01-10-1959 Regular MeetingMinutes of January 10, 1959 Regular meeting of Mayor and Council,recessed 10:15 P. M., January 5, 1959 to Saturday, January 10, 1959, was called to order at 9:00 O'clock A. M. Mayor J. M. Gibson presided with six councilmen present. Resignation of J. V. Brooks by letter,dated January 3, 1959,.created a vacancy.in city government from ward No. 6. Councilman G. W. Kreeger motioned to fill the unexpired term of Mr. Brooks by nominating Mr. Dennis H. Daugherty of ward No. 6. J. B. Rhodes seconded -the nomination. J. t. Ables nominated W. T. Rutledge as Councilman for ward No. 6. seconded by R-. H..Wood. Mayor Gibson called for the vote. Voting for W. T. Rutledge: J. b. Ables, W. B. Sanders, L. C. Dodd and R. H. Wood. Voting for Dennis H. Daugherty, J. B. Rhodes, G. W. Kreeger and J:. M. Gibson. Council voted to make Mr. Rutledge's election unanimous on J. B. Rhodes motion. W. T. Rutledge sworn in January 10, 1959 by G* Conley Ingram and was seated at council table. In the first order of business council received a petition through spokesman Rex Pruitt of 339 Dunn Street calling out six points of objections to a day nursery operating at 330 Dunn Street. Action on Mr. Pruitts petition was held in abeyance pending inspection reports its progress per Mr. �'. W. Kreegerls motion. Voted unanimous after second by R. H. Wood. Mr. Don S. Bridges requested.annexation of fifty-one acres(more or less) in Southeast Smyrna located off Spring Road and was adt ised that land annexed must.be.contiguous to adjacent property for annexation per Georgia Laws. Mayor Gibson announced he would contact McKenna, Northcutt, and Howell in connection with incorporation of their properties in land Lot No. 737 and advise Mr. Bridges on results and progress. Memo: All or portion of L. L. 737 must come in before properties of Don S.,Bridges a straw vote of Council.revealed unanimous approval on annexation of the 56 acres. In other actions Council voted as follows: Motioned to refer to G. Conley Ingram for ruling on disposition of $240.00 added supervisiory claim of Boroughs and Dale ( Architects, New City Hall), appointed G. W. Kreeger, J. B. Ables and R. H. Wood to assist in arranging final disposition. Voted to increase from 15 to 25 miles per hour the speed limit on,Spring Road and install caution light. Refered to Police Department for action. Set 1959 Business license tax at prevaling rates established for 1958. Deadline for purchasing business license for 1959 was, by unanimous vote, set at January 31; 1959; Agreed that if no unfcrseeable problems were encountered, the examination of books for calendar year of 1958 will start February 2, 1959. Voted unanimous to pay balance due on fire station furniture purchased from Ivan Allen Company from funds on deposit in the General Xund.- Bids received in connection with materials required for correction of drainage problems were opened. -Bids submitted ranged from $1.90 to $2. 45 per foot for 1811 pipe; $3.00 to $3.75 for 2411 pipe and $10.00 to $10.95 per foot for 4811 T. & G. Concrete Pipe. J. B. Ables motioned to accept the low bid of Marietta Concrete Pipe Corporation. Motion seconded by J. B. Rhodes and voted unanimous. . A tentative report from City Fire and Electrical Inspectors stated that several day nurseries did not meet safety requirements. Council advised the inspections be continued and reports submitted in February meeting. A tentative operating budget for the first.calendar quarter of 1959 was approved by Council. Finance Chairman L. U. Dood instructed each department to hold expenditures down for first quarter and then moved to accept third quarter 1958 operating costs by department as tentative appropriation for first quarter 1959 pending submission of balanced budget. J. B. Rhodes seconded the motion and the vote was unanimous. j' im Continued - Minutes of January 10, 1959 The distribution of tentative appropriation includes $25,000 General Fund, Street Department $6,000, Police $12,000, Fire $7,000, Sanitation $15,000 Parks, Street Lighting, Contributions, and Insurance $12,000, Total : $78,000. , Civil Service - (Carry over item from Januaiv 5, 1959) in the meeting of 1 9 J. Be Ables redommended adoption of Civil Sertirce to cover fire and police employees and appoint Board members to•ca.11 on Cobb County Legistlators to adopt a bill to amend city.charter. Referred to G. Conley Ingram for study and/or revision. In meeting of Mayor and ouncil January 10,1959, typed copies of Civil Service Regulations were distributed in Council. Most of the discussion hinged on procedure, revisions, coverage and board members. Action to provide Civil Service coverage came on motion by J. Be Ables, second by G. W. Kreeger that this Council adopt a bill -to comer city employees of Fire and Police Departments and other departments desiring to come under provisions of Civil Service, Subject to approval of Mayor and Council; and, further that this bill be submitted to Cobb Legistlative Delegation for action through the 1959 General Assembly. Motion received unanimous approval by Council. There was no vote on Mr. Ables' original motion which deleted coverage for departments other than Fire and Police. , Prepared plats showing boundaries of land owned by City and Mr. W. B. Bowles in area of North Cooper Lake Road were distributed by Sam Hensley, City En ineer. On the basis of complaints from Cobb Health Department, Mayor• ibson invited all Councilmen, -and the Press on an inspection tour of the present garbage disposal area. On completion of inspection W. B. Sanders motioned to contact Mr.. W. Be Bowles and work out a program to trade.acre for acre, such trade to be contingent upon soil tests to provide desirable land fill method of garbage disposal. On second by G. W. Kreeger the vote was, .unanimous. To negotiate a property trade between City of Smyrna and Mr. W. Be Bowles, Mayor J. M.
