Continuation of June 10, 1960
Called meeting by Mayor G. W. Kreeger 7:10 P. M. to act on J. K.
Chastain's request to consider Merit Board's recommendation and to hire a Chief
of Police, City of Smyrna.
ACTION:
- Councilman J. K. Chastain motioned to hire Elmer E. Dyke, effective
July 1, 1960 as Chief of Police and Marshall of the City at starting salary of
$4.50.00 per month. On second of R. J. McCurry, the vote was five to one, W. L.
Keck abstained.
t ; Fire damage May 30, 1960 to home of Mr. J. A. Brookshire, 119 Brent-
wood Drive, was discussed.' Per W. B. Sanders' motion, which carried, "In view
of the circumstances, this Council waive existing ordinance and permit Mr.
Brookshire to Cccupy trailer on the premises pending completion of repairs
caused by fire." J. B. Ables seconded motion.

A called meeting.of Mayor and Council was held at City Hall, Smyrna,
Georgia on June 20, 1960 at 7:00 o'clock P. M. Mayor G. W. Kreeger presided,
and all councilmen were present.
Mayor G. W. Kreeger read in council a letter from Nordec, Inc. rem
questing the City to furnish forty feet of 24 inch drain pipe to be installed
by Nordec under the road extension (Dundee Drive) in the area of Pump Station
No. 1. Motion by H. E. Ingram authorized Sam Hensley to.check specifications
and submit bill of materials, and further recommended that Mr. Northcutt in-
stall the pipe. Second -by W. L. Keck. Voted unanimous.
Mr. Hensley reported and submitted plats relative to the drainage
problem West Smyrna Heights and Cardinal Lake Manor. The recommended solution
called for 230 feet of 42 inch.concrete pipe from the existing culvert, divert-
ing the flow of surface water drainage. In discussion, Mayor Kreeger appointed
the following committee to contact developers Bennett and Shipp: W. B. Sanders
W. L. Keck, and Sam Hensley.
Council deferred action on sidewalks on Concord Road pending completion
of petition and setting date for the hearing.
.Bids submitted in Council for Stephens Street improvements were opened.
The bid from J. E. Lovern was $740.38; the bid from Co -Mar, Inc. was $700.00.
Motion by H. E. Ingram we accept the bid from Co -Mar, Inc. in the amount of $700.00.
Second by J. B. Ables, and voted unanimous.
l Council, after discussion with J. M. Gibson, voted to install cast
iron water lines in preference.to transite in the Howell development. The ,
variance in materials cost, cast iron over transite pipe,- was $1,028.00. On a
1 vote which carried, W. L. Keck motioned to install cast iron pipe in Howell
J project per plat and specifications submitted in the amount of $9,124.38, this
cost to,be borne by the subdivider. The motion, seconded by R..J. McCurry,
further agreed -to connect water..ma.ins between Don Bridges property and Howell
project east on Spring Road, a distance of 149 feet and west on Spring Road
265 from Howell line to the Highlands Subdivision main line, a total of 414 feet
of cast iron pipe connectors, the cost of said connectors to be absorbed by the

On motion by W. L. Keck and second by W. B. Sanders, Council accepted
Mr. Sam Henley's estimated material costs of $16,622.06 for water lines in

Creatwood Forest, Unit No. 1. Motion authorized installation of lines, the
City of Smyrna absorbing the .difference between six and eight inch pipe, a dis-
tance of 995 feet.
Council approved the letting of bids covering water tank repair and
repaint. Bids to be submitted and opened in council August 1, 1960.
City Hall staff submitted reports on current and advance 1960 tax
collections; current accounts payable; current and year-to-date budget reports
by department.
Ordinance presented and read in council by G. C. Ingram, was on
R. J. McCurry's motion accepted as amended.' Ordinance makes it unlawful to con-
gregate, loiter, gather or assemble on the public streets or other public
places within the corporate limits of the City of Smyrna.

BA unanimous vote (R - RJ 5council named the new pony league
ball park on Bank Street and Sanford Place the "Ralph Cobb Memorial Park."
Dedication date to be set and published.
Chairman of Streets, H. E. Ingram, was requested to investigate and
report on Hughes Street drainage problem.
Chairman of Sanitation, R. J. Austin, was requested to follow up
all reports on dog bite cases reported by City Sanitary personnel.
Council scheduled June 27th 7:00 o'clock P. M. as the date to hear
and resolve all paving assessment complaints. Letters calling out this date
to be mailed upon receipt of protests. Committee assigned to resolve protests:
J. Bt Ables, G. Conley Ingram, and L.W. Charles.
Mayor G. W. Kreeger read the proposed contract or joint agreement
between Cobb County and City of Smyrna, which agreement calls out construction
of -an outfall sewer line approximate length of 7,200.1inear feet along Nicka-
jack Creek in"southwest Cobb County to a proposed new lift station. Copy of con-
tract upon signature of both parties to be attached to the minutes and made a
part thereto. J. B. Ables motioned "this Body authorize.the Mayor to negotiate
the contract with Cobb County Advisory Board." Seconded by H. E. Ingram, and
voted unanimous. MEMO: (Contract negotiated, signed, and delivered to City Hall

