03-11-1957 Continued Regular Meeting312 The regular meeting of Mayor and Council was held March 4, 1957, 8:00 P. M. at the City Hall, Mayor James E. Quarles presiding with the following councilmen present. N. E. Brenner, A. S. Dowd, J. E. Johnosn, D. M. Scarborough,anA J. G, White.and R. H. Wood. Alen Adair, spokesman for the proposed*car club and drag strip to be located out side City on Hurt Road..requested`indorsement by Mayor and Council Or said club. Mr. Williams and Mr. Pearson of Wills Street requested approximat date of installing sewer line on Wills Street to give service for 15 houses. Hearing opened on Mr. Billie H. Livingston case, appealing Judge Kelley's descision on traffic violation. Testimony given by Officer Lee Poss and Mr. and Mrs. Livingston. Motion J. E. Johnson, seconded D. M. Scarborough that the Council uphold the descision* of Judge Kelley. Hearing opened on James E. Bardin case, appealing Judge Kelley's descision on traffic violation. Testimony given by Officer Poss and H. E. Brown. Motion A. S. Dowd, seconded J. E. Johnson that Judge Kelley'si descision be sustained. voted unanimous. Motion Sonenberg, seconded Brenner that the descision to revoke Mr. Bardin's drivers license be overruled. Voted unanimous. Harold S. Willingham arrived. Motion D. M. Scarborough, seconded A. S. Dowd, that Harold S. Willingham be appointed City Attorney, retroactive until January 1, 1957, subject to comply to the ordinance that is being drawn concerning duties of City Attorney. Voted unanimous.* Willingham led discussion on Northcutt Subdivision. Motion J. E. Johnson, seconded D. M. Scarborough to waver the reading of ihe'minutes of the last meeting until the next meeting to be held llth of March, 1957. Voted unanimous. Motion N. E, Brenner, seconded D. M. Scarborough that the second request of G, F. Brown to rezone the property located off the northwest corner of Love Street and South Atlanta Street be set for April 1; 1957. Voted unanimous. Notion N. Johnson, seconded Scarborough that the minutes of the February meeting' be adopted. Mr. Homer Clackum's letter read concerning his car stolen' in Smyrna, Reffirred to Police Committee. C. E. Barbour of 134 Bank Street, requested by letter reconsideration on erecting sign 313 on his property. Motion Sonenberg, seconded Johnsen that the action of the Council one month ago be given reconsideration and permission be granted to erect sign. Substitute motion by A. S. Dowd, seconded J. E. Johnson that the former.action of . Council be stricken, that the application for erecting a sign be submitted to Engineer Pressley (Building Inspector) subject to his approval.and-if.application'be in ac- cordance with the provisions of City Ordinances be approved and if opposed, be denied. I' Voting for: Johnson, Dowd, Scarborough. Against: Wood Brenner and White. Sonenberg withdrew his original motion. Motion J. E. Johnson, seconded J. G. White that the five (5Y minute parking signs be erected in front of Post Office for a space of two (2) car lengths. Voted unanimous. Motion Scarborough, seconded J. G. White that the City Superintendent be authorized to get ltices to have Adams Pool Road fixed with. Automotive Parts Company,\given oportunity to fix patrol cam at no cost to City and referred back to the Street and Finance Committee for their Approval and action. Voted unanimous. Written opinion on the improvement on Bank Street request of Attorney W llingham. f MoVioonn J. G. White, seconded Murray Sonenberg that the Fire Committee recommended that the City adopt the National Fire Code. Voted unanimous. Motion J. G. White, seconded Sonenberg that when the Fire Marshall finds a violat�en of the Fire Ordinance, that a written notice be given said violator with 15,days to be allowed for correcting said conditions. Fine for failing to comply with warning not to exceed $100.00. oted unanimous. i Motion J. G. White, seconded Sonenberg, that the same penalty to cover violators of , the Electrical Code. Voted unanimous. Councilman Sonenberg reported that the contracts Committee met on February 28th. Copy of their report read with Motion that the contracts for construction in City be awarded as outlined in review from Committee with formal contracts to be prepared by Attorney for make up. Seconded J. E. Johnson. Voted unanimous. Copy of said review attached to these minutes and made a part thereof. Motion Sonenberg, seconded Johnson that,the Contracts Committee be authorized to negotiate the sale of equipment subject to approval of Council. Voted unanimous. Motion N. E. Brenner, seconded J. E. Johnson that when a resident wants an additional sewer tap, the second sewer tap on same plated-46t-b&.450.00�- Voted unanimous. Motion N. E. Brenner, seconded R. H. Wood that the property owned by Thomas J. Northcutt, Inc., William J. MacKenna, Argyle Realty Co., and A. L. Crowe designated on plat submitted adjoining existing City Limits of City of Smyrna be on application of Thomas J. Northcutt, Inc., William J. MacKenna, Argyle Realty Co. and A. L. Crowe accepted into City of Smyrna. Copy of Ordinance and said plat attached to these mint►tes and made a part thereof. Voted unanimous. y Motion N. E. Brenner, seconded R. H. Wood that the request of J. L. Sappington, Jr., assistant Vice -President of Kennesaw Mortgage and Investment Co., to rezone th$ property located at the southeast corner of Pai; Mell Road and Old Concord Road be set for April 1, 1957s 8:00 P.
