'Meeting called to'order at 9:00 A.M., Mayor J. M. Gibson presided
and five councilmen present: Messrs. G. W. Kreeger, J. B. Ables,
J. B. Rhodes, W. B. Sanders and L. C. Dodd. Absent: Messrs. J.V.
Brooks, and R. H. Wood.
Mayor Gibson announced that R. B. Bennett Realty Co. will
build additional houses in vicinity of Shirley and Westbrook Sts.
In West Smyrna Heights. Water and sewer lines approximating 1900
linear feet would be required plus three manholes and three fire
plugs. Using materials on hand plus additional pipe purchased
was estimated at $6200.00 cost to the City. Mayor stated Mr.
Bennett has check to cover entire job in the amount of $9600.00 .
In discussioni the question was unsolved whether the City or R. B.
Bennett will do the job or to secure bids. It was decided that
Mayor Gibson continue negotiations.
Mayor J. M. Gibson read Mr. T. J. Northcutt's letter calling
out additional houses to be built in Unit II of "The Highlands."
Mr. Northcutt's letter dated April 3, 1958 calls out a•parcel of
land, 11.5 acres more or less. Paragraph four of this letter reads
Quote "I hereby request that you take this property into the City
of Smyrna. It presently adjoins the City_ limits as I have previous-
ly stated. Signed Thomas J. Northcutt." This•letter attached to
minutes and made a part thereto.
Motion by Mr. G. W. Kreeger that the property•described by
Mr. T. J. Northcutt'be accepted into the city of Smyrna.,* Georgia.
Seconded by Mr. J. B. Rhodes and voted unanimous.
Mr. Otis S. White objected to back tax statement covering two
buildings and claimed our tax structure was in error, also that
his 1957 taxes were paid by R. D. Warren Company. Opening the City
Tax Returns for 1956 and 1957 it was revealed there was no error.
Mr. Otis paid the amount assessed as well as 1958 Business license
as a painting contractor.
Eight representatives of the soft drink bottling companies
doinj business in the City, appeared in Council room to protest
the 100.00 business license fee for 1958. Using the profit. angle
as the basis of their protest they advised council they would stop
making deliveries unless license fee was•reduced.
Council refused to reduce the $100.00 license fee to $50.00
for 1958 as recommended by Mayor J. M. Gibson.
Motion by Mr. J. B. Ables to accept Mayor's recommendation
at $50.00 was seconded by Mr. G. W. Kreeger. Voting for: Messrs.
G. W. Kreeger and J. B. Ables. Voting against: Messrs J. B. Rhodes
L. C. Dodd and W.• B.' Sanders.
In the discussion of new paving contracts, Councilman J. B.
Rhodes moved to rescind previous action of council, an ordinance
requiring a 2_5% performance bond for all sub -dividers -- See
minutes of March 29, 1958 Page No. 65 which reads as follows:
Motion by Mr. J. B.,Ables to adopt anew paving ordinance'
calling out soil cement base and requiring a 25% performance
bond for -all sub -dividers. Second G. W. Kreeger. Voted
unanimous.
Vote to reconsider was unanimous and council adopted the
following ordinance, copy of same to bereproduced and submitted
to all contractors and/or subdividers as follows: -
Ordinance
Be it resolved that all newly constructed streets in new subdivi-
sions shall be inspected as the paving is laid. Further resolved
that the assigned City engineer.or consultant engineer shall fur-
nish this inspection during the period of construction and cost
incurred for this service shall be borne by the contractor or
builder. As a part of ibis ordinance Consultant Engineer's Hens-
ley and Associates, Inc., are••hereby authorized to establish and
submit acceptable rates for this inspection. This ordinance
put in motion by Mr1 J. B.-Ables. Seconded by Mr. W. B. Sanders.

Resignation of Fire Chief P. A. Bond was accepted�on mot'_on by
Mr. G. W. Kreeger, seconded by Mr. W. B. Sanders. Voted un� fsmous.
In the discussion of volunteer firemen, Mr. G. W..Kreeger moved"
to hold current personnel at eighteen with ten paid volunteers ® $10900
per month with complete insurance coverage, the.balance (Eight) deleted
from City payroll but protected by Workman's Compensation only. Second-
ed by Mr. J. B. Ables. Voted unanimous..
Reports or memo's were called out by council with reference to
sidewalk repairs, water bills,.City recorder and lights on Concord Road
No action taken.
Mr. L. C. Dodd moved to retain through second quarter of 1958 the
services of consultant Engineer, Hensley & Associates, Inc. @.$400.00
per month. On Mr. Kreeger's second the vote was unanimous'
A committee was set up consisting of Mr. L. C. Dodd, J. V. Brooks
and J. B. Rhodes.and on Mr. G. W. Kreeger's motion this committee was
authorized to start immediately the wrecking operations of the two build-
ings purchased by the city as the site for the new City Hall. One
building occupied by a cafe is vacant, the other to be vac ted on.or be -
building ore April 30, 1958. Motion seconded by Mr. J. Be Ables Voted unani-
mous.
Mayor J. Mc Gibson announced the present City Hall will be convert-
ed for use by the Police Department and jail, this allowing adequate
space.for the fire department.
Mr. J. Be Rhodes made a motion that the City purchase the H. Morris
property at $7,500.00. Voted unanimous on Mr. G. W. Kreeger's second.
Closing cost of $165.00 per Mr. G. Conley Ingram's statement on the
J. D. Anderson property was authorized for payment'by Mr. L. C. Dodd.
Seconded by Mr. W. Be Sanders. Voted unanimous.
Inspection of a fruit stand located on South Cobb and.Concord Road
was referred to Mr. G. W. Kreeger and Mr. W. W. Kidd on the report of
potential.fire hazard.
Councilman L. C. Dodd requested report on second quarter appro-
priations be deferred to April 19, 1958. Mr. Dodd reminded council that
loss in revenue was alarming and suggested a "freeze" of city.purchasing
until recommended appropriation for second quarter of 1958 was completed.
Mr. J. B..Rhodes motioned to recess this meeting to April 19., 1958••