In discussion regarding sanitary sewer line, R. B. Bennett sub-
division, in landlots 384,385,336, and 337, W. B. Sanders motioned to secure
bids to be opened in council: July 1.1,.1960 covering labor and materials to in-
sta11,8 inch sewer lines from the outfall line to Honeysuckle Drive, to Rose-
dale Drive, and to Cooper Lake Road. Motion seconded by J. B. Ables and voted
unanimous.
Announcement made in council by Jaycees inviting Mayor and Council
to serve as honorary judges during 1960 Soap Box Derby to be held in Smyrna on
July 4, 1960.

regular meeting of Mayor and Council shall be held at City Hall July 11, 1960

C O N T R A C T
THIS AGREEMENT, made and entered into this 2 th day of June, 1960,
between COBB COUNTY, a Political Subdivision of the State of Georgia, acting
by and through its Commissioner of Roads and Revenues and Advisory Board, as
Party of the First Part, and the CITY OF SMYRNA, a Municipal Corporation in
Cobb County, Georgia, acting by and through its Mayor, as Party of the Second
Part;
W I T N E S S E T H:
WHEREAS, each of the parties to this agreement is desirous of extend-
ing and improving the sewerage facilities owned and maintained by it for public
use, and
WHEREAS, each of the parties hereto has investigated and determined
that it needs additional sewerage facilities and that a portion of said facilities
can be improved jointly by the parties, so as to serve each of the parties and
at a considerable savings to each of the parties, and
WHEREAS, the Party of the First Part has employed Hensley and 'Associates,
Inc., an, Engineering firm of Cobb County, Georgia, that is acceptable to Party
of the Second Part, to prepare the plans and specifications for the proposed
sewerage facilities to be constructed by the parties, and
WHEREAS, the parties wish to enter into a contract providing for the
construction and use of said sewerage facilities and the payment therefor;
NOW, THEREFORE, in consideration of the premises, the mutual covenants
contained herein and the further sum of One ($1.00) Dollar, each to the other
in hand paid, the receipt and sufficiency whereof is hereby acknowledged, the
parties, acting by and through their duly authorized officials, agree as follows:
1. The City of :Smyrna agrees to construct an out -fall sewer line, in

accordance with specifications to be furnished by Hensley and Associates,
Inc., which shall extend from the existing sewerage treatment plant of
the City of Smyrna on South Cobb Drive in a Southwesterly direction,
an approximate length of 7,200 linear feet, along Nickajack Creek to
a lift station which shall be constructed by the City of Smyrna on
property of Cobb County where there is presently located an existing
sewerage treatment plant belonging to Cobb County. It is agreed that
the City of Smyrna shall bear the total expense of the construction

and maintenance of said out -fall line and lift station and that title
to said line and station shall remain in the City of Smyrna, and that
Cobb County will execute and deliver to the City of Smyrna simultaneously
herewith a perpetual easement for the location of said lift station.
2. It is further agreed that the City of Smyrna shall have the right
to pump sewerage through said out -fall line into the sewerage treatment
plant of Cobb County and that for the privilege of using said sewerage
treatment plant of Cobb County, the City of Smyrna agrees to pay to
Cobb County one-half of the cost of enlarging said sewerage treatment
plant, to include the following provisions:
(a) A primary settling basin;
(b) A trickling filter;
(c) A secondary settling basin;
(d) A secondary sludge digester;
(e) Drying beds and all necessary appurtenances thereto,
,as provided in the plans and specifications fir the
enlargement of said sewerage treatment plant, prepared
by Hensley and Associates, Inc. It is agreed, however,
that the cost to the City of Smyrna of the enlargement
of said treatment plant shall in no event exceed $90,000.00
and that the remainder of the costs of enlarging said
plant shall be paid by Cobb County.
3. It is further agreed between the parties that Cobb County shall
have the privilege at,any time of tapping on to the aforesaid out -fall
sewer line of the City of Smyrna which is to be constructed to empty
sewerage into said County sewerage treatment plant, but that all expense
necessary or incident to tapping said line by Cobb County or its customers
shall be paid by Cobb County and/or its customers and shall be done at
no expense to the City of Smyrna.
4. It is further agreed by and between the parties that all customers
who tap said sewerage line to be constructed by the City of Smyrna
shall be billed monthly for the privilege of using said sewer facilities
at the rate of at least $1.50 per month, or at such larger sum as may
be agreed upon by the parties from time to time, which sum shall be
added to the monthly water bill charged by the party to this agreement

from whom said customer purchases water and shall be collected
each month by said party and disbursed as follows: two-thirds
of each monthly collection from each customer shall be paid to
Cobb County and the balance of said sum shall be paid to the City
of Smyrna as it is collected by the respective parties.
5. It is further agreed between the parties that the out -fall line
to be constructed by the City of Smyrna, as aforesaid, and the enlarge-
ment of the County sewerage treatment plant shall be constructed and
accomplished within six (6) months from the date of this agreement
by the respective parties and all sums due therefor shall be paid
promptly upon completion of said work.
6. It is further agreed by and between the parties that Cobb County
shall bear all expense necessary for the continued maintenance of said
sewerage treatment plant and will keep it in good repair to receive
sewage ,,pupped by the City of Smyrna into said plant for treatment
for and during the life and existence of said sewerage treatment plant
and that upon payment by the City of Smyrna of its share of the cost
of enlargement of said plant, said City shall have a vested interest
in said plant, to the extent of its investment, for the life and
existence of said plant.
IN WITNESS WHEREOF, each of the parties has caused this contract to be
executed the day and year first above written.
