The regular meeting of Mayor and Council was held October 6, 1958, 7:00 P.M.
at the City Hall. Mayor J. M. Gibson presided, and the following Councilmen
were present: Messrs. J. B. Ables, J. V. Brooks, L. C. Dodd, G. W. Kreeger,
J. B. Rhodes, W. B. Sanders, and R. H. Wood.
Meeting called to order. First item on.agenda covered citizen reports.
Mrs. Betty Lou Waites requested council action on installation of drainage
pipe at rear of yard on Ventura Road. Upon removal of cyclone fence, Mr. Ables
stated he would schedule the job.
Water drainage at rear of new City Hall to the H. G. Poss building was
brought before Council. Mr. Poss claimed surface water drainage would eventually
seep through foundation of his building. He also called out water pressure.
problem in the 300 block area on Lee Street, On J. B. Rhodes motion and G. W.
Kreeger's second, Council unanimously voted corrective action to•.relieve drainage
problem and requested Councilman W. ' B. Sanders to investigate low pressure com-
plaint on Lee Street.
Other problems were called out, mostly on drainage. Mr. L. W. Boring re-
quested Mayor and Council action on dogs running.in phacks, and suggested legal
steps to enforce inoculation and impounding all,6trays on unscheduled inspection
tours.. Upon request, ordinance. pertaining to dogs running at large dated
June 2, 1958, was read in Council. On this date Council adopted two sections
.of a five part ordinance. Councilman J. B. Rhodes motioned to amend ordinance
to include section No. l and Section A1o. 3., Amendment passed six to one on
R. H. Wood's second. 4
Revised ordinance dated 10-6-58 and effective 11-1-58 adopted on motion
by R. H. Wood. Seconded by J. B. Ables the vote was, for adoption:: J. B. Ables,
J. V. Brooks, L. C. Dodd, J. B. Rhodes, W. B. Sanders, and R. H. Woo .a Voting

Councilman G. W. Kreeger motioned to accept as read the finalizedminutes
covering the three council meetings held during September, 1958. On J. V. Brooks
second, the vote was unanimous.
The problem.on unsecured easements holding up the Northcutt Sewer Project
was a step nearer completion when Council accepted concessions requested by
affected property owners. The hold-up involved property owners outside the
City limits with demands for free sewer taps in lieu of .rights granted the city
to cross their property. Action came when G. W. Kreeger moved to place authority
in City Attorney G. C. Ingram to record all easements. On W. B. Sanders second,
the vote was unanimous. - ,
Progress on conversion,, old city hall to jail and Police headquarters was
called out as "on schedule." Police Chief M. L. Robinson and Mr. P. E. Abercrombie
were authorized to move radio to new location at no expense to city. Motion by
J. V. Brooks, seconded by J. B. Rhodes. Voted unanimous.
Survey and report on over-all drainage problems was�in�progress per J. B. Ables
and Robert Sutton.
On Accounts payable, General Fund -covering September purchases, Mr. L. C. Dodd
motioned to pay all properly documented bills. Voted unanimous on J. V. Brooks
second. w ,
Submitted report on current bank balance showed $500.00 in Water and Sewerage
Extension Fund as of 10-6-58. Councilman L. C. Dodd recommended that this Council
transfer $6,000.00 from General Fund to Water & Sewerage Extension Fund to meet
current obligations in the amount of $5,900.00 representing September purchases
of pipe, fittings, meters, and recurring parts and repairs.. On motion by L.,C.,
Dodd, seconded by G. W. Kreeger, the vote was unanimous. (This transfer of funds
dated October 7. 1958 shall for the purpose of this record be reversed at the
proper time.)
Mayor J. M. Gibson called out the following Councilmen: G. W. Kreeger,
L. C. Dodd, and Electrical Inspector L. W. Boring to report to council on Christmas
lighting costs in the business area. Suggestion was made to call in Chamber of
Commerce and all merchants to assist and defray the costs involved.
Referring to prior council action, W. B. Sanders accepted assignment to
secure facts and determine the action and discussion which prompted the Chamber
of Copm►erce in their petition to widen Atlanta Street.

