May 23, 1962
The continued meeting of Mayor and Council was held at City Hall above date and
called to order by Mayor J.B. Ables at 7:00 o'clock P.M. All councilmen were present.
Approximately 125 citizens from Ward No. 1 and No. 2 appeared at the council meeting
in protest of plans to build a concrete mixing plant'' -in the area south of Corn Road and
east of the railroad right-of-way. The area was established as early as 1951 as an
industrial site and re -affirmed in the Comprehensive Zoning Ordinance of 1960 as an indus-
trial district as' called out in Section 9, Item 10, Palg 18 of the City of Smyrna Com-
prehensive Zoning Ordinance. Various spokesmen for the protesting residents claimed de-
valuation of property, -excess dust, noise and damage to the city streets and requested
that council rescind previous action of granting permit and issuance of city business
license to Isley"and Sons of Powder Springs, Georgia.
Action came after the three hour debate on a motion by H.E. Ingram which authorizes
the notification by letter to, the company, Isley and Sons,, of an existing ordinance which
prohibits the use of vehicles passing through the City of -Smyrna weighing in excess of
10,000 lbs. either loaded or unloaded and calls out the designated streets as direct truck
routes. A further requirement of the motion designates and entrance and exit across the
railroad tracks to South Atlanta Street. Second, W.L. iSeck.and voted unanimous.
The second motion lost 5 to 2 when Councilman J.W. Webb moved that we revoke the
building permit pending further investigation regarding truck capacity and other state-
ments in a previous council meeting by Isley and Sons' representative.
The third motion concerning the proposed industrial operation was made by J.B. Rhodes
as follows: "All plans, specifications and other details of the plant or plants shall
besubmitted to the building.inspector together with drawings of all the buildings and-
saidbuildings and/or operations shall be 98% dust proof and 98% sound proof and further
that all evidence of meeting said specifications shall be approved by the City Engineer."
The motion was seconded by J.W. Webb and voted unanimous.
Mayor J.B. Ables and Robert Huntemann spoke to.the assembled crowd on the urgent
need of Boy Scouts leadership in the greater Smyrna area together with the cost of this
professional assignment. Councilman J.B. Rhodes motioned that the City Donate $250.00
to the Boy Scout 'project. The motion carried and was rescinded on motion by W.L. Keck,
second, R.J. McCurry on the basis that the city cannot legally contribute to civic or-
ganizations. The vote to rescind was 5 to 2.
Three citizens, Messrs. Hammond, Strayhorn and Hunter spoke in Council and referred
to the problems in the area of Cobb Park called out in previous minutes. Action -to
resolve the problem was referred to the parks committee on recommendation of Mayor J.B.
Ables.
A letter read in council requested the installation of a manhole at the end of the
existing sewerage -facility -on Spring Drive. The manhole was deleted in 1960 pending
further information on the proposed improvement of the additional 130 lots. Motion by
J.B. Rhodes authorizes the installation and engineering and the contractor to build one
manhole in the area desinnated. Second J.W. Webb and noted unanimous.
Council, on H.E. Ingram's motion and H.L. Smith's second, set June 4, 1962 at
7:00 o'clock P.M. as the date to receive and open bids in connection with the sale of
$760,000.00 General Obligation bonds.
In the next order of business council called for'the'hearing in connection with the
appeal of Buford Fergerson, case #3341 and #3342. 'The'appeal resulted from charges of
driving under the influence and speeding 50 M.P.H. in a 30 M.P.H. zone: The Recorders
Court upheld the charges and imposed a fine on both counts. Appearing for the defendent
Attorney J.A. Cochran; for the City, Conley Ingram. Witnesses for the city, Sgt.
J.L. Edge and Officers R.L. Chandler and T.T. Bates. Appearing for the defendent,
George King, A.B. McWhorter, Duncan S. Goss, Hubert W. Gilley and Buford Fergerson.
The proceedings centered mostly on Georgia State Law, Code 68-1625 which refers to man-
datory blood tests for alcoholism upon request. Attorney J.A. Cochran moved for dis-
missal stating his client was denied his legal right in accordance with state laws of
Georgia. The two hour hearing ended when J.B. Rhodes motioned that his council vote
to dismiss the charge of driving under the influence and -further that the speeding charge
shall stand. Seconded by H.E. Ingram, the motion carried 5 to 2.

R.J. McCurry motioned, seconded by H.E. Ingram that a certificate of agreement be
drawn between the City of Smyrna and the Bank of Smyrna to pay the principal amount
($7,793.26) plus interest at 5% for payment for one 20 cu. yd. Pak Mor garbage unit
mounted on one 19623 C-800, Ford Chassis and further motioned that the Mayor and
Clerk of the City of Smyrna shall sign -the first note dated May 24, 1962 and all succeeding
notes. Voted unanimous.

A meeting of Mayor and Council was held at City Hall above date and called to
order at 7:00 o'clock P.M., Mayor J.B. Ables presiding and all Councilmen present
except W.L. Keck.
The purpose of the meeting was to complete items called out on the agenda of
May 23, 1962 in which meeting the time was absorbed in the controversy hinging on a
concrete mixing plant in the industrial area of Corn Road and an appeal from the
recorder's Court.
In the first order of business the council discussed the street improvement
bond issue program and petitions concerning curbs and gutters.
Council approved the signing of six months extension to the.Southern Meter
Company contract at the current price per unit.
Councilman J.B. Rhodes referred the additional Bohannon Creed plant drying
beds and the construction cost to Hensley & Associates and Elmer Wester for
recommendation and report.
C ouncil discussed the wage scale submitted by thQ committee assigned and
agree to accept their recommendation, stating that it was a step forward covering
the overall city personnel. The pay scales and classifications were adopted by a
5 to 1 vote, J.W. Webb voting against, on motion by.R.J.McCurry, seconded by J.B. Rhodes,
with the following changes:
1. Change Receptionist classification grade from•6'to 7.
2. Change Mrs. Melvin job title to Junior Accountant.
3. Change Administrative pay scale step increase from present 4th to 5 years.
4. Put pay scale into effect July 1, 1962 as follows:
