01-05-1959 First Regular Meeting1-15 Minutes of January 5, 1959 The first regular meeting of Mayor and council of the City of Smyrna was held at the City Hall, January 5, 1959 at 7:00 O'clock P: M. Mayor J. M. Gibson presided with councilmen J. B. Ables, L. C. Dodd, G. W. Kreeger, J. B. Rhodes, W. B. Sanders, and R. H. Wood present. J. V. Brooks, Councilman from the sixth ward was.absent. In the first order of business, a letter of resignation signed by councilman of the sixth ward, J. V. Brooks, was read in council.by.Mayor J. M. Gibsonp stating he could no longer represent ward No. 6 on the city government during 1959 by reason of business activities, Mr. Brooks recommended as his successor, Mr. Dennis H. Daugherty of Ward No. 6. on motion by J. B. Ables & duly seconded by W. B. Sanders, council accepted resignation of J. V. Brooks. During discussion of successor L. C. Dood motioned to fill the vacancy in ward 6. with Mi;Daugherty as recommended. Seconded by J. B. Rhodes. In deliberation on placement, W..B. Sanders motioned, second by G. W. Kreeger, to defer naming a successor until January 10, 1959. On Mr. Dodd's motion the vote was four to two against naming successor at this meeting. On Mr. Sanders'Motion to defer to l/W59 the vote was unanimous. Mayor J. M. Gibson recommended to continue session to January 10, 1959, 9:00 A. M. to fill the vacancy and to locate area for city garbage disposal. On L. C. Dodd's motion the check in the amount of $300.00 endorsed to the City by Mr. H. G. Poss be accepted as taxes to apply. on building located at 123 West Spring Street covering the years 1959-1960 and 1961. Also, provided,.in this agreement that property is not improved during period called out, and further that sanitation disposal taxes are excluded from this agreement. Second R. H. Wood , voted unanimous. (This action cancelled t Mr. Posse request to annex 12 acres in West Smyrna). Finalized minutes of December 1958 meetings read in council by staff employee. Correction to item No 8 , Page No. 111 of 12IV58 minutes requested by W. B. Sanders. Councilman.L. C. Dodd motioned minutes accepted as corrected. Seconded by G. W. Kreeger. The vote was unanimous. Statements of accounts payable, November and Decomber were distributed in council as well as year end bank balances.. L. C. Dodd.moved to pay all properly documented bills. Unanimous on R. H. Woods second. Mayor J. M. Gibson read his new year letter addressed to council, department heads and city employees calling out 1958 accomplishments of this administration as follows: . Payment of 1956-57 bills ($72,000) thus regaining top credit rating, purchase of new police cars, moving South Cobb lift station from Uheney Woods, installation of sewer and water lines in four major subdivisions with laterals to 310 lots plus lines to•four new stores and one school, purchase of property for construction of new city hall, remodel police and fire department buildings, repossession of city owned equipment, purchase of garbage disposal trucks,-- » ""Mm feting the paving of 21 streets, engineering to solve traffic control throgh installation of signal devices and lanes at seven intersections, and approval through council of 83 new street lights per survey completed*during - - Council voted five to one to accept amended ordinance as drawn by., G. Conley Ingram regarding keeping horses within the city limits. Under the amended ordinance owners may keep horses within 100 Feet of an occupied residence �.--- -• ---» as- opposes to previous ordinance calling out 300 Feet. Ordinance provides an inspection clause authorizing city person -el and Cobb Health Department to inspect premises and all stables and places of confinement of horses for �-- the purpbse of strict compliance with amended ordinance. On discussion of unpaid 1958 taxes as of 111159, Mr. L. C. Dood moved to set January 15, 1959 as the deadline for payment, and issuance of Fi Fats and Penalties allowable by law shall apply on all unpaid taxes effective January 16, 1959. M -. 116 Continued Minutes of January 5, 1959 Appreciation for accomplishment on recreation bkoad during 1958 was extended to Mr. Harry Mitchell by the Mayor and Council. Opening of bids covering year end examination of city books resulted in motion by L. C. Dood to retain William E. Farrell Company, C. P. A. of Marietta, they having submitted the low bid of $48.75 per day against two other bids of $50.00 per day. On J. B. Rhodes second the vote to retain low bidder was five to one. J. B. Ables opposed. Memo: In meeting of 12/1/58 Council by unanimous vote on J. B. Ables motion, authorized city to retain auditor on a bid basis. Mayor J M. Gibson recommended at this first meeting in 1959 that Council consider re -appointment of all department heads, all inspectors, city attorney, court recorder, committeemen and City Clerk for 1959. Recommendation put in motion by J. B. Rhodes and duly seconded by L. C. Dodd., Concilman J. B. Ables motioned that this council adopt civil service plan for Fire and Police Departments and further that we request Cobb County Delegation to amend city charter to provide for a Civil Service set up Motion seconded by R. H. Wood. On the motion of J. B. Rhodes to Re -hire all department heads for 1959. The vote was unanimous. There was no vote on adoption of'Civil Service. Councilman W. B. Sanders motioned to place this itme on the Agenda of Mayor and Council Meeting January 10, 1959. Seconded by R. H. Wood and voted unanimous. On dicussion of first quarter operating budget, L. C. Dodd requested deferment to January 103 1959. Letters prepared by G. Conley Ingram Read in council pertaining to safety devices and traffic sighals at Hawthorne Street cross -over and letter to Mr. C. B. Yancey on sidewalk damage. Letter from Cobb County Health Department called out complaints regarding garbage disposal area on North Cooper Lake Road and recommended sanitary land fill method. Mayor J. M. Gibson requested all members of Council and the Press to meet January 10, 1959 at disposal area to resolve the problem. Motion to recess, L. C. Dodd and W. B.
