
Backhoe. Motion by Councilman Porterfield, seconded by R. H. Wood
to purchase said equipment from low bidder, Marietta Truck &
Implement Co. for the sum of $6,300.00, to be disbursed from the
Water Revenue Fund surplus. The vote was unanimous.
On a motion by John C. Porterfield, seconded by R. J. McCurry,
the council voted unanimous to employ the services of Mr. Paul
Brown to represent the City in tax appeals at a flat fee of $500.00.
Mayor J. B. Ables read a letter from Attorneys Hicks and Howard
representing the Rust Cheese Company on South Atlanta Road, the
latter formally petitioning the City for annexation to the corporate
limits, provided that in the near future said property can be tapped
on to the sanitary sewer system of the City of Smyrna, said request
accompanied by a legal description of the property. Motioned by
James W. Webb, seconded by R. H. Wood the property of Rust Cheese
Company per submitted request be annexed to'the corporate limits
of the City of Smyrna subject to all applicable codes, ordinances
and regulations of the City. Further motioned above annexation
is made in accordance with existing zoning of Cobb County and that
1964 city taxes are payable, or an amount equivalent thereto for
services rendered. Voted unanimous.
A request from J. A. Bailey for a building permit for the
Conwick Corporation was granted subject to approval of plans by the
city building inspector. Motion by R. J. MCCurry, second by James
W. Webb and voted unanimous.