Although sinking funds were established to retire principal and interest on
,municipal funded debt., it was discussed whether -surplus in'these accounts could
be transferred "brokers agreeing".to the -General Pund., Extension., --or Construction
Funds. It was suggested that audit of funds be submitted as well as advice from
paying agents. I < . e . f.
G. W. Kreeger excused 9:00 P.M.
On the result of a prepared nine months analysis of fnspection fees
covering building., electrical, and plumbing., J. B. Ables moved to allow the City
to withhold 10% of the plumbing fees effective November 1., 1958. Unanimous
vote on R. H. Wood's second.
Letter from Cobb County Health Department read in Council by Mayor
J. M. Gibson referred to swamp area near.Hughes Street. Hensley and Associates
authorized to check area and transmit, the result of their investigation to Cobb
County Engineer.
Mr. S. J. Lindsey submitted legal description of property and requested
annexation into City of Smyrna with stipulation that present Cobb County water
service be continued. J. V. Brooks and W. B. Sanders will.report on this request.
J. B. Rhodes motioned to accept property into the City subject to satis-
factory contractual agreement between Mr. Lindsey., W. B. Sanders., and,J.V.,Brooks.,
and that all regulations are in compliance with existing ordinances, and further
that 1959 taxes are collectible or equivalent thereto for city services rendered.
The vote on annexation was unanimous., Mr. J. V. Brooks seconded the motion of
Councilman J. B. Rhodes. I ,
Tabled by J. V. Brooks was the estimate of material cost ($2.,314.00) to
.repair.front-end loader. Labor would bring total repair costs in excess,of.
$5,000.00., Trade-in on reconditioned loader would equal cost.of .labor and
material to repair the present equipment: . �^

STREET PAVING ORDINANCE
Paving ordinance recorded in finalized minutes of April 12., 1958 was
read in Council. Mr, Sam Hensley, Consultant Engineer, prepared and submitted
for this meeting an amended ordinance calling out Type No. 1., 2, and 3 paving
specifications. Type No. 1 paving being. the same -specifications as called out
in ordinance recorded and enacted by Mayor and Council in meeting April 12,1958.
Type No. 2 and'No. 3 are alternative specifications to be used on new city
streets., requiring the approval`of City'Engineer before installation. Council
adopted as read the amended ordinance on motion of J. -B. Ables and second by
R. H. Wood.
Amendment requested by Mayor Gibson that copies.of ordinance dated
10-6-58 be mailed to all builders and developers was put in motion by J. B.
Ables,, seconded by J. B. Rhodes, and voted unanimous.
L. C. Dodd moved, R; H. Wood seconded to write off Fi Fas on back taxes
#1469,.. #1593,, and #1695. Voted unanimous. t
Prior to adjournment, J. B. Rhodes suggested that street improvements.
could be accomplished by setting aside two (2) mills of recent tax increase for
a bond issue which through referendum would yield $20,000.00 per year towards
retirement of a Federal loan in the amount necessary. to -initiate such a
program. Mayor J. M. Gibson appointed himself.. J.-.B. Ables,, and.J. B. Rhodes
to work out a plan on this problem with no tax increase to the citizens.

DEDICATION - SMYRNA CITY HALL
OCTOBER 18, 1958
For the record covering 1958 minutes of Mayor and Council, the following
shall became part of the finalized minutes and attached thereto::
Invitations were mailed October 9, 1958, to State officials and the Mayors
and Councils of Cobb and adjoining counties to attend christening ceremonies of
the new Smyrna City Hall. Invitations to merchants and citizens of Smyrna
and to all friends in Cobb County were issued through press releases.
SCHEDULE OF EVENTS: -
A rare Bible, Bruce Rogers, one of the first printed in the King James
Version was presented to Mayor J. M. Gibson for the citizens of Smyrna
by Mr. W. A. Ward at 11:00 A.M. Reverend John H. Knight dedicated the
Bible to the City in the presence of citizens assembled in the new
council chamber. '
The Smyrna Legion Color Guard donated an American Flag, which was raised
during colorful ceremonies at high noon.
State officials were in attendance, and Lieutenant Governor -Elect
Garland T. Byrd selected the subject "Self. -Government" for his twenty
minutes dedication address.
Guests were greeted by Mayor J. M. Gibson and Council and escorted
through the new building by the following staff personnel:: Mrs:'Elaine
Davenport, Mrs. Katherine Melvin, Mrs. Ethel Silvey, and Mrs. C.D. Williams.
All visitors were invited to visit the old city hall converted to a new
jail and Police headquarters completed by Mr. W. W. Kidd October 17, 1958,
The Administration expressed appreciation for the flowers received, and
especially to the following citizens who contributed to the success of
the dedication ceremonies: Mrs. George P. McEntire, Mrs. Frank Lacey
Mrs, E. A. Monroe, and Mrs. E. L. Hoepner.
Prepared, typed, and accepted as read by Council during meeting held at
City Hall November 3, 1958. This article is not to be construed as minutes
of Mayor and Council but rather a permanent record calling out progress of
the current administration.
