02-07-1955 Regular Meeting210 The regular meeting of the Mayor and Council was held at the City Hall. February 7,-1955,at 7:45 P.M. Mayor' James E.' Quarles presiding with the fcrllowing� *councilmen present: N.E. Brenner, John S. Collier, A.M. Poston, V.R. Siddall and G.R. Yarbrough. City Attorney Harold Willingham present. Minutes -of previous meetings of January read. Motion by N.E. Brenner, seconded',by A.M. Poston to ,adopt minutes as read. Voted unanimous. Mr. Henry Withen1 of 411 Le'e St. read, turned over to Mr. Watts, request that his water meter be City Supt. Mr. A.V.'Bolton.. presented a petition to Mayor and'Council requestin, that beer be sold in food stores. Rev. York Chambless and Rev. Roland Walker each presented petitions requesting that beer be kept; out of the food stores. Councilman,A.M. Poston reported that the A.& P. Food Store had made application for beer license. Motion by A.N. Poston, seconded by V.R. Siddall that the business license for the sale of beer for the A.& P. store be granted. Y Voting for- Poston, Siddall, Brenner; and Yarbrough, Voting against, Collier. Finance Statement read by Councilman Collier. Fire 'Chief John�Themas report of Feb. 1, 1955 read by Councilman Collier. Motion by John S. Collier,' seconded by G.R. Yarbrough that Fred McRae be rehired as Electrical Inspector for 1955. Voted unanimous., - Motion by John S. Collier, seconded by A.M. Poston that application for fire protection outside city be accepted within„a 2 Mile radus of the fife station. Fee to be $151.00 for houses and $35.00 for business. All to expire Dec. 31, 1955. Payment for balance of the year to be prorated on Monthly basis. Voted unanimous. V.R. Siddall read the Street Committee report of their meeting. Motion by G.R. Yarbrough', seconded by A.M.'Poston that Mr. Watts be authorized to purchase a 3/4 ton pickup truck for the water dept. to be paid for from' the water Dept'. Bids to be obtained from not less than 3 firms. Voted unanimous. V.R. Siddall read the Pabks and Building Committee report of their meeting. Motion by V.R. Siddall, seconded by N.F. Brenner that Mr. Grist be authorized to survey and make plat, and be paid for same of 9 acres that Belmont Hills Co. had offered to the City for a park, Voted unanimous. Motion by N.E. Brenner, seconded by A.M. roston that W.L. Westbrooks be relisted.,as Plumbing Inspector for 1955. Voted unanimous Motion by N.E. Brenner, seconded by V.R. Siddall that they would like fox it to go on record thanking; -in the form of a letter, the three members of the legislature in putting thru the bills in the behalf of the City of Smyrna, Voted unanimous. Section 5. Be it further ordained that it shall be unlawful for any pool room to remain open after 11 o'clock at night, or allow an�r aa.-ies- played. on pool tables, and where other business, proprietor or operator of such business shall keep dark and not -tIllow public access to the part of building in which pool t.-i.bles are located. flnd all windows and doors facing th : streets must be kept clear of all Posters, signs, paint or other obstucl s that would cut off the view of the p<a ssing pedestrians. Section 6. Be it further ordained it shall be unlawful for any per son, firm or corpor�.tion to sell or offer to sell any beer or melt beverages of intoxicating nature after 11:00 at night. Section 7. Be it further ordained by the authority aforesaid that all licenses issued under this ordinance for specific or special license tat shall be posted conspicuously in the place of business of the person, firm or corporation to whom the licenses are issued, and upon their failure to do so, the license in the discretion of the T-1 Lyor., shall be revoked and they shall be punished as prescribed in Section 55 of the Code of said City. Section 8. Be it further ordained by the authority aforesaid th�1t the M Iyor or the City shall have the right to revoke any license issued under this ordinance, whether a person doing business under such lic3n-se shall viol-,Ite any law or ordinance of the United Stt.a.tes, or of the State of Georgia or of the Town of Smyrna, in pursuance of such business conducted under such license, or irhen it shall be proven before the Mayor that the health, ^nor^.ls, interest and convenience of the public demand the revoca.t.icn of such license or the person, firm or cornoration holding such license W-_IS issued, and said Mayor shall report his revocation of such license to the next regular meeting of the City Council for their ratification or rejection and should the action of the Ilayor be sustained by the Countil, then the said license shall be permanently revoked, otherwise it shall be restored. and remain in full force. Section 9.. Be it further ordained btr the authority aforesaid that the license issued under tht ordinance shall transferred to any vi°her person, firm or corporation doing the same business �.t th-ti, s:a.r.e place or places of business,. upof written approval of sc'a transfer, by the lIaqyor 6f this City, who shall have full discretion to approve or disapprove such transfer, Section 10. Be further ordained by the authority of the aforesaid that any pe °sons w'no s'r Il begin ol. carry on any said business or occuncIt4ons without first obtaining said license as prescribed abojre, shall upon conviction,, be final,?. by the Mlayor in a sure not exceeding p100.00 or in defcault of the payr ent thereof shall be required to work on the streets of s,,aid City not exceeding fifty days. Be it provide. that if any section, Paragraph or .rt of this ordinance shall for any reason be adjudged by a court- to be invalid, such judgement shall not affect the remainder of the Ordin!ance.
