Continued meeting -,,of Mayor and Council was held and called to order
above date at City Hall at 7:00 o'clock P. M. Mayor J. B. Ables presided,
all council members present except H. E. Ingram.
In the first order of business, petition was submitted by J. M.
Gibson requesting rezoning of his acreage from R-1 residential to R-2
multiple housing. Petition accepted and on motion by H. L. Smith,
February 4, 1963'was set as the date for public hearing. Second by
R. J. McCurry and voted unanimous.
R. J. McCurry motioned toast date of public hearing at February 4.9
1963 at 7:00 o'clock P. M. to amend Comprehensive Zoning Ordinance setting
up and calling out that each rezoning petition shall state a particular
type of structure and business and further the erection of a sign on all
property subject t6 rezoning shall be placed thereon during the period of
publication (15 days) up to and including date set for public hearing.
It was recommended to establish classifications as 10 -1 Restricted" or R-2
Restricted". Motion seconded by J. B. Rhodes. Voted unanimous.
Petition for one chair beauty shop was submitted, accepted and permit
granted on motion by R. J. McCurry, second by H. L. Smith. Motion states
that no sign shall be erected on the property of petitioner, Mrs. W. L.
4� Fowler, Spring Road, Rolling View Acres. Unanimous vote.

4~' Petition submitted by Mrs. A. M. Turner, 236 Sherwood Road, requested
operation of drapery workroom in above residence. Council discussed
petitioner's request and granted permit•on motion by H. L. Smith, second
by R. H. Wood. Voted unanimous.
Request of Rev. Alvin C. Ellerbusch to move house trailer (Body only)
on church premises for purpose of storage of church and office equipment.
Council, on motion by R. H.. Wood, granted permit for one year and in
compliance with 1962•amendment to trailer ordinance. Second -by H. L.
Smith, Unanimous. -
Mr. Forest Mangum 4peared and spoke in council with reference to
control of transient photographers and the attitude of City Hall Staff
regarding, per Mr. Mangum, a failure or cooperation in calling out his
company as a -licensed studio,in the city. MEMO:- City Hall policy
prohibits any information relative to verbal requests for recommending
business establishments in the city and denies all requests for facts,
records, etc. pertaining to or affecting our citizens.
Motion by R. H. Wood, second J. B. Rhodes., to change present business
telephone at Public Library to limited service only.
Council discussed operating budgets covering six month period ending
June 30, 1963 and tentatively called out proposed budgets for all depart-
' ments except Police, Fire and Civil Defense. Deferred to January 21,
1903 meeting.
Councilman R. J. McCurry passed out for discussion, proposed ordinance
covering business license tax applicable January 1, 1963 for professional
occupations and insurance companies. On motion by R. J. McCurry, seconded
by W., L. Keck, the following ordinance was adopted the 16th day of January,•
.1963 effective retroactive to January 1, 1963. Vote on the motion was
.five to one:- for adoption, H. L. Smith, J. B. Rhodes, R. H. Wood, W. L.
Keck and,R. J. McCurry. Abstain, J. W. Webb.
ORDINANCE
That this,Mayor and Council adopt this ordinance providing for the
following Business License Taxes for business transacted in the City of
Smyrna for any calendar year beginning January 1, 19,63 and thereafter,
'Ghat on and after the effective date hereof, it shall be unlawful.for any
person, corporation or company, to begin or carry on any of the occupations,
uses, or businesses hereinafter mentioned in the City of Smyrna without first
having applied to the Clerk of said City and obtaining a license for carrying
on each said business or occupation as may be subject to City of Smyrna
business license tax, occupation, or use license tax, provided further that
each Professional occupation presently carried on in the City of Smyrna
shall have thirty (30) days from this date in which to secure said license
in accordance with this Ordinance. Any violations of this ordinance shall
be punishable at the discretion of the City Recorder up to and including
the maximum penalty provided in the Charter of the -City of Smyrna.

As to each person, maintaining his or her principal office within the
corporate limits of.Smyrna, Georgia -in which he conducts in his or her occupa-
tion as a practitioner of law, medicine,,osteopathy, chiropractic, chiropody,
dintistry, optometry, podiatry, masseur, public accounting, embalming, civil,
mechanical, hydraulic, electrical engineering, architecture, not exempt by some
other applicable law.

Plus two (2) per -cent of all gross premiums collected excepting that
portion pertaining to Life Insurance, gross premiums meaning the amount paid
by the assured before and without any deductions for commissions to agents
or any dividends paid to the policy holder. Insurance policies containing
Life issued in conjunction with any other type insurance shall be subject to
2% on all premiums collected exclusive of the portion applicable to the Life
insurance.
4wr The fee of $75.00 shall be applicable January 1, 1963. The 2 of premiums
collected during the calendar year of 1963 shall be payable during the month
of January 1964 and each January thereafter, and such shall be with a statement
submitted to the Clerk of the City of Smyrna showing the gross amount of
premiums collected during the preceding calendar year. If any Insurance
Company discontinues -business in the City of Smyrna during any calendar year,
such company shall forthwith submit said statement and pay the 2% of the gross
premiums collected.

Discussion on out -of -city fire protection resulted in the following motion
by H. L. Smith:- "I move we discontinue fire protection for all residents
located in Cobb County and not within the corporate limits of the City of
Smyrna effective February 1, 1963.11 Seconded by W,. L. Keck. Voting for dis-
continuance.:- H. L. Smith, R. J. McCurry and W. L. Keck. Voting against
discontinuance:- R. H. Wood, J. W. Webb and J. B. Rhodes. ,The motion lost,
Mayor J. B. Ables cast the tie -breaking vote against the motion.
On R. J. McCurry's motion the non-resident fire registration rate was
set at One Hundred Dollars ($100.00) per dwelling with provision that seventy-
five percent participation is secured. Motion seconded by J. B. Rhodes which
carried five to one, J. W. Webb voting against.
A motion was heard to recess.

Continued meeting of Mayor and Council was held at City Hall above date and
called to order -,at 8:•30 o'clock P.M. by Mayor J. Be Ables. The Mayor, due to
illness, was excused following his announcement that Councilman Harry. E.,Ingram
was named "Citizen of the Year't by the Smyrna Civitan Club. Mayor Pro-Tem H.E.
Ingram presiding Faith four council- members present:- H. L. Smith, R. H. Wood,
W. L. Keck and R. J. McCurry, Absent:- J. W. Webb and J. B. Rhodes,
Citizen Harold Anderson, 754 Old Concord Road requested zoning of his
property from R-1 to R-2 for garage type apartment structures at rear of property.
Council accepted request on motion of H. L. Smith, second by W. L. Keck and set
date for hearing on February 18, 1963 at 7.-00 P.M. MEMO: Front area of property
has income units thereon. Hold advertising pending receipt of costs and legal
description. Check out proposed rear building line tia.th existing sewerage
easement.
Mr. T. L. Dickson's request for street lights in shopping center area was
held in abeyance pending action on widening of South Cobb Drive. Referred to
Street Committee.
Council authorized Georgia Power Company to proceed with installation of
110,000 volt transmission line dlong north side of Cherokee Road. Delayed action
on the project resulted from negotiations with citizens. Motion to proceed,
R. H. Wood,.sedond by R. J. McCurry.. Voted unanimous.
