09-17-1956 Regular Meeting• 0J The regular meeting of the Mayor and Council was held at the City Hall, September 17,, 1956, Mayor James E. Quarles presiding with the following Councilmen present; D. M. Scarborough, N. E. Brenner, Murray 8onenberg, J. G. White, A. V. Bolton and' Roy Wood. Minutes of previous meeting read and approved as corrected. A group of Citizens from Powder Springs Street requested information of paving, curb and gutter on Powder Springs Street. Mr. Presley assured them that Curb and Gutter would be started the last of September. Mr. Quarles stated that he would talk with Cobb County Commissioner about' the paving. (Men's names that came before Council; Mr. Wilson, Mr. R. B. Stewart, Mr. Wiley Cross and Mr. Don Kane.) Mr. Harold Willingham arrived. Capt. Kanatzer of McLinden Avenue, requested apprgximate starting date on the construction of gutter on McLinden and Dell Avenue, also, to ask if the City would pay a share Qf the gas line that is to be ]paid on Church Street. J. A. Bradshaw asked Council, about water line,fee on Glendale Place. He asked if he could stub out to where line ended and eliminate fee. He agreed to pay ,the 90 ft. frontage and have line run past property. A Citizen (Mr. Watkins) asked Council about bids on Recreational,Center. Why the City gave it to another bidder instead of St. Johns Co., the lowest bidder. Mr. Bolton thought it best not to go into it at that time. Mr Bolton read from Charter on same/ Mr. Quarles read a report from Lockheed on Condition of stream test at Buckham Bridge. Report showed that stream was in better,cogdition now than it has ever been. Mr. Bolton's protest (or appeal) on tax assessments on Sanford,Road read. The assessment was lowered by tax assessors from $2,800.00 to $29700.00. (23 houses in all.) The question was asked as to Mr. Bolton's right to appeal for others than himself. Mr. Willingham said if nec- essary the City could appoint an arbritator, or file individual protest. Report on Taz Assessment Board read by Mayor. Total assessments for 1955 $6,484,622.00, Total for 1956, $79850.059,00. Motion by Murray Sonenberg, seconded b the Tax .Assessor Board report by right assessment and assess the property set Charter, doted unanimous. - Mr. Roy Wood arrived. y N. E, Brenner, that we accept of appeal subject to render forth, thence provided by Motion by N. E. Brenner, seconded by D. M. Scarborough, that the Tax Rate for 1956 be set at -.1.3 mills. .11 Mills 'fbr General Fund and .02 Milks for (Sinking Fund) Bonded Indebtedness. Voting against: A. V. Bolton, 'Murray Sonenberg. Motion bF Roy Wood seconded by D. M. 'Scarborough, that the Sanitation tax fee be set at J1.50 for Residence and $2.00 for businesses. Effective the billing for September,'1956. oted unanimous. Contract with -Northcutt read and explained by Mr.�Wiilingham. Motion by Murray Sonenberg, seconded by A. V. Bolton, that conclusion of same, the following resolution was adopted; -Resolved, City of Smyrna enter into proposed contract with Thomas J. Northcutt and that the Mayor be and hereby authorized to execute Contract for and on - behalf of City, and the City Clerk be and she is hereby authorized to attest such ex- ecution effective by Mayor and to fix the seal of the City thereto. Resolve further, that when such Contract be duly executed by both parties thereto, that a duly conformed copy of same be attached to .the minutes ,-of the within meeting at the end thenceof,. and made a part of same by this reference thereto. Voted unanimous. 290 Motion by N. E. Brenner, seconded by D. M. Scarborough, that we hire Kessler Co.. to repair water tank at an .estimated cost .of $4,,000.00. Voted unanimous. I . Brentwood 1,160 feet Wisteria 300 " Magnolia. 500 " Between Wisteria & Magnolia 300. " Reason: Depth of cut such that city equipment could not make cut be- cause of extreme depth. Motion By N. E. Brenner, seconded by A. V. Bolton, that Kennesaw Land and Sales Agency request for water and sewerage in Unit 7, An Green Hills Sub -Division be granted, subject to the payment of a City Business License for the year 1956. Voted unanimous. Discussion was held on the purchase of new trucks for City. Request made for Mr. Presley to get with all.Departments and refer back at next meeting. Discussion was held on purchase of New hater Tank. Dicision made to authorize Welcher and Merritt.to obtain bids and have them submitted to City Hall, Councilman A. V. Bolton expressed his disappointment to Council con- cerning the way a few matters concerning the Police Department had been handled. Also, he was not pleased witli the actions of the Police Committee, Mayor Quarles requested the Police Committee to call a meeting.within, the next week and notify all Councilmen, and Mayor, for their attendance. An ordinance was introduced -by and seconded by providing that Powder Springs Street between Atlanta Stree t and Eastf ield Road be improved by the construction on eadh side with a concrete curb and gutter. Copy of said ordinance attached to these minutes and made a part thereof. , Move for adoption of Section-6_-.and 7-of ordinance for construction of concrete curb and gutter of Powder Springs Street by and seconded by Motion by D. M. Scarborough, seconded by Brenner, that the speed limit be set on that part of South Cobb Drive within the city limits, at 45 M.P.H. Voting for: D. M. Scarborough, R. H. Wood, S. G. White, N. E. Mr. Dick Stewart, of Powder Springs Streets requested information on the coat of curb and gutter and resurfacing Powder Springs Street to South Cobb Drive. Mr. Ben Zie g, 506 Cherokee Road, objected tothe sign that had been placed at the intersection of N. Burbank Circle and Cherokee Road, because it was :too_;large, obnoctous, wiring was exposed and too. close to -the ground. Therefore, it would be tempting for children to climb. Mr. Walter Levy, president of Upland Construction Co., stated that the sign in question was a tempory sign, the limit of time from 9 mos. to a year and if necessary, and his responsibility, he would take out special insurance on sign. Mayor Quarles referred matter of the sign to Planning and Zoning Committee to get with Mr. Zieg and Mr. Levy this week.add report back at the following meeting. Mr. David Freedborn, of Cherokee Road requested information concerning the Police Department. Mr. R. L. Gordon, of 581 Gober Terrace, requested permission to park house trailer an his lot. Mr. Gordon was advised that he would have to get a release from his covan6 nt from Kennesaw Land Co. or Mrs. Mary Benson, before consideration would be given by Council. Mayor Quarles read letter from C. E. Barbeau, requesting permission to sell beer at Fay's Cafe,located at 123 Bank Street. Motion A. V. Bolton seconded N. E. Brenner, that beer license be granted to Fay's Cafe for Oft the premise consumption. Voted unanimous. Councilman R. H. Wood reported that the lights had been installed at Ward Park at a savings over the estimated price. ,4r. Cooper, of 310 Concord Circle requested the city to remove a dead tree an City right-of-way. Motion D. M. Scarborough, seconded J. G. White, that three bids be obtained to remove the tree in question and any others that were needed. Voted unanimous. Mayor Quarles called attention to the fact that no fire plugs were in front of stores in the Belmont Hills Shopping Center. Requested that it be called to Mr. Bill Wards attention. Hearing set for November lst, 1956, on the re -zoning of David M. Carlson property located at 563 Ventura Road. .. ' Motion A. V. Bolton, Seconded N. E. Brenner, that the motion of previous meeting be amended on authorizing the firm of Merritt and Welker engineering ,f�m to obtain bids on new and used water tanks with in- vitation to be extended to Brown Steel Co. of Griffin, Georgia. With closing date on submitting bids to be November 3, 1956, at 10 A.M.
