07-14-1958 Continued Regular Meeting0 July 14, 1958. The regular meeting•held July 7, 1958 was recessed at•11:15•P. M. and continued to July 14, 1958 at the City Hall, Mayor J. M. Gibson presided. All councilmen were present except Mr. W. B. Sanders. The first order of business covered citizen reports. Mr. J. G. Samples, spokesman for a group representing Cheney Woods) complained of a drainage problem,in the area of Stonecreek Road. On his report of two to three inches of water after abnormal rainfall, Mayor Gibson stated that a test of gravity flow would be made and referred problem to City Engineer,. Mr, Sam Hensley to consult with county and state engineers if another opening under South Cobb Drive will, solve the problem. I On Mr. G. W. Kreeger's recommendation, Mayor Gibson and Sam Hensley will investigate storm sewer problem at 572 Ventura Road as reported by Mr. & Mrs. C. G. Waites. It was brought out that 100 ft. of 141, pipe was needed to proper- ly drain this property. MEMO: Easement dedicating land to the City towards solution of this drainage problem received and filed at City Hall. fin ordinance pertaining to storm.sewers and drainage problem was presented to Council by Mr. J, B. MEMO: Ordinance on drainage to be submitted to all builders and sub dividers prior to issuance of building permits and upon receipt of plats. Revisions to ordinance pertaining to stabling of horses, cows, pigs or goats in the City of Smyrna was read by Attorney G. Conley Ingram. Accepted as corrected on motion of Mr. G. W: Kreeger. Seconded by Mr. J. B. Rhodes. Unanimous. Mr. J. B. Rhodes motioned the purchase of new street signs and•posts be left to the discretion of the Department Head. On L. C. Dodd's second, the vote was unanimous: 4 In the discussion of business license ordinances (referring mostly to City x� Hall contractors) Councilman J. B. Rhodes motioned to collect fifty per cent of annual license fee on all merchants starting business on or after the half - year mark. Seconded by J. V. Brooks. Voted unanimous:- - A statement for professional services in the amount of $750.00 covering injunction suits (Robert Lewis and Southland.Ice Co. VS City.of Smyrna,,Cobb Superior Gouts) was presented for payment. Motion to_pay by L. C. Dodd. Seconded by J. B. Rhodes. - Unanimous, On a vote of five to one, Council waived the tax penalty charge on citizen Lawrence Langley, based on his letter calling .out .reasons for failure to' return 1958 taxes, Councilman J. B. Ables referred to the high cost of street repairs and requested a paving appropriation of $18,000.00, In the discussion that followed, Mayor.J. M. Gibson indicated the City -may receive a one cent per gallon return on State Gasoline Taxy effective July 1, 1958. If this legislation is passed all refunds to the City will be earmarked for street improvements per Mayor Gibson. Mr. Sam Hensley reported land .use study.and .related _maps .were _in .process in connection with Federal million dollar loan. Sewer line and lift station for the Baptist Church improvement was referred to Mr. J. V. Brooks and Mr. R. H. Wood for solution. Council rejected request (per letter to E. Mayor J. M. Gibson presided and stated the special meeting was called to discuss and solve the Northcutt easements in South Atlanta Street area; the,settlement of the A. V. Conley Ingram stated Federal Government (grant) requires certified records on all lands dedicated to City for easements through properties involved. This means, per Mr. Ingram, a thorough check of deeds to determine mortgaged property. Mr. Ingram discussed the Brawner properties and reported concessions mentioned in lieu of sewer lines Grassing the hospital property. He requested a definite proposal must come from Council on South Atlanta area sewer tie-in.. L
