02-07-1959 Continued MeetingMinutes of February 7, 1959 123 The continuation of the meeting held by Mayor and Council, recessed Februaryl2, 1959, at 1:10•A. •M. , was called to order February 7, 1959, at 9:00 O'clock A. M. at the City Hall. Mayor J. M. Gibson presided and the following Councilmen were present: G. W. Kreeger, J. B. Able s, J. B. Rhodes, , W. B. Sanders, R. H. Wood, and L. C. Dodd. W. T. Rutledge was absent. In the first order of business Mr. H. G. Hayes requested incorporation of his property on Hayes Drive into the City of Smyrna. The improved property pe.r plat submitted comprises 150 foot frontage in land lot 527 of the 17 District, second Section of Cobb County, Georgia. Motioned by L. C. Dodd, the property of H.G. Hayes be annexed into the City of Smyrna provided that full compliances with all existing ordinances pertaining to streets,.drainage, R&Nfcand water" lines and futher that all 1959 taxes shall be assessed or equilvalent thereto for services rendered. Motion seconded. by W. B. sanders and voted unanimous. Mayor J. M. Gibson appointed the following committee to investi- gate the paving conditions of Earkway and Beaver Creek Road in Cherokee Hills: Messrs. Sam Hensley, J. B.. Ables, L. C. Dodd, Gardner Potter, W. , A. Ward, L. F. Daniel., H. W. Clay, and Mr. Austin of C. W. Mathews and May -or Gibson. This committee to meet at 1:00 P. M., February 7th, to resolve the problem . The issue prompting this committee assignment was the result of council action which banned the approval of building permits by reason of conditions of the streets mentioned above. • Mr. 'Gardner Potter requested -Council action that the ban on building:; permits be lifted at once, that streets be repaired and street signs installed. Councilman J. B.-Rhodes motioned as follows: This committee to be authorized to inspect the streets in Cherokee Hills and when satisfactory agreement is reached by all parties that Council. Action as a result of this meeting, shall recommend ban on building permits be lifted. Seconded byy G. W. Kreeger. Voting for was G. W. Kreeger, J. B. Able s, J. B. Rhodes, W. B. Sanders, . R. H. Wood, Opposed, L. C. Dodd. , The following recommendation of Mayor J. M. Gibson was put in motion by J. B. Ables, seconded by G. W. Kreeger, and voted unanimous. All developers and sub -dividers inside the city limits of Smyrna shall be supplied by the City Hall with copies of all current and existing ordinances- applicable to paving, drainage, curbing, and further thht all developers, builders, and sub -dividers shall notify the City Engineer before paving, curbing and side- walks are installed including drainage and/or storm sewers. Further resolved that all plats and layouts must be approved by City Engineer and Street Department Chairman prior to issuance of the Building Permit. To apply to -all• builders, subdividers, and developers within the city limits as evidence that full compliance with all existing ordinances have been met. In the meeting of February 2, 1959, the vote to adopt the Civil Service Bill as drawn by City Attorney, G. C. Ingram, was five to two in favor for adoption. Mayor J. M. Gibson's veto of this action dated February 6, 1959a was read in Council and later withdrawn through discussion by reason of the following actions Motion by J. B. Ables that Section "B" of Paragraph I. of the Civil Service Bill be ammended to read that "other departments where the majority vote of the members is secured plus the unanimous vote of the merit board" shall come under the provisions of the bill. Gibson regarding the rehiring of Police Sergeant .H..E. Brown. G. W. Kreeger moved to defer action on the Brown case,.to the next regular meeting of Mayor and Council in March,r:1959• There was no second. Motion with -drawn.. Councilman J. Be Rhodes was,excused. A resolution was presented in Council to change Section 8, 11, and 15, of the Smyrna Charter which changes the procedure for filling vacancies in office of the Mayor or Councilmen, and established a run-off if no candidate. received a majority of the votes cast, and provides that eligibility hinges on the candidate being a resident and a free holder. G. W. Kreeger motioned the resolution be adopted as read. W. Be Sanders seconded. Voting for adoption: G. W. Kreeger, J. Be Ables, W. Be sanders, and R. H. Wood. Opposed was L. C. Dodd* Futher motioned, W. Be Sanders.., that these ammendments to the charter be adopted as separate resolutions. ( section 8,11,15) on J. Be Ables second, the vote was four to one for adoption. Meeting• recessed for. demonstration of (SewerKing) Sewer Pipe cleaning equipment by .representative of the O'Brien Manufacturing Company. I . Meeting reconvened at the City Ball at 12:15 P. M. R. H. Wood motioned each Councilman investigate sewer cleaning equipment and secure bids. G. W. Kreeger Seconded; voted unanimous. Mayor J. M. Gibson excused 12:15 Pe M. for business and 1:00 P. M. meeting at Cherokee Hills. J. Be Ables motioned that this body declare this meeting an official called meeting of act on the Police Sergeant H. E. Brown Case. ¢ W. Be 13anders seconded. Be Sanders seconded to over -ride Mayor J. M. Gibson's veto on Police Sergeant H.'E.'Brown. VV. Be Sanders requested that Sergeant Brown be rehired on the payroll on the same shift and that no disciplinary acts be held against him and that no reflection shall be directed on the Chief of Police. Voting to over -ride the veto and rehire Sergeant H. E. Brown were J. .Ables., W. Be Sanders, R. H. Wood; Opposed -- L. C. Dodd. Motion by W. Be Sanders that failure to sign payroll check for Sergeant H. W. Brown by Mayor J. M. Gibson, the Bank of Smyrna be authorized to accept anD honor payroll' -'check c srrying the signature of G. W.
